The original will be forwarded to the City Clerk for filing. As we have discussed, the agreement has been modified to indicate the parties intent to cooperate in meeting their respective statutory responsibilities under Chapters 26.44 and 74.34 RCW. Thank you for your cooperation and assistance in revising the proposed agreement to make it more acceptable to the City. PURPOSE: ADULT PROTECTIVE SERVICES /LAW ENFORCEMENT AGREEMENT BETWEEN R/4 A.+�Cj o� g C P I 1 I2)ept AND DEPARTMENT OF SOCIAL AND HEALTH SERVICES AGING AND ADULT FIELD SERVICES OFFICE This agreement is made to set forth the system f r cooperative investigations between ,f "A, ro %l of l yand Adult Pro- tective Services. It is the intent of this agreement to provide efficient and effective means for investigation of cases. Additionally, it is the desire of the parties to this agreement to promote the cooperative sharing of information and coordination of services. II. PROGRAM AUTHORITY ADULT PROTECTIVE SERVICES: A) STATE: (1) Chapter 74.34 RCW Abuse of Vulnerable Adults (2) Chapter 26.44 RCW Abuse of Children, Adult Dependent Person and Developmentally Delayed Adults. B) FEDERAL: (1) 42 U.S.C. 1397 To furnish services directed at the goal of preventing or remedying neglect, abuse or exploitation of adults unable to protect their own interests. III. ADULT PROTECTIVE SERVICES POPULATION: Adult Protective Services are provided to any vulnerable adult, developmentally delayed adult or adult dependent person who is being physically or sexually abused, financially exploited, neglec- ted or abandoned. Provision of services include investigation, the offer of supportive services and referral to other appropriate agencies. A) "Vulnerable adults" are persons sixty years of age or older who have the functional, mental or physical inability to care for himself or herself. B) "Adult dependent persons" are individuals over the age of eighteen years who have been found legally incompetent pur- suant to Chapter 11.88 RCW, or found disabled to such a degree pursuant to Chapter 11.88 RCW that such protection is indi- cated. ECE1V I- 3 KT .A Citf AT/UM APS Agreement Page Two IV. PROCEDURE: C) "Developmentally delayed adults" are persons defined as dis- abled according to Chapter 71.20.016 RCW. A) Reporting to the department (Adult Protective Services) 1) Any person having reasonable cause to believe that a vul- nerable adult has suffered abuse, exploitation, neglect, or abandonment, or is otherwise in need of protective services may report such information toE.the.e department (Adult Protective Services) J Aivgq e2 e.6 PeD4) LE' 1 shall make an immediate oral report of information to the department and shall report such information in writing to the department within ten calendar days of receiving the information (Chapter 74.34.030 RCW). 2) Any law enforcement agency receiving a report of an inci- dent of abuse or neglect involving an adult dependent or developmentally disabled person shall report such inci- dent, or cause a report to be made to the department (Adult Protective Services). In emergency cases, the law enforcement agency shall notify the department within 24 hours; in all other cases, 72 hours (Chapter 26.44.030 RCW). B) Reporting to Local Law Enforcement 1) The department, upon receiving a report of an RCW, inci- dent of abuse or neglect pursuant to Chapter 26.44 RCW, involving an adult dependent or developmentally dis- abled person who has died or has had physical injury or injuries inflicted upon him or her other than by accidental means or who has been subjected to sexual abuse, shall report such incident to the proper law enforcement agency. In emergency cases, notify the proper law en- forcement agency with 24 hours after a report is received by the department; in all other cases, 72 hours. If the department makes an oral report, a written report shall also be made to the proper law enforcement agency with five days there- after (Chapter 26.44.030 RCW). 2) If there is reasonable eause to= believe :that a:crime has been committed against a recipient of Adult Protective- Services APS shall make a report to Pe> ,tic4.P,5 Patj.e' Fj��. APS Agreement Page Three V. AMENDENT: The terms of this agreement may be changed upon mutual agreement of all parties.
