I cannot help much at this stage.
I inspected the foundation and found that it is inadequate.
I did not look at the structure above and therefore cannot comment one way
or the other
It seems to me that the City should make the next move.
Also, we have not been hired to do anything, so I'm just waiting.

condition of the structure. If its not a problem, please state the case so i

Set backs are mostly a regulatory issue.
They are not a design consideration, in my opinion.
We could put in pilings or deep concrete and keep the same garage foot
print.
I have a feeling this will not happen due to high cost.
Keep me posted on progress.

After meeting with you last week, I stopped at the City office and discussed your
situation with Jim Lierly Building Inspector (Pat Bartholick was out but Mr Lierly was
familiar with your house
As you know the City is concerned over settlement of the garage foundation and has
determined that is an unsafe condition I inspected the west side exterior and all
foundation visible from the interior The west side of the garage and the west and south
sides of the backyard are on fill dirt, retained by a timber wall The wall consists of
vertical pilings spaced 10 to 12 feet apart and behind the pilings are horizontal 4x12
planks that support the soil From my observations it is apparent that the garage has
settled Although I believe that it is not facing an imminent danger I cannot say that it is
100% safe
Because of the very steep slope down from the timber wall and from the way it is built,
in my opinion that there is no economically feasible way to fix this problem Also Mr
Lierly stated that the rooms above the garage may not comply with structural and
possibly other building code requirements It is possible that these rooms were built
without benefit of a City issued building permit.
Therefore I believe that one option is to remove the garage and the rooms above and
then rebuild what has been removed With the building above gone it will be possible to
construct a proper foundation so that soil instability is no longer a concern The garage
and second floor rooms could then be replaced Unfortunately this will be an expensive
undertaking very likely over $100 000
One other option is to convince the City that the house is safe The City's `unsafe
determination was made over 10 years ago nothing has happened since then and the
City did not pursue its threatened abatement process This option should be
investigated by a lawyer I would be happy to assist if requested
I am sorry that I do not have a better solution to offer Please let me know how you
would like to proceed
