RE. Operation of construction equipment within the City's nght of way
On Fnday January 22, an Affordable Roofing crane was observed off loading roofing matenal on West
5 Street and at South Cedar Street. The crane stabilizers extended out into the traffic lane. Your
employee had placed cones tapering around the equipment, but this does not meet the Manual on
Uniform Traffic Control Devices (MUTCD) traffic safety legal authonty requirements for this type
of traffic diversion.
Traffic safety can be accomplished through the use of a flag man or other protective measures such
as advance warning signs per MUTCD Sec VI. The use of traffic cones alone are not adequate.
City ordinances require you to obtain a Right of Way Use Permit before you obstruct any City street or
right of way Use of the City's street nght of way for the off loading of construction materials will
require an approved traffic control plan as part of the required nght of way use permit. Obstruction of
City street or sidewalk is prohibited unless an approved nght of way use permit is issued.
Failure to comply and obtain a nght of way use permit and agreeing to use appropnate traffic safety
measures may cause a halt to your operation and a citation may be issued.
