AGREEMENT
We the undersigned, property owners of land located at the southernmost end of
Fairmount Avenue, Port Angeles (Clallam County) Washington 98363, connecting to
Highway 101 and lying between the Fairmount Grocery and Shell Gas station to the east
and the Welcome Inn Trailer Park to the west, and described as follows

Libera address 4404 Fairmount Avenue, Port Angeles, WA. 98363
Rigg parcel number•063008582100
Rigg address 4412 Fairmount Avenue, Port Angeles, WA. 98363
Parties to this agreement hereby attest and agree as follows That in the process of
developing the Libera parcel which is the northernmost piece of these two (2) pieces
which are a part of this agreement, a driveway entrance needs to be wider and installed
on city right -of -way which fronts both pieces and is used by both owners and their
tenants for access. Accordingly, any driveway, sidewalk, curb or gutter to be installed
will need to be partially on the Rigg parcel's nght -of -way which is the southernmost
piece of these two pieces.
It is further agreed that any expense of design, material or labor for said improvements
shall be at Libera's expense and that both parties shall have permanent and legal access to
their respective properties in the future. Also, if any repair or modification shall be done
at any time in the future, it shall be at the City's expense.

The •Storni water Management Manual for the State bf Washington directs the
necessary elements of a drainage plan and..erosion .control -for development within
.Clallam County andthe City of Port Angeles This-- planwill address the necessary
elements .so that rainfall run- off be controlled in a manner which. will* make it so
adjoining. parcels will not see any adverse effects as a .result of this project..It
will also control the. location of infiltration systems..so that the existing atormwater
.systems will not be adversely affected
The site is Clallam gravelly. sandy loam that is moderately well .drained soil The
permeability of this Clallam. soil.is_ moderate to the compact .glacial till and very slow
through it. This requires a very Iow:infiltratibt rate' :for any drainage handling system
The :site is at 4404 Fairmount Avenue This is located- in Section -8, Township 30 North,
and Range 6 West, W M This is near State Route 101 west of Port Angeles
The attached analysis shows that this building and parking lot requires 112 feet .of
infiltration system The building source of runoff is relatively clean so .perforated piping
in 2'x2' infiltration trenches from the :building to the catch basins allows most of this to
infiltrate away at -the. slow rate of the site soils This creates 1.37 feet of infiltration
As insurance of coverage the asphalt or concrete parking and driveway will be routed to
the catch basin /oil water separators This will contain any oil spill before ,the drainage
enters the infiltration piping and'the added 10 cubic yard dry well The dry well is about
5 feet deep and about.five feet by seven feet at the outlet of the- south east oil water
separator This adds enough capacityto handle the driveways alone The overflow of
the dry well is then routed to the existing catch basin along Fairmount Avenue at the
south -east corner of the property
With these two systems working together the entire system is at least 50% over
designed Thus with the two oil /water separators "managing.any potential contamination
the .system is designed to function long term

appears "to me that they are still valid_for the proposed facility f determined the runoff of

There..are,some minor revisions that could be made now that Mr Libera, is planning a
Latte Stand with .a slightly wider parking, and drive in front of the building This is so
minor compared c the original design that the proposed s ,terr will easily handle the
additionatrunoff.

In reviewing your site development plans (Building Permit 07 1174) for 4404 Fairmount Avenue it is
clear that the site plans do not adequately address a number of elements required by the City's
development standards and State stormwater requirements Stormwater issues have significantly
changed since your original submittal several years ago and so were not part of the original
submittal materials However you were contacted during the review process to provide additional
materials and discussion with Inspector Roger Vess indicated that a fundamental element missing
from your plans is a site erosion and sediment control plan which has not as yet been received
Further site inspections cannot occur until the stormwater plan is approved and erosion control
measures are installed inspected and accepted by the City's Public Works Utilities Engineering
Division
Please have your engineer address the following issues
1 Show driveway locations and detail identifying width slopes, and clearances from utilities
per City standard details
2 Show road cross section for Fairmount Avenue
3 Roadway asphalt taper length along Fairmount Avenue based on 35 MPH and detailed
improvements to ditch including existing catch basins at north south property corners and
beyond
4 Submit stormwater design and calculations to meet current requirements per 2005 Storm
Water Management Manual for the parking area downspouts and perimeter drains, and
design to include catch basin with curb inlet at south end of curb gutter
5 Submit an engineer's design showing the location of the proposed espresso stand traffic
flow and utility connection locations (Although your proposed designation for the stand on
the original plan is understandable, the original drawings are stamped by an engineer and
cannot be changed in any way

The interceptor shall have an interior baffle for full
separation of the interceptor into two (2) sections. The
outlet pipe shall be the same size as the inlet pipe of the
sand interceptor, the minimum being three (3) inches
(80 mm), and the baffle shall have two (2) openings of
the same diameter as the outlet pipe and at the same
invert as the outlet pipe. These openings shall be
staggered so that there cannot be a straight line flow
between any inlet pipe and the outlet pipe. The invert
of the inlet pipe shall be no lower than the invert of the
outlet pipe.
The sand interceptor shall have a minimum
dimension of two (2) feet square (0.2 m for the net free
opening of the inlet section and a minimum depth under
the invert of the outlet pipe of two (2) feet (610 mm).
For each five (5) gallons (18.9 L) per minute flow
or fraction thereof over twenty (20) gallons (75.7 L)
per minute, the area of the sand interceptor inlet
section is to be increased by one (1) square foot (0.09
m The outlet section shall at all times have a
minimum area of fifty (50) percent of the inlet section.
The outlet section shall be covered by a solid
removable cover, set flush with the finished floor,
and the inlet section shall have an open grating, set
flush with the finished floor and suitable for the
traffic in the area in which it is located.
1016.3 Separate Use. Sand and similar interceptors for
every solid shall be so designed and located as to be
readily accessible for cleaning, shall have a water seal of
not less than six (6) inches (152 mm), and shall be vented.
>n 1017.0 Oil and Flammable Liquid Interceptors.
1017 1 Interceptors Required. All repair garages
and gasoline stations with grease racks or grease
pits, and all factories that have oily flammable, or
both types of wastes as a result of manufacturing,
storage, maintenance, repair, or testing processes,
shall be provided with an oil or flammable liquid
interceptor that shall be connected to all necessary
floor drains. The separation or vapor compartment
shall be independently vented to the outer air If two
(2) or more separation or vapor compartments are
used, each shall be vented to the outer air or may
connect to a header that is installed at a minimum of six
(6) inches (152 mm) above the spill line of the lowest
floor drain and vented independently to the outer air
The minimum size of a flammable vapor vent shall not
be less than two (2) inches (50 mm), and, when vented
through a sidewall, the vent shall not be less than ten
(10) feet (3048 mm) above the adjacent level at an
approved location. The interceptor shall be vented on
the sewer side and shall not connect to a flammable
vapor vent. All oil and flammable interceptors shall be
provided with gastight cleanout covers that shall be
readily accessible. The waste line shall not be less than
three (3) inches (80 mm) in diameter with a full -size

cleanout to grade. When an interceptor is provided
with an overflow it shall be provided with an overflow
line (not less than two (2) inches (50 mm) in diameter)
to an approved waste oil tank having a minimum
capacity of five hundred fifty (550) gallons (2,080 L)
and meeting the requirements of the Authority Having
Jurisdiction. The waste oil from the separator shall flow
by gravity or shall be pumped to a higher elevation by
an automatic pump Pumps shall be adequately sized
and accessible. Waste oil tanks shall have a two (2) inch
(50 mm) minimum pump -out connection at grade and
a one and one -half (1 1/2) inch (40 mm) minimum vent
to atmosphere at an approved location at least ten (10)
feet (3,048 mm) above grade.
1017.2 Design of Interceptors. Each manufactured
interceptor that is rated shall be stamped or labeled
by the manufacturer with an indication of its full
discharge rate in gpm (L /s). The full discharge rate to
such an interceptor shall be determined at full flow
Each interceptor shall be rated equal to or greater
than the incoming flow and shall be provided with an
overflow line to an underground tank.
Interceptors not rated by the manufacturer shall
have a depth of not less than two (2) feet (610 mm)
below the invert of the discharge drain. The outlet
opening shall have not less than an eighteen (18) inch
(457 mm) water seal and shall have a minimum
capacity as follows: where not more than three (3)
motor vehicles are serviced and /or stored, interceptors
shall have a minimum capacity of six (6) cubic feet (0.2
m and one (1) cubic foot (0.03 m of capacity shall be
added for each vehicle up to ten (10) vehicles. Above ten
(10) vehicles, the Authority Having Jurisdiction shall
determine the size of the interceptor required. Where
vehicles are serviced only and not stored, interceptor
capacity shall be based on a net capacity of one (1) cubic
foot (0.03 m for each one hundred (100) square feet (9.3
m of surface to be drained into the interceptor, with a
minimum of six (6) cubic feet (0.2 m3).
