About two weeks ago, I phoned you to discuss the lack of compliance with conditions of a
mitigated determination of non signficance (MDNS 1208) that was issued to you with
regard to a National Pollution Discharge Elimination System (NPDES) permit required of
the Department of Ecology for the above referenced development. We spoke regarding the
MDNS requirement to revegetate an area along Maple Street that was to have been
accomplished no later than November 30, 2007 The work has not been done and must be
done immediately Our conversation ended without agreement by you as to your plan, but I
hoped to hear from you in the meantime. This letter is written in hopes that enforcement is
not necessary to resolve this matter
Although I can well understand your disappointment that the homes have not sold, and that
the economy has turned sour, the completed residences may appear more desirable to
prospective purchasers with the area revegetated and in compliance with all required
permits. Toward that end, please contact this department either by mail or phone within the
next week to make clear your intent in this matter The conditions cannot be ignored. The
City administration would appreciate working with you to obtain compliance in this matter
within the next month. Spring is a good time to plant.
