Annie,
1 am in receipt of your letter to me dated April e, 2012, requesting a reduced side
lot line setback for a driveway_ Specifically, a reduction from 7.5 feet to 5 feet as
shown on the attached site plan. 1 have reviewed the facts set for in your letter,
which is provided as an attachment, as well as discussed the matter with IDCEID
and members of my staff. Also at issue is the proposed driveway's proximity to
an existing PUS power pole.
The primary purpose of the setback is to provide adequate separation between
adjacent driveways_ The existing driveway to the home to the north is adjacent to
its north lot line, not the lot line common to both lots_ In addition, you provided an
email indicating PUS is alright with the proposed driveway location provided the
driveway users will be responsible for any damage they may cause if the pole is
struck by a vehicle_ As such, 1 am able to grant the reduced 5 foot setback to the
side lot line for this location_

The Peninsula Housing Authority has been developing Peninsula Village with "Self -Help
Housing". As we approach the final phase of the development, an issue has arisen that was
initially approved but is being rescinded by Roger Vess.
Lot #19 at the southwest most corner of the development has a PUD power pole located 18'
south of the north property line. Originally the Site Plan reflected a driveway 5' from the
north property line flush with the proposed home: The setbacks in this Planned Residential
Development allow for buildings to be placed up to 5' from the property line. It was
assumed that the PRD building setbacks dictated the driveway setbacks as long as the 15'
distance was met between adjacent driveways.
Roger Vess referred me to Eric Walrath who, in turn, suggested 1 request permission from
you to place the driveway approach 5' from the north property line.
Please consider the following points:
The adjacent neighbor's driveway is on their northern property line providing much more
than the prescribed 15' between driveways.
The proposed home has an oversized single car garage with an 8' garage door.
The guidelines allow for parking up to 5' from the property line.
"Flipping" the house is not a viable option as the tot has significant setbacks on three
sides and the house footprint was predicated on the unique shape of the buildable area.
The cost of $2110.00 to relocate the power pole is a hardship for the landowner.
We propose two options given the power pole's current location:
5' setback from the property line to a 12' wide driveway, or
7'-6" setback from the property line to a 9' wide driveway

Washington State Energy Code, (2009 edition). This set is for structures built under the IRC and located
in Climate Zone 1.
The following forms provide much of the required documentation for plan review. The details noted here
must also be shown on the drawings (WSEC 104.2).
This form is not a substitute for the energy code itself. To obtain a copy of the energy code,
