Dear Bill:
This is a follow up e -mail to confirm our phone conversation yesterday (June 20) regarding 1133 E. 9th Street. It is
disappointing that Mr. Targett is not pursuing the street vacation at this time. A successful vacation would smooth the
way for him to do further improvements to the property and ensure that those portions of the structure located within the
setback area can be enhanced and repaired if needed. A good portion of the northeast corner of the house is also in an
area that, if severely damaged, may not be replaceable. I assume you discussed this information with the client, and he has
made his decision known to you.
This e -mail then is to confirm our discussion that the garage will not be enclosed because that would require construction
of a wall within the setback area to support a door. Work within the carport will be outside of the 13 foot setback area
with the exception of roof supports that are being done because you stated that you do not believe the structure is safe as
built. Even though the structure has withstood some pretty severe weather over the past years without appearing to have
been damaged, repair to maintain safety is permissible in nonconforming situations.
I am sorry that these issues seem to have been overlooked even though we did discuss the project prior to construction,
but am glad that we were able to work through them with some success. I hope that if the time comes when Mr. Targett
determines he would like to do additional work that the situation hasn't changed such that he is unable to acquire
additional area to make the property conforming. We deal with nonconformities on a pretty regular basis given the age of
our City, but the main intent is to ease them into nonexistence, not encourage extension of use. I hope things work out
for the property owner such that he is happy with his new living unit.
