HomeMy WebLinkAbout000522 Original ContractThis contract is entered into between the City of Port Angeles, an optional municipal code city of the State of Washington (hereinafter referred to as "City and Larry Dunbar, (hereinafter referred to as "Temporary Employee In consideration of the covenants and promises set forth herein, the parties hereto agree as follows: 1. Scope of Services. Temporary Employee agrees to provide the City with services as follows: City of Port Angeles Record 000522 TEMPORARY EMPLOYMENT AGREEMENT LARRY DUNBAR Advanced Metering Infrastructure System construction project management. Continue project management role including acting as the single point of contact for the Mueller Systems project manager. Organize and carry out weekly project management meetings and weekly project team meetings. Maintain list of outstanding issues and prepare revisions to the implementation plan. Review and approve invoices. Wireless Mobile Data System construction project management. Continue project management role including acting as the single point of contact for Capacity Provisioning, Inc. project manager. Organize and carry out every-other week project management team meetings. Oversee Columbia Telecommunications professional services and City project coordinator construction log. Review and approve monthly invoices. Preparation of a request for qualifications for the triennial cost -of- service studies and tax audits oversight for all utilities. This needs to be completed by the end of this calendar year. Collaboration (as directed by Director of Public Works and Utilities) on special Issues with Industrial Transmission Customer (e.g., Cogeneration Utility Taxes). Staff training on the Annual Capital Facilities Plan facilitation. This needs to be completed in January 2013. Staff training on Microsoft Excel macros used to prepare monthly utility statistics. This needs to be completed in January 2013. Preparation of a request for qualifications for the Cable Television franchise formal renewal process oversight. This needs to be completed by the end of 2013. 2. Term. This contract shall commence on November 5, 2012 and shall continue until December 31, 2013, unless sooner terminated pursuant to paragraph 4 or unless extended by mutual agreement of the parties. 1 3. Work Hours. Parties agree that Temporary Employee shall be available to provide services to the City not less than 20 hours, and not more than 69 hours, per month. 4. Termination. Either party may terminate this contract at will upon ten (10) days written notice to the other party. 5. Compensation. Temporary Employee's compensation for the services performed herein shall be at the hourly rate, not exceed the total amount of $46.65. Temporary Employee shall submit itemized invoices to the City Manager, and the City shall make payment to the Temporary Employee within thirty days of submittal of acceptable invoices. If a 2% COLA is approved by City Council for management and administrative employees, then the rate will increase to $47.58 for hours worked after January 1, 2013. 6. Relationship of Parties. The parties understand and agree that Temporary Employee is a temporary part-time employee, not a full -time, regular employee of the City. City shall assume full responsibility of all federal, state, and local taxes and contributions imposed or required, including, but not limited to, unemployment insurance, Social Security, and income tax withholding. Temporary Employee shall not be entitled to medical insurance, vacation, sick leave, or any other benefits provided by the City to its regular, full -time employees. 7. Breach of Contract. Each party shall have all remedies provided in law or equity for breach of any provision of this contract. 8. Applicable Law and Venue. This contract shall be governed by, and construed in accordance with, the laws of the State of Washington. Venue of any legal action related to this contract shall be in Clallam County, Washington. 9. Modification. This contract may be modified, or its term extended, by written modification hereto.
