HomeMy WebLinkAbout000525 Original ContractCity of Port Angeles Record #000525 MEMORANDUM OF AGREEMENT UNITED STATES COAST GUARD AND CITY OF PORT ANGELES REGARDING INSTALLATION OF WIRELESS ACCESS POINTS ON THE U.S. COAST GUARD INSTALLATION LOCATED ON EDIZ HOOK, PORT ANGELES, WASHINGTON 1. PARTIES. The parties to this Agreement are the United States Coast Guard (USCG) via Air Station /Sector Field Office Port Angeles (USCG), and the City of Port Angeles Washington. 2. AUTHORITY. This Agreement is authorized under the provisions of 14 U.S.C.§ 93(a)(20) 3. PURPOSE. The purpose of this Agreement is to set forth the responsibilities of the USCG and the City of Port Angeles that will result in the installation and operation of Wireless Access Points (WAPS) onboard USCG facilities. The City of Port Angeles has undertaken a project to construct a city wide wireless fidelity (WI -FI) system designed to improve public safety and increase affordable internet access for residents and businesses. The city wide system is designed to share infrastructure with a separate first- responder network that will enable fire and police departments to have dedicated, on- demand access to information vital to public safety. This MOA will enhance the abilities of the City to provide emergency assistance to the USCG as described in the MOA between USCG, Port Angeles Police Department (PAPD) and Clallam County Sheriff's Office (CCSO) dated November 5, 2010; and as described in the MOA between USCG and Port Angeles Fire Department dated December 18, 2001. 4. RESPONSIBILITIES: USCG a. USCG will grant entry to base facilities during normal work hours for the purpose of installing, maintaining, and removing two (2) wireless access point routers which provide access to the cities Metro -Net WIFI system. b. USCG will allow the installation of two (2) wireless access point routers onboard the USCG installation at locations agreed upon by the parties. routers. c. USCG will provide electrical power required by the two (2) wireless access point City of Port Angeles a. City of Port Angeles will provide all equipment, supplies, and hardware, and labor associated with the installation of two(2) wireless access points. The equipment shall remain the property of the City of Port Angeles. b. City of Port Angeles will ensure all work associated with the installation of the wireless access points and associated power supplies is completed in accordance with all applicable industry codes(NEC, BOCA/NBC) and industry standards. c. City of Port Angeles will compensate the USCG for cost of the incidental electrical power used by the two wireless access points. d. City of Port Angeles will provide USCG with 24 hours advance notice prior to entry of USCG facilities. e. City of Port Angeles will assume responsibility for all activities of its employees, contractors, and subcontractors conducting work in furtherance of this agreement. This includes but is not limited to supervision and control to prevent injury or damage and maintenance of the property during use. f. City of Port Angeles agrees to hold the USCG harmless for personal injury or property damage caused by negligence or fault of the City of Port Angeles, its employees, contractors, and subcontractors when conducting activities authorized by this agreement. g. City of Port Angeles agrees to repair or make an appropriate settlement with the USCG for any damage to the real property of the USCG. h. City of Port Angeles agrees to restore the USCG facilities to the same condition as prior to the installation of the wireless equipment. 5. POINTS OF CONTACT. OTHER PROVISIONS. a. Nothing in this Agreement is intended to conflict with current law or regulation or the directives of the U.S. Department of Homeland Security or the U.S. Coast Guard. If a term of this agreement is inconsistent with such authority, then that term shall be invalid, but the remaining terms and conditions of this agreement shall remain in full force and effect. b. This Agreement is not an agreement by the United States, U.S. Department of Homeland Security, or U.S. Coast Guard to indemnify any party, to assume financial, legal, or any other liabilities, or to obligate or expend any funds. Additionally, nothing resulting from this agreement will constitute a violation of the Anti- Deficiency Act, 31 U.S.C. 1341 (et.seq.) 7. EFFECTIVE DATE. The terms of this agreement will become effective on the date the last party signs the Agreement and shall be effective for a period not to exceed 10 years or until cancelled per paragraph 9 below. 8. MODIFICATION. This agreement may be modified upon the mutual written consent of the parties. 9. TERMINATION. The terms of this agreement, as modified with the consent of both parties, will remain in effect until one or both of the parties terminate the Agreement. The agreement may be extended by mutual written agreement of the parties. Either party upon 30 days written notice to the other party may terminate this agreement.
