The City Commission of the City of Port Angeles do ordain as follows: Section 1. That there be and is now hereby' granted to Union Oil Com pany, a corporation, its successors and "assigns; for the term of , ( /o, years, the right, privilege and authority to construct, maintain, use and operate a standard guage railway spur or ###AW Side -track in, along, and-upon the following described portion of Third street in the city of _ Port Angeles, to -wit: commencing at the intersection "of the centerline of the main line track of the Chicago, Milwaukee &.St.Paul Railway' Company with the Southerly margin of Third street, on -the Northerly-line of Block numbered One Hundred and Three (103) of the "Townsite'of Port Angeles; thence Northeasterly on a curve to the right to a point On the center line .of A street, produced, Ten (10) feet Southerly from the northerly margin of Third street; thence Easterly along Third street; parallel with the Northerly margin of Third street, and terminating at a point opposite the center of Lot numbered Thirteen (13) in Block numbered Ninety -seven (97) of the Townsite of Port Angeles; the center line of the track to be Ten (10) feet Southerly from the Northerly margin of Third street. Section 2. The said Union Oil Company, successors and assigns, shall at all times during the life of the right, privilege and authority here- by granted, maintain and operate said spur or side track in such condition and manner that the same shall not in any way interfere with traffic over said street nor in any way endanger the life, limb or property of persons 0 using or passing along -ar upon said street. --- Section 3. Whenever and to whatever extent the grade of the said street or streets over which said spur or side track is to or shall ex- tend shall be established or changed by said city, said track shall be so adjusted and changed as to conform to said grade so established or changed, said adjustment and change to be in all things made at the cost and expense of said Union Oil Company, successors and assigns, Section 4. Failure on the part of the grantee, said Union Oil Com- pany, its successors or assigns, in the performance or keeping of any of the terms or conditions of this ordinance shall work a complete forfeit- ure of all of the rights and privileges hereby granted, and said city may thereupon declare such forfeiture and repeal this ordinance. Section 5.
