HomeMy WebLinkAbout0713ORDINANCE NO. 7/ AN ORDINANCE ordering and providing for the improvement of Pine liltreet from the North margin of 8th street to the top or break of the bluff between 2nd and 3rd streets by clearing and grubbing the full width of the street, surface grading for 15 feet on each side of the center ine of said street, and graveling for 6 feet on each side of said center ° l ine of said street, and, further, the improvement of said Pine Street by the construction of a wooden side -walk, five feet wide, on the Westerly ti side of said Pine Street from the Northerly margin of 8th street to the Southerly margin of 3rd'street, and on the Easterly side of said Pine Street from the Northerly margin of 6th street to the Southerly margin of 3rd street, and, further, the improvement. of 3rd street by the construct- ion of a wooden. sidewalk -five feet wide on the §outherly side of said 3rd street from the Easterly margin of Pine street, Easterly, to the top or break of the Valley street gulch; to connect with present zig -zag up • hill; all in accordance with local improvement resolution No. 91, and Mand specifications adopted by the City Commission of the City of Port Angeles; creating a aocal improvement district therefor, and provid- ing for payment for said improvements by special assessments upon the property in sa d district, payable by mode of "payment by bonds ". THE CITY COMMISSION of -the City of Port Angeles Do Ordain as Follows: Section 1. That the following named`st -Teets of the the city of \_ 0 Port Angeles be improved as follows, to -wit; Pine Street from the forth margin of 8th street to the top or break of the bluff between 2nd and 3rd streets by clearing and grubbing the full width of the street, surface illgrading for 15 feet on each side of the center line of said street, and graveling for 6 feet on each side of said center line of said street, and further, the improvement of said Pine street by the construction of a wooden sidewalk, five feet wide, on the Westerly side of said Pine Street from the Northerly margin of 8th street to the Southerly margin of 3rd street, and on.the Easterly side of said Pine street from the Northerly margin of 6th street to the Southerly margin of 3rd street, and, further, the improvement of 3rd street by the construction of a wooden sidewalk five feet wide on the Southerly side of said 3rd street from the Easter- ly margin of Pine street, Easterly, to the top or break of the Valley • street gulch; to connect with the present zig -zag up the hill; and that such other work be done as may be necessary in connection therewith to carry out the construction of the contemplated improvements, all in lebcordance-with plans and specifications prepared by the city engineer, filed with the city clerk, and which have been heretofore approved and adopted by the City Commission. Section 2. That the cost and expense of said improvements, includ- ing all necessary and incidental expenses, shall be borne by and assess- ed against the property included in the assessment district hereinafter created, in accordance with law and the ordinances of said city; and the said city of Port Angeles shall not be liable in any manner for any por- tion of the cost and expense of said improvements or of said district. Section 3. That there be and is hereby created and established a 0 Local Improvement District,. to be called_Local improvement District No. 91, which said district is described as follows, to -wit; 11 A11 the assess- able property between the termini of said improvements, abutting upon, adjacent, vicinal or proximate to such portions of said streets ### 04M to a distance back from the marginal lines thereof, as provided by law. Section n . Bonds bearing interest at the rate of seven per cent per annum, payable on or before twelve years from the date of issuance, shall be issued in payment of the cost and expense of said improvements, IPwhich bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property in said district, payable in ten equal annual installments, with interest at said rate, under the mode of "payment by bonds" as defined by law and the ordinances of said city of Port Angeles. These bonds may be delivered to the contractor in redemption of warrants on the local. improvement district fund, issued on estimates of the city engineer, or the City of Port Angeles at its elect- ion may sell said bonds and make such redemption in cash. Section 5. This ordinance shall take effect and be in full force after its passage and approval and from and after five (5) days after its lawful publication. r Passed first reading /7w, 1922.
