HomeMy WebLinkAbout0715ORDINANCE No. 7 AN ORDINANCE ordering and providing for the construction of a lateral sewer, commencing at the manhole on the center line of the alley between fourth and Fifth streets on Francis street in the city of Port Angeles; and thence Easterly, along the center line of said alley, through locks 175, 176, 177 and 178 of the !ownsite of Port Angeles, Wa shington, and terminating on the Easterly margin of said block 178, a distance of about 2045 feet, together with all necessary man - holes, .catch basins, flush tanks, openings and wyes within the boundaries of the district here- inafter described, and all other work in connection therewith which may be necessary; creating local improvement district No. 93; and providing for the payment of the cost and expense thereof by special assessments upon the property within the said district according to law and by the mode of "payment by bonds ", all in accordance with improvement resolution No. 93 of the City of Port Angeles, and in accordance with maps, plans . and specifications prepared by_the=_City Engineer and approved-and adopted by the City Commission. THE CITY COMMISSION of the CITY OF PORT ANGELS do ORDAIN as follows: First. That there is hereby ordered the construction of a lateral sewer, commencing at the man -hole on the center line of the alley between Fourth and Fifth .streets on Francis street in the city of Port Angeles; and thence Easterly, along the center line of said alley, through blocks 175, 176, 177 and 178 of the Townsite of Port Angeles, Washington, and • terminating on the Easterly margin of said block 178, a distance of about 2045 feet, together with all necessary man - holes, catch basins, flush • tanks, openings and wyes within the boundaries hereinafter described, and all other work in connection therewith that may be necessary. The sewer pipe for said sewer to be so constructed hereunder shall be first ciaS$ vitrified clay, cement, brick or other suitable material. All of said improvement to be done in accordance with reaps, plans and specifications prepared by the City Engineer and adopted and approved by the City Comm- ission, and in accordance with improvement resolution No. 93 of the city 4 of Port Angeles. Second. That the cost and expense of said improvement,, including all necessary and incidental expenses, shall be borne by and assessed against the property situated and included within the boundaries of the district lereinafter created. and described, in accordance with law and the ordin- ances of the city of Port Angeles; and said city shall not be liable in any manner for any part of the cost or expense of said improvement. l; 'hied. That there is hereby created a local improvement district to `" be called "Local Improvement District No. 930, which said district is described as follows, to-wit; All of the territory which may be severed by said lateral sewer, as herein ordered to be constructed, situated in blocks 175, 176, 177 and 178 of the fownsite of Port Angeles, Clailam County, Washington. Fourth. Bonds bearing. interest at the rate of seven per cent (7 %) per annum, payable on or before twelve years from the_ date of their issue, shall be issued in paymeng of the cost and expense of said improvement, which bonds may be redeemed by the collection of special assessments to be levied and assessed against the property within said district, payable in ten annual installments, under the mode of "payment by bonds" as pro- vided by law, 'these bonds may be delivered to the contractor in redempt- ion of warrants on the special fond of the local.improvement district herein created, on estimates of the city engineer, or the said city, at its election, may sell said bonds and wake such redemption in cash or cash warrants.
