HomeMy WebLinkAbout0722ORDINANCE NO. 7 c c AN ORDINANCE approving and confirming the assessments and assessment roll in and for local improvement district No. 91, under Ordinance No. 713, for the improvement of Pine Street from the North margin of Eighth Street to the top or break of the bluff between Second and Third Streets, by clearing and grubbing the full width of the street, surface grading • for fifteeh feet on each side of the center line of said street, and graveling for six feet on each side of the center line of said street, and, further, the improvement of said Pine Street by the construction of a wooden sidewalk, five feet wide, on the Westerly side of said Pine Street from.the kortherly margin of Eighth Street to the Southerly mar- gin of Third Street, and on the Easterly side of Pine Street from the Northerly margin of Sixth Street to the Southerly margin of Third Street, and, further, the improvement of Third Street by the construction of a wooden sidewalk five feet wide on the Southerly side of said Third Street from the Easterly margin of Pine Street, Easterly, to the top of break of the Valley Street gulch, toconnect with present zigzag up the hill; all in accordance with local improvement resolution No. 91, and plans and specifications adopted by theC.ty Commission of the City of Port Angeles ordering the levy and collection of such assessments; creating and estab- lishing a special fund for said district, and ordering that said assess- ments be paid into said special fund. THE CITY COMMISSION OF THE CITY OF PORT ANGELES DO ORDAIN AS FOLLOWS: Section 1. That the assessments and assessment roll for Local Improve- ment District No. 91, created by Ordinance Ito. 713, approved May 24th, 1922, which said ordinance ordered and provided for the improvement of Pine Street from the North margin of Eighth. Street to the top or break of the bluff between Second and Third Streets, by clearing and grubbing the full. width of the street; surface grading for fifteen feet on each side ,of- thercenter line of, said „street, , and graveling for six feet on each side of the center line of said street, and, further, ## the improvement of said Pine Street by the construction of a wooden sidewalk, five feet wide, on the Westerly side of said Pine Street from the Northerly margin of Eighth Street to the Southerly margin of Third Street, and on the East- erly side of Pine Atreet from the Northerly margin of Sixth Street to the Southerly margin of Third Street, and, further, the improvement of Third Street by the construction of a wooden sidewalk five feet wide on the Southerly side of said Third Street from the Easterly margin of Pine Street, Easterly, to the top or break of the Valley Street gulch, to connect with the present zigzag up the hill, all in accordance with maps, plans and specifications adopted by the City Commission of the city of Port Angeles, and Local Improvement Resolution No. 91, created eted asaoc local m- improvement district therefor, and provided for the payment im- provement by special assessments upon the property in said district pay- able by the mode of "payment by bonds "; as said assessment roll now stands, as revised, changed, lowered and modified by the said City Comm- ission sitting as a board of equalization thereon on the 6th day of Sept - ember, 1922, according to regular notice thereof, and the ordinances of said city, and in accordance with the findings and order of said Board of Equalization in said meeting, be and the same are hereby in all respects approved and confirmed in all things. Section 2. That each lot, tract and parcel of land shown upon said assessment roll is hereby declared specially benefitted by said improve- ment in at least the amount charged against the same, and the the assess- ment appearing against the same is in proportion to the several *#I# assessments appearing upon said roll, and there is hereby levied and rolsst aaaon actually n o tract appearing said the rolll, the amount same. • Section 3. That there is hereby created and established for said Local tmpro vement District No. 91, a special fund to be known and desigta nated as Local Improvement tistrict No. 91, for the uses and purposes provided by law and the ordinances of said city, and into which special fund all such assessments shall be paid when collected. Section 4. Said assessments or any of them may be paid without inter- est at any time within thirty (30) days from the date of the first pub- lication of the City Treasurer's notice to pay the same as required by law to be given, but unless payment be made within such time said assess- ments or any portion thereof not sd paid, will become delinquent; such delinquent assessments with interest and penalty will be enforced and collected in the manner provided by law and the ordinances of said city of Port Angeles. Section 5. That immediately upon the taking effect of this ordinance said assessment roll shall be turned over to the City Treasurer for the collection thereof, who will thereupon proceed to collect the same accord" ing to law. Section 6. This ordinance shall take effect and be in full force after its passage and approval and f(Om and after five (5) days after its lawful publication.
