HomeMy WebLinkAbout0794ORDINANCE No. 9 1,14-- AN ORDINANCE approving and confirming the assessments and assessment roll in and for Local Improvement District No.111 under Ordinance No. 783 for the construction of trunk and lateral sewers in and along the following described portions of streets in the City of Port Angeles, Washington, to -wit: a trunk sewer beginning at the alley between Twelfth street and Thirteenth Street on Pine Street,-and running thence northerly along Pine Street to Third Street, thence easterly along Third Street to Valley Street, thence northerly along Valley Street to a point approximately in the southerly margin of Front Street, being the point of discharge into Port Angeles harbor, together with lateral sewers adjoining the said trunk sewer in the following described portions of alleys in the City of Port Angeles, to -wit: in the alleys between Third and Fourth Streets, between i°ourth and Fifth Streets, between Fifth and Sixth Streets, between Sixth and Seventh Streets, and between Seventh and Eighth Streets, from the break of Tumwater gulch to the break of Valley gulch, together with the manholes, flush tanks, catch basins, wyes and other equipment necessary and suitable to complete said improvement, all in accord- ance with maps, plans and specifications prepared by the City Engineer and adopted by the City Commission and in accordance with Local Improvement desolution No.111 of the City of Port Angeles; ordering the levy and collection of such assessments; creating and establishing a special fund for said district and ordering that said assessments be paid into said special fund. THE CITY COMMISSION OF THE CITY OF PORT ANGELES DO ORDAIN AS FOLLOWS: Section I. That the, assessments and assessment roll for Local Improvement District No.111 created by Ordinance No.783, approved June 24, 1925, which said ordinance ordered and provided for the construction of trunk and lateral sewers in and along the follow- ing described portions of streets in the City of Port Angeles, to -wit: A trunk sewer beginning at the alley between Twelfth street and Thir- teenth Street on Pine Street, and running thence northerly along Pine Street to Third Street, thence easterly along Third Street to Valley Street, thence northerly along Valley Street to a point approximately in the southerly margin of Front Street, being the point of discharge into Port Angeles harbor, together with lateral sewers adjoining the said trunk sewer in the following described portions of alleys in the City of Port Angeles, to -wits In the alleys between Third and Fourth Streets, between Fourth and Fifth Streets, between Fifth and Sixth Streets, between Sixth and Seventh Streets, and between Seventh and Eighth Streets, from the break of Tumwater gulch to the break of Valley gulch, together with the manholes, flush tanks, catch basins, wyes,• and other equipment necessary and suitable to complete the said improvement, all in accordance with maps, plans and specifi- cations prepared by the City Enginner and adopted by the City Commission and in accordance with Local Improvement Resolution No.111 of the City of Port Angeles; and which said ordinance created a local improvement district and provided for payment for said improvement by special assessment on the property in said district, payable by f the method of "payment by bonds ", and which said local improvement district was more particularly described thereafter so as to define its metes and bounds by Ordinance No.789 entitled "An ordinance amending Section III of Ordinance No.783 of the City of Port Angeles, etc. ", approved October 14, 1925; as said assessment roll now stands, as revised, changed, raised, lowered and modified by the City Commission sitting as a Board of Equalization thereon on the 25th day of November, 1925, according to regular notice thereof and the ordinances of said city, and in accordance with the findings and _ order of said Board then and there made, be and the same are hereby in all respects approved and confirmed in all things. Section II. That each lot, tract and parcel of land shown upon said assessment roll is hereby declared specially benefitted by said improvement in at least the amount charged against the same, and that the assessment appearing against the same is in proportion to the several assessments appearing upon said roll, and there is hereby levied and assessed against each said lot, tract or parcel of land appearing on said roll the amount actually charged and assessed therein upon and against the same. Section III. That there is hereby created and established r- for-said-Local Improvement District- T o.111, a. special fund to he known and designated as Local Improvement District No.111 for the uses and purposes provided in such case by law and the ordinances of said city. Section IV. That said assessments, or any of them, may be paid without interest at any time within thirty days from the date of the first publication of the City Treasurer's notice to pay the same as required by law to be given; and all assessments not paid within said period of thirty days shall thereafter be paid in ten equal annual installments with interest thereon at the rate of seven per centum per annum. Section V. That immediately upon the taking effect of this ordinance, said assessment roll shall he turned over and delivered to the City Treasurer for the collection thereof, who shall thereupon proceed to collect the same according to law. Section VI. This ordinance shall be in full force and effect after'its passage and approval, and from and after five days after its lawful publication; and the City Clerk is hereby directed to cause the same to be so published.
