HomeMy WebLinkAbout0803• • ORDINANCE No. (1p c3 AN ORDINANCE ordering and providing for supplemental assessments, and a supplemental assessment roll to provide for certain deficiencies in the fund created to pay the cost and expense of the improvement of the Local yis-tr+cfi streets and property described in ^ mprovement No.104 created under Ordinance No.762, approved July 30, 1924, entitled "An Ordinance ordering and providing for the Improvement of the following described portions of streets and real property in the City of Port Angeles, Wash- ington, and in the manner following, to -wit: Beginning at a point approximately 318 feet westerly of the center line of A Street and ex- tending thence along Third Street, etc.," and the levy and collection thereof and payment thereof by the mode of "immediate payment". WHEREAS, it appears to the City Commission of the City of Port Angeles that the original assessments and assessment roll of Local Improvement District No.104, as approved and confirmed by Ordinance No. 786, are deficient and insufficient to pay all the cost and expense incidental to said improvement, occasioned by interest accruing on warrants issued to the contractor during the construction of said im- provement; by the delay in issuing bonds due to an appeal from the confirmation of the assessment roll in the said Local Improvement District No.104; by the decree of the Superior Court of the State of Washington for the County of Clallada eliminating certain property from the said roll; and by reason-of the fact that certain property of the County of Clallam and School District No.7 was omitted from the original roll, and WHEREAS, said deficiency and the cost of preparation of a supplemental assessment roll and the collection thereof equals the sum of $ / ,L- / % Sfl , NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF PORT ANGELES DO ORDAIN AS FOLLOWS: Section I. That supplemental assessments and assessment roll for Local Improvement District No.104, created by Ordinance No.762, API • approved July 30, 1924, entitled: "An Ordinance ordering and providing for the improvement of the following described portions of streets and real property in the City of Port Angeles, Washington, and in the manner following, to -wit: Beginning at a point approximately 318 feet westerly from the center line of A street and extending thence along Third Street, westerly a distance of approximately 2321 feet to the intersection. 04 said Third street with the easterly boundary of the Sampson Donation Land Claim, by removing all old lumber in the present bridge structure situated in and upon said portion of said Third Street, removing all piling that cannot be protected and saved, construction of a new trestle or bridge, driving a minimum of three and a maximum of six piles per bent, such piles to be peeled Douglas fir, capping such piles with 12x12 timbers and 4x12 stringers and with decking sufficiently strong to support a reinforced concrete slab, five inches in thickness, divided into sections eleven feet by eleven feet in size, which concrete slab or pavement as aforesaid, shall be so con- structed thereon; a four foot sidewalk to be constructed along the south side of the roadway; 225 feet of the westerly end of the above described portion of the said third street to be filled to grade with suitable earth and a concrete slab or pavement nine inches thick placed thereon; the said peeled Douglas fir piles to be protected by Portland cement two inches in thickness to be applied by the ,nGunite° process; together with all necessary guard rails, hand railing, bulkheads, retaining walls, and doing such other work as may be necessary in connection therewith. Also the improvement of Second Street beginning at the easterly end of the said Third Street bridge • which is the easterly end of the above described portion of Third Street; thence in a northeasterly and easterly direction along said Second Street to the easterly margir of Cherry Street; thence southerly along Cherry street to the northerly margin of Third Street; by clearing, grubbing, -2- • draining and all necessary trunk sewer connections; by raising Second Street between the said Third Street bridge and Valley Street to a permanent grade, by filling with earth mostly obtained in that part of Second Street between Valley and Cherry Streets, by building sidewalks and graveling roadway thirty feet in width. Also the improvement of Cedar --street from the northerly margin of Sixth Street, northerly along said Cedar Street to the southerly margin of Second Street; by bringing said portion of said Cedar street to a permanent and even grade between said Sixth street and Second Street; by gravelling a roadway thirty feet in width, together with all necessary drainage, and construction of wooden sidewalks. Also the - improvement of all that portion of streets and alleys and of Blocks 35 and 36 of the Townsite of Port Angeles lying between and contained within lines parallel with and forty feet distant on either aide from a center line described as follows, to -wit: Beginning at a point on the center line of r'irst Street, which point is five feet easterly from the westerly margin of Valley Street; and running thence southwesterly a distance of approximately 816 feet to a point on the center line of Second Street, which point is 150 feet westerly from the westerly margin of Pine Street (being a strip of land 80 feet in width); by the removal of all old buildings and refuse and debris; the filling of said right -of -way with a suitable earth or sand and gravel fill; together with all necessary road gravel, rip -rap, guard rails, and wooden sidewalks; all as may be necessary to make a complete and finished street and roadway forty feet in width on the top of such fill; together with all such other work in connection therewith as may be necessary to properly carry out the construction and making of the con- templated improvement, all in accordance with maps, plans and specifica- tions prepared by the City engineer, and adopted by the City Commission, and in accordance with Local Improvement nesolintion No.104; providing for an enlarged Local Improvement District and providing for payment of the cost and expense of said improvement by special assessment upon the property within said district, according to law and by the mode of "payment by bonds" be made and collected upon all property within said -3-. • • V I. Local improvement District No.104, except that property which has been eliminated from assessment within said district by reason of the decree of the Superior Court of the State of Washington in and for Clallam County entered as aforesaid, in the manner as provided by law; said supplemental assessment roll to include said deficiency and the cost and expense of the preparation of said supplemental roll and the collection thereof. Section 2. That immediately upon taking effect of this ordinance, the officers charged with the making of said supplemental assessments and roll shall immediately proceed to cause said supplemental assessments and roll to be made and report the same to this Commission as in such case made and provided by law and ordinances of the City of Port Angeles. Section 3. That the said supplemental assessments shall be defrayed and paid by the mode of "immediate payment" as defined by law and the ordinances of the Oity of Port Angeles, Washington. Section 4. This ordinance shall be in full force and effect after its passage and approval, and from and after five days after its lawful publication.
