AN ORDINANCE authorizing the Union Oil Company of California, . a corporation, to lay, construct, maintain, operate and repair pipelines for the transportation of petroleum oil and its by- products under, along and across certain portions of certain streets and alleys in the City THE CITY CO;.CaSSI0N OF THE CITY OF PORT ANGEL DO ORDAIN AS ioLLOWS : Section I. That the Union Oil Company of California, a cor- poration, its successors and assigns, is hereby given a license and pri- vilege for fifty years from the date on which this ordinance shall be- come effective to lay, construct, maintain, operate, repair, renew and change the size of pipe lines of not more than eight in number, none to exceed eight inches in internal diameter, together with necessary con- nections, manholes and appliances for the operation of said pipelines. Said lines to he used for the transportation of . petroleum oil and its by- products and for no other purposes whatever, under, across and along the following described portions of the following described streets and al- leys in the City of Port Angeles, to wit: Beginning at the northerly terminus of Tumwater Street, thence Southerly along said Tumwater Street Qr0S5lr1 Q Second Street to the intersection of the center line of the alley through Block 97 of the Townsite of Port Angeles; thence Westerly along said alley to the center line of "A" Street produced. Section II. The terms, conditions and provisions under which ill this right and license is granted and to which it shall at all times be • subject, and for a failure of any one or more of which it may at the op- tion of the City be forthwith revoked, are the following, to wit: 1. All pipe to be laid and maintained under this license shall be of good workmanship and shall be standard steel pipe, lap or butt welded with either welded, screw or flange connection.• • 1 2. Said pipelines shall be laid at all points not less than 1A -kr feet under the surface of the ,round; all excavations for laying, repairing, renewing, changing the size of and /or removing said pipes and appurtenant equipment shall be done in such manner as not to interfere with the free use of the streets by the public except such temporary in- ferepce as may be necessarily incident to the proper prosecution of said work, and the Union Oil Company of California shall restore the surface of any street or alley herein described which may be disturbed by reason of its use thereof to a condition at least as good as that of the rest of said street forthwith. 3. The Union Oil Company of California shall hold the City harmless for any damage to persons or property resulting from the open- ing of any street or alley; the installation of any pipe or apparatus and the maintenance of the said pipes and appurtenant equipment includ- ing any loss or damage occasioned by the escape of petroleum, gasoline, gas or any petroleum products, or any conflagration resulting from any escape of such petroleum and its by- products. 4. In the event the City of Port Angeles shall change the grade of any of the streets or alleys above described, the Union Oil Company of California shall immediately and at its own cost and expense change its pipelines and appurtenant equipment to conform to such change of grade. 5. In the event the City of Fort Angeles shall install water pip sewer pipe% electric conduits or any other equipment to be used • in connection with carrying on the cityts business, the pipes and ap- 411 purtenant equipment of Union Oil Company of California shall be by the said Union Oil Company of California and at its own cost and expense, immediately changed so as to conform to such installation of any such equipment by the City of Port Angeles. 6. The Union Oil Company of California shall pay to the City of Port Angeles for the license herein given the sum of 3100.00. -2- 1 Section III. This ordinance shall take effect and be in full force from and after its passage and approval and from and after thirty • days after its lawful publication.
