ORDINANCE NO.b
AN ORDINANCE ordering and providing for the construction of
a lateral sewer in the following described portion of the following,.
described alley in the City of Port Angeles, to wit: Running easterly
and westerly in the alley between First and Second Streets and from the
westerly margin of Race Street westerly to the easterly margin of Lots
9 and 10 in Block 24 of Norman R. Smith's Subdivision of the City of
Port Angeles, together with manholes, flush tanks, catch basins, wyes
and other equipment necessary and suitable to complete said improvement;
creating Local Improvement District No. 123; and providing for the pay-
ment of the cost and expense thereof by special assessments upon the
property within the said district according to law and by the mode of
"immediate payment"

123 of the City of Port Angeles, and in accordance with maps, plans
• and specification prepared by the City Engineer and approved and adopt-
ed by the City Commission.
FOLLOWS:
THE CITY COMMISSION OP THE CITY OP PORT ANGELES 1)0 ORDAIN AS
Section I. That there is hereby ordered the construction of
a lateral sewer in the following described portion of the following des-
cribed alley in the City of Fort Engeles, to wit: Running easterly and
westerly in the alley between First and Second Streets, and from the
westerly margin of Race Street westerly to the easterly margin of Lots
9 and 10 in Block 24 of Norman R. Smith's Subdivision of the City of
Port Angeles, together with manholes, flush tanks, catch basins, wyes
and other equipment necessary and suitable to Complete said improvement.
Al]. of said improvement to be done in accordance with maps, plans and
specifications prepared by the City Engineer and adopted and approved
by the City Commission, and in accordance with Improvement Resolution
No. 123 of the City of Port Angeles.

s y Section II. That the cost and expense of said improvement in--
ludirig.all necegsary and incidental expenses, shall be borne by and a s -
. ses,3ed ajainst the property situated and included within the boundaries
.otlthe di'srict-hereinafter created and described, in accordance with
law and the"' ordinances of the City of Port Angeles; and the City of Port
Angeles shall not be liable in any manner for any portion of said cost
and expense of said improvement, except in so far as the said City is
made liable by virtue of the statutes of the State of Washington in such
cases made and provided;
Section III. That there is hereby created a Local Improvement
District to be called Local Improvement District No. 123, which said dis-
trict is described as follows, to wit: All of the territory that may be
severed by the said lateral sewer as herein ordered to be constructed,
and all the property between the described&termini, of said improvement
abutting upon, adjacent, viscinal or proximate to said portion of said al-
ley to a distance back from the marginal lines thereof according to law.
Section IV. That the said assessments shall be defrayed and
paid' by the mode of "immediate payment" as defined by law and the ordin-
ances of the City of Port Angeles, Washington.
Section V. This ordinance shall take effect and be in force
after its passage and approval., and from and after five days after its
lawful publication.
Passed first reading by the City Commission , May 9, 1928.
• Passed second reading by the City Commission, May 16, 1928.
Passed third reading and finally passed and adopted by the City Commis -
� sion, May 16, 1928.
