AN ORDINANCE approving and confirming the assessments and as-
sessment roll in and for Local Improvement District No. 123, created un-

der Ordinance No. 845, approved May 16, 1928, ordering and providing for
the construction of a lateral sewer in the following described portion
of the following described alley in the City of Port Angeles, to wit:
Running easterly and westerly in the alley between First and Second
Streets and from the westerly margin of Race Street westerly to the eas-
terly margin of Lots 9 and 10 in Block 24 of Norman R. Smith's Subdivi-
sion of the City of Port Angeles, together with manholes, flush tanks,
catch basins, wyes and other equipment necessary and suitable to complete
said improvement; all in accordance with improvement resolution No. 123
of the City of Port Angeles, and in accordance with maps, plans and speci-
fications prepared by the City Engineer and approved and adopted by the
City Commission; ordering the levy and collection of such assessments;
creating and establishing a special fund for said district, and order-
ing that said assessments be paid into said special fund.
THE; CITY COMMISSION OF THE CITY OF PORT ANGELES DO ORDAIN AS
FOLLOWS:
Section I. That the assessments and assessment roll for Local
Improvement District No. 123, created by Ordinance No. 845, approved May
16, 1928, which said ordinance ordered and provided for the construction
of a lateral sewer in the following described alley in the City of Fort
Angeles, to wit: Running easterly and westerly in the alley between
First and Second Streets, and from the westerly margin of Race Street
westerly to„the easterly margin of Lots 9 and 10 in Block 24 of Norman
R. Smith's Subdivision of the City of Port Angeles, together with man-
holes, flush tanks, catch basins, wyes and other equipment necessary and
suitable to complete said improvement, all in accordance with improve-
ment resolution No. 123 of the City of Port Angeles, and in accordance
with maps, plans and specifications prepared by the City Engineer and
approved and adopted by the City Commission; and which said ordinance

created a local improvement district and provided for payment of said
• improvement by special assessment. on the property in said district, pay-
able by the mode of "immediate payment ", as defined by law and the or-
dinances of the City of Port Angeles, and which said Local Improvement
District was more particularly described in said ordinance so as to de-
fine its bounds; as said assessment roll now stands, as revised, changed,
raised, lowered or modified by the City Commission sitting as a Board of
Equalization thereon on the 26th day of September, 1928, according to
regular notice thereof and in accordance with the ordinances of this city,
and with the findings and order of the said Board then and there made,
be and the same are hereby in all respects approved and confirmed in all
things.
Section II. That each lot, tract and parcel of land upon said
assessment roll is hereby declared to be specially benefitted by said im-
provement in at least the amount charged against the same, and that the
assessment appearing against the same are in proportion to the several
assessments against each said lot, tract or parcel of land appearing on
said roil, and there is hereby levied and assessed against each said lot,
tract or parcel of land appearing.on said roll the amount actually charg-
ed and assessed therein upon and against the same.
Section III. That there is hereby created and established for
said Local Improvement District No. 123, a special fund to. be lmown and
designated as Local, Improvement District No. 123, for the uses and pur-
poses provided in such case by law and the ordinances of the City of Port
Angeles.
Section IV. That said assessments, and any of them, may be
paid without interest at any time within thirty days from the date of
the first publication of the City Treasurer's notice to pay the same, as
required by law to be given, and all assesments shall be due and payable
unto the said fund known as Local Improvement District No. 123 within
thirty days of the said publication of the said City Treasurer's Notice,
and those not paid within said thirty days shall be and become delinquent
and shall bear interest and penalties as provided by the- statutes of the
State of Washington and the ordinances of the City of Port Angeles.
Section V. That immediately upon the taking effect of this or-
dinance, said: assessment roll shall be turned over and delivered to the •
City Treasurer for the collection thereof', who shall immediately proceed
to collect the same according to the mode'of "immediate payment" as pro-
vided by law. -
Section VI. This•ordinance shall be in full force and effect
after its passage and approval and from and after five days after its
lawful publication; and the City-Clerk is hereby directed to cause the
same to be published.

Passed second reading by the City Commission, October 3, 1928.
