HomeMy WebLinkAbout0871ORDINANCE No. AN " ORDINANCE, approving and conf,e rming the assessments and as- sessment roll'in and for Local Improvement District No. 126, created un- der Ordinance No. 865, approved January 10, 1929, ordering and provid- ing for the following described improvements along the following describ- ed portions of streets and alleys in the City of Port Angeles, to wit: The construction of a lateral sewer in the alley running through Block 205'beginning approximately at a point 175 feet westerly from the wester- ly margin of Eunice Street in said Block 205, and running thence wester- ly a distance of approximately 375 feet to a point to connect with the existing sewer running through the alley between Sixth and Seventh Streets in the City of Port Angeles; also a lateral sewer in Second Street begin- ning at a point approximately 375 feet west of the westerly margin of Tumwater Street, and running thence easterly to and emptying into Turn- ipwater Creek in front of Block 97, in the Townsite of Port Angeles; all in accordance with improvement resolution No. 126 of the City of Port Angeles, and in accordance with maps, plans and specifications prepared by the City Engineer and approved and adopted by the City Commission; ordering the levy and collection' of such assessments, creating and es- tablishing a special fund for said district, and ordering that said as,. sessments be paid into said special fund. THE CITY COIMMISSION OF THE CITY OF PORT ANGELES DO ORDAIN AS 0 FOLLOWS: Section 1. That the assessments and assessment roll for Local Improvement District No. 126, created by Ordinance No. 865, approved Jan- uary-10,,1929,-which said ordinance ordered and provided for the follow- ing described improvements along the following described portions of streets and alleys in the City of Port Angeles, to wit: The construc- tion of a lateral sewer in the alley running through Block 205 beginning approximately at a point 175 feet westerly from the westerly margin of Eunice Street in said Block 205, and running thence westerly a distance of approximately 375 feet to a point to connect with the existing sewer running through the alley between Sixth and Seventh Streets in the City of Port Angeles; also a lateral . sewer in Second Street beginning at a point approximately 375 feet west of the westerly margin of Tumwater Street, and running thence easterly to and emptying into Tumwater Creek in front of Block 97 in the Townsite of Port Angeles; all in accordance with improvement resolution No.' 126 of the City of Port Angeles, and in accordance with maps, plans and specifications prepared by the City En- gineer and approved and adopted by the City Commission; and which said ordinance. created a local improvement district and provided for payment of said improvement by special assessment on the property in said dis- trict, payable by the mode of "immediate payment", as defined by law and the ordinances of the City of Port Angeles, and which said Local Im- provement District was more particularly described in said ordinance so as to define its bounds; as said assessment roll now stands, as revised, III changed, raised, lowered or'modified by the City Commission sitting as a Board of Equalization thereon on the 1st day of Hay, 1929, according to regular notice thereof, and in 'accordance with the ordinances of this city, and With the findings and order of the said Board then and there made, be and the same are hereby in all respects approved and confirmed in all things. Section II. That each lot, tract and parcel of land upon said assessment roll is hereby declared to be specially benefitted by said im- • provement in at least the amount charged against the same, and that the assessment appearing against the same are in proportion to the several assessments against each said' lot, tract or parcel of land appearing on said roll, and there is hereby levied and assessed against each said lot, tract or parcel of land appearing on said roll the amount actually charg- ed and assessed therein upon and against the same. Section III. That there is hereby created and established for said Local Improvement District No. 126; a special fund to be known and designated as Local Improvement District No. 126, -for the uses and pur- i ,F► • poses provided.1n such case by law.and the ordinances of the City of Port Angeles. Section IV. That said assessments, and any of them, may be paid without interest at any time within thirty days from the date of the first publication of the City Treasurer's notice to pay the same, as required by law to be given, and all assessments shall be due and-payable unto the said fund known as Local Improvement District No. 126 within thirty days of the said publication of the said City Treasurer's Notice, and those. not paid within said thirty days shall be and become delinquent and .shall bear interest and penalties as provided,by the statutes of the State of Washington and the ordinances of the City of Port Angeles. Section V. That immediately upon the taking effect of this ordinance, said assessment roll shall be turned over and delivered to the City Treasurer for the collection thereof, who shall immediately proms eeed to collect the same according to the mode of "immediate payment ", as provided by 1&w. • .. ;. Section VI. This ordinance shall be in full force and effect after its passage and approval and from and after five days after its lawful publication, and -the., City.
