AN ORDINANCE authorizing the leasing of a certain portion of Railroad Avenue, described as follows, to wit: Beginning at a point at the intersection of the northerly mar- gin of Railroad Avenue and the easterly margin of Oak Street, running thence easterly a distance of 250 feet along the nor- therly margin of Railroad Avenue; thence southerly a distance of 12 feet; thence westerly a distance of 250 feet; thence northerly a distance of 12 feet to the point of beginning. THE CITY COMEISSION OF THE CITY OF PORT ANGELES )DO ORDAIN AS FOLLOWS: Section 1. That pursuant to an application in that behalf filed by Loft1ua, & Nobles, a..copartnership, it being the owner of, or entitled to the beneficial use, of all the property abutting upon the said portion ref Railroad Avenue, 44A purua}1t. to notice of intention to lease the said portion of said Railroad Avenue published according to law, the Mayor and the City Clerk be and they are hereby authorized and empowered to execute and deliver on behalf of the City of Tlort. Angeles, a lease'to the said applicant, Lofthus & Nobles Lumber Co.; a copartner- ship, for a period of fifteen years from the 1st day of April, 1930, for the purpose of building, maintaining and operating a structure or struc- tures for manufacturing, warehousing, merchandising purposes, and other purposes incidental thereto, covering the following described portion of Railroad Avenue in the City of Port Angeles, to wit: Beginning at a point at the intersection of the northerly mar- gin of Railroad Avenue and the Easterly margin of Oak Street, running thence easterly a distance of 250 feet along the nor- therly margin of Railroad Avenue; thence southerly a distance of 12 'feet; thence westerly a distance of 250 feet; thence nor- therly a distance of 12 feet to the point of beginning. at the annual rental of 111.00., payable in advance subject to the right of the City of Port Angeles, at the expiration of each five year period from the said lst day of April, 1930, to readjust between itself and, the lessee the annual rental according to the provisions of Section 9070, Rem. Comp. Stat.; and provided further that the lessee shall at all times during the life of said lease, maintain that portion of Railroad Avenue between the tracks of the Chicago, Milwaukee, St. Paul & Pacific Rail - road Company, and that portion of Railroad Avenue described in said Tease, in a condition at least equally as good as the contiguous, adja- cent portions of Railroad Avenue; and provided further, that if at any time during the.Aaid term of this lease the City of Port Angeles shall desire to regrade, resurface or in any wise improve the portion of Rail- road Avenue in this ordinance and the said lease described, then upon thirty days written notice to the lessee, the lessee shall remove any and all structures by it placed on the'leased portion of Railroad Avenue and quit and surrender up the leased portion to the City of Port Angeles and the rights of the lessee shall upon the expiration of said thirty days be at an end. Section 2, This ordinance shall take effect and be in force after its passage and approval, and from and after thirty day after its lawful publication.
