AN ORDINANCE providing for the construction of a city hall building for the purpose of housing the various official activities of the City of Port Angeles, including the various Commissioners! depart- . meats and the Light and Water Departments, and also for the construction of a building for the City jail and Police Department purposes; declaring the estimated cost thereof as near as may be; providing for the issuance and sale of bonds to secure funds therefor, and submitting to the quali- fied voters of the City of Port Angeles the said two propositions at thea- r omN4elleal election to be held in the City of Port Angeles on the 1st day of December, 1930, and declaring an emergency. THE CITY C0MMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN AS FOLLOWS: Section I. That the necessities and requirements of the City 0 of Port Angeles demand adequate facilities for housing the various activ- ities of the City of Port Angeles, including the various Commissioners! Departments and the Light and Water Departments, and that the require- ments of the Police Department for adequate facilities, including a City jail, all make it necessary and expedient that the city construct the said two buildings on the real property belonging to it on the east side of Lincoln Street between Second and Third Streets, the said two build- ings when completed to become a comprehensive group in connection with the building now provided to house the Fire Department, all in accordance with plans and specifications prepared by an architect heretofore employ- ed by the City of"Port Angeles, which said plans and specifications are • on file with the City Clerk, and that such demand, requirement and expe- diency are indicated by the•present dilapidated condition of the struc- tures on West First Street now occupied by the City of Port Angeles on land owned by the United States Government, and by the prospect of the early construction of a post office building on said land, and by the in- adequate quarters now provided for the various activities of the City of Port Angeles. Section 2. That the City of Port Angeles and its corporate authorities hereby specify and adopt a plan and proposition to provide an adequate and suitable °city hall building to be erected upon the pro- perty of the City aforesaid, immediately south and connected to the City • Fire Hall now under course of construction, and also to provide an ade- quate city jail and a building to provide for the requirements of the Po- lice Department to be constructed immediately south of the City Hall Build- ing herein projected, which two buildings together with the existing fire hall shall form one group of buildings for the purpose of housing all the official activities of the City of Port Angeles according to plans and specifications aforesaid. Section 3. That the gross estimated cost of the construction of the said city hall building to house the activities of the various com- missionerst Departments including the City Cler], City Treasurer and Light and Water Department, being the central building in the proposed group of • buildings, together with the cost of the necessary furniture and fixtures to make the same available for use, as near as may be estimated, is the sum of $73,000.00, the said sum is to be raised by bonds of the City of Port Angeles as hereinafter provided. Section 4. That the gross estimated cost of the construction of the proposed City Jail Building to house the activities of the Police Department, being the southerly building in the proposed group of build- ings, together with the cost of the necessary furniture, fixtures and jail equipment to make the same available for use, as near as may be estimated is the sum of $32,000.00, the said sum is to be raised by bonds of the City of Port Angeles as hereinafter provided. • Section 5. That in order to secure funds to carry out the plan for the construction of both the City Hall Building and a Jail Building, in the event that the plan for the construction of both buildings shall be ratified by the voters of said city as hereinafter provided for, said City shall issue and sell its negotiable bonds in an amount not to exceed $105,000.00, being the total amount of the gross estimated cost of the said two buildings as hereinbefore specified, which said bonds shall be issued in the denomination of $500.00 each and shall bear such rate of in- terest not exceeding six per cent per annum, payable semi - annually, as the City Commission may by resolution direct. Said bonds shall mature serially as follows: $3,000.00, three years after date. 3,000.00, four years after date. 4,000.00, five years after date. 4,000.00, six years after date. 4,000.00, seven years after date. 5,000.00, eight years after date. 5,000.00, nine years after date. 5,000.00, ten years after date. 6,000.00, eleven years after date. 6,000.00, twelve years after date. 6,000.00, thirteen years after date. 7,000.00, fourteen years after date. 7,000.00, fifteen years after date. 8,000.00, sixteen years after date. 8,000.00, seventeen years after date. 8,000.00, eighteen years after date. 8,000.00, nineteen years after date. 8,000.00, twenty years after date. The bonds of the issue of $105,000.00 maturing more than ten years after date, according to the schedule herein set forth, shall be callable for • redemption in their numerical order at par and accrued interest, on any interest payment date after ten years from their date, upon thirty dayst notice published in the newspaper doing the city printing. • Section 6. That in order to secure funds for erecting the Jail Building to house the activities of the Police Department only, should the qualified voters of said City fail to ratify the proposition for both the City Hall and the Jail Building, and ratify only the proposition for a Jail Building, said city shall issue and sell its negotiable bonds in an amount not to exceed $32,000.00, which shall be issued at such times in denominations of $500.00 and shall bear such rate of interest not exceed- ing six per cent per annum payable semi - annually, as the City Commission • may be resolution direct. Said bonds shall mature serially as follows: $3,000.00, three years after date. 3,000.00, four years after date. 3,000.00, five years after date. 4,000.00, six years after date. 4,000.00,setan years after date. 5,000.00,eigit years after date. 5,000.00, nine years after date. 5,000.00, ten years after date. Section 7. All of the bonds provided for in this ordinance shall have attached thereto proper interest coupons which shall be a part thereof. Both principal and interest of said bonds shall be payable in gold coin of the United States of the present standard of weight and fine- ", n.ess at the office of the City Treasurer of the City of Port Angeles or at the Fiscal Agency of the State of Washington in New York City, at the option of the holder. Section 8. That there be and is hereby created a fund to be called the "Municipal Building Fund". From and after the date of said bonds and so long thereafter as any obligations are outstanding against the City of Port Angeles on account of said bonds, the City Treasurer shall set aside and pay from said fund thirty days prior to the respective dates on which interest, or principal and interest, of said bonds shall become due and payable, certain fixed amounts derived from the levy and payment of taxes equivalent to the respective amounts of interest, or principal and interest, as the case may be, falling due upon any and all bonds issued hereunder and then outstanding. The City of Port Angeles binds itself to levy from time to time and provide by budget allotment from time to time sufficient amounts, to permit the payment into said fund of sufficient revenues to meet the payment of principal and interest of said bonds herein authorized, when the same come due and until the same shall have been paid in full. The City Treasurer is hereby authorized . to make payment of said bonds and coupons herein authorized as the same fall due, and the payment of said bonds and coupons as they fall due is hereby declared to be the only charge which has been made upon said fund, 0 or will ever be made thereon until all of said bonds and interest thereon shall have been paid. Thab the City of Port Angeles and its corporate authorities do hereby declare that the purposes for which the bonds herein provided for are to be issued, are strictly municipal purposes. Section 9. In the event that one or the other of plans herein adopted and the issuance of the bonds herein authorized, shall be ratified by the voters of said City at said election, all the said bonds shall be sold at public sale and the City Clerk is hereby instructed to publish a notice in the Evening News once a week for four consecutive weeks call- ing for bids for the purchase of said bonds, the said notice shall specify 0 the place and designate the day and hour subsequent to the date of the last publication thereof, when sealed bids will be received and publicly opened for the purchase of said bonds, and the Clerk shall further mail to the State Finance Committee at Olympia, Washington, a copy of such no- tice at least three weeks prior to the date fixed for the said sale; the notice shall specify the maximum rate of interest such bonds shall bear, and require bidders to submit bids specifying, (a) The lowest rate of interest and premium, if any, above par at which such bidder will purchase said bonds, or (b) The lowest rate of interest at which said bidder will purchase said bonds at par. • Said bonds shall be sold to the bidder making the best bid, sub- ject to the right of the City to reject any and all bids and readvertise. None of the said bonds shall be sold at less than par and accrued inter- est and no discount or commission shall be allowed or paid on the sale of such bonds. All bids shall be sealed and, except the bid of the State of Washington, if one is received, shall be accompanied by a deposit of five per cent, either cash or certified check, of the amount bid, and the no- tice hereinbefore provided shall so state. e101. Said bonds and coupons shall be in such form and contain such provisions as may be determined by ordinance, after the rati- ofication by the qualified voters of the City of Port Angeles of one or the other of the alternative propositions submitted pursuant to this or- dinance. Section 10. a +itm,Inioipa.1 election n. o be held in t the City of Port Angeles on the 1st day of December, 1930, in the several at•,d ai .1- 4:241:.-.3 established voting precincts of the said city,Athere shall be submitted for ratification or rejection, to the qualified voters of said city, the alternative plans herein specified and adopted, for the construction of both a City Hall and Jail Building, or for the construction of a Jail Building only, together with the necessary equipment and fixtures for making the same available for use, and the issuance of bonds as herein . specified, to provide funds to pay therefor, and the propositions so sub- mitted shall appear on the ballot in substantially the following form: PROPOSITION I. Shall the City of Port Angeles pursuant to a plan therefor provided by Ordinance No. 918 of the said City, at an estimated cost of $105,000.00, construct and equip both a City Hall Building and a Jail Building, which together with the existing Fire Hall, shall constitute a comprehensive group for housing the official activities of said city, and for said pur- pose issue and sell its bonds in an amount not to exceed $105,000. and shall said ordinance insofar as it refers to said proposition be ratified by the qualified voters of said city? PROPOSITION 2. Shall the City of Port Angeles pursuant to a plan therefor specified and adopted by Ordinance No. 918 of the City of Port Angeles, at an estimated cost of $32,000.00, construct and equip a Jail Building only, to meet the requirements of the Police Department, and for said purpose issue and sell its bonds in an amount not to exceed $"32,000.00, and shall said ordinance, inso- far as it refers to said proposition be ratified -by the qualified • voters of said City? In favor of Proposition I, for both City Hall and Jail, Against Proposition I, for both City Hall and Jail, In favor of Proposition 2, for Jail only, : Against Proposition 2, for Jail only, • Any voter who desires to vote in favor of Proposition I, shall place an X in the square to the right of the words "In favor of Proposi- tion I, for both City Hall and Jail ", and any voter who desires to vote against said proposition I, shall place an X in the square to the right of the words "Against Proposition 1, for both Cith Hall and Jail ". Any voter who desires to vote in favor of Proposition 2, shall place an X in the square to the right of the words T'In favor of Proposition 2, for Jail only", and any voter who desires to vote against said proposition 2, shall place an X in the square to the right of the words "Against Proposition 2, for Jail only ". Section 11. The polls of said election shall be open at 8:00 o'clock a.m., and shall remain open until 8:00 o'clock p.m. Notice of said election shall be given as required by law and the City Clerk is hereby directed to give such notice. The polling places in the various precincts of said city and the election officials to conduct said elec- tion shall be designated in accordance with law prior to giving of said election notice and shall be stated therein. Section 12. This ordinance is declared to be urgent and neces- sary for the immediate preservation of the public peace, health and safe- ty of the inhabitants and people of said city of Port Angeles, and shall take effect and be in force immediately upon and from and after its pass- age, approval and lawful publication. This ordinance shall be published once in the Port Angeles Evening News.
