HomeMy WebLinkAbout0919ORDINANCE N0. 9/f ,. AN ORDINANCE to provide for minimizing radio interference, and providing a penalty for the violation thereof. THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN AS FOLLOWS: Section 1. It shall be unlawful for any person, firm or cor- poration to operate in the City of Port Angeles, any machine, device or apparatus generating, producing or causing high frequency oscillations which interfere with radio broadcast transmitting or receiving apparatus, between the hours of 8:00 a.m. and 12 :00 p.m.; unless such apparatus shall be equipped with shielding and condensing devices approved by the Super- intendent of the City Light Department for avoiding radio interference; provided, however, that this section shall not prohibit the use of neces- sary equipment by regularly licensed physicians, surgeons and dentists in the actual administration of their therapeutic treatments to patients in 0 cases of emergency or extreme necessity. Section 2. Whenever the Superintendent of the City Light De- partment shall determine by means of detecting devices, operated by the City of Port Angeles, or otherwise, that any person, firm or corporation is interfering with radio broadcast transmitting or receiving, by reason of any apparatus, equipment or by reason of any defect therein, it shall be his duty, and he, or his authorized agent, shall have the right and privilege to enter upon the premises of such person, firm or corporation and inspect the apparatus or devices causing interference with radio broad- cast transmitting or receiving. The superintendent of the City Light De- partment shall thereupon notify the owner of such apparatus or device 1 causing such interference, to equip the same with proper shielding and condensing equipment, or to remedy the defect, or may in his discretion cause the same to be done and the owner thereof shall pay the cost of such installation or repair, provided, however, that public service corporations maintaining competent electrical experts, shall have fifteen days within • which they themselves may remedy any defect in their systems or apparatus causing nigh interference. Section 3. The following described electrical equipment and apparatus shall be deemed as coming within the meaning of this ordinance as defining equipment, apparatus and machines causing radio interference, to wit: Violet ray machines, machines using the Tesla coil or principle x -ray machines, open or quenched spark machines, or any machine including or incorporating a device producing high frequency oscillations; provided however, that this ordinance shall not apply to radio stations, commercial or amateur, which are licensed by the Federal Government or are employed in Interstate communication. Section 4. Any person, firm or corporation violating any of the terms of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding $100.00 or by imprisonment in the City jail for a term not to exceed thirty days or by both such fine and imprisonment. Section 5. This ordinance shall take effect and be in force af- ter its passage and approval and from and after thirty days after its law- ful publication.
