HomeMy WebLinkAbout09241 ORDINANCE NO. fit( _ AN ORDINANCE of the City of Port Angeles, Washington, grantirg to the Chicago, Milwaukee, St. Paul & Pacific Railroad Company, a Wisconsin corporation, its successors and assigns, a franchise grant- ing said corporation, its successors and assign, the right, privilege and franchise to construct and maintain a railroad track. along and upon certain streets and highways of the City of Port Angeles and to operate railroad trains and other railroad equipment over, across and upon said railroad track, specifying the limitations and conditions of such grant. THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES HRDAIN AS FOLLOWS: Section, 1. That the City of Port Angeles, Washington, does hereby grant to the Chicago, Milwauke, St. Paul & Pacific Railroad, a Wisconsin corporation, its successors and assigns, the right, pri- vilege-and franchise to construct and maintain a line of railroad track along, over and upon the following described streets and alleys of the City of Port Angeles, to wit: The North One -half of Third Street within the following limitations, to wit: Commencing at a point opposite the line between Lots Four and Five in Block One hundred, and three, of the Townsite of Port Angeles, which point is the intersection of Center Line of Seaview Drive and Third Street, thence Easterly to the Westerly margin of Tumwater Street, a distance of ap- proximately 770 feet. and to operate trains and equipment over and along such track when constructed. Such right, privilege and franchise shall continue and exist for a term of jtf years from and after the effec- tive date of this ordinance. Section 2. The construction, repair, operation and use of the said railroad shall be conducted in all respects in accordance with and under and pursuant to the provisions of the franchises under which the said railroad is at present operating within the City of Port Angeles and particularly the provisions and restrictions of Ordinance No. 457 of the City of Port Angeles. • A11 requirements of the said Ordinance Ho. 457 and of other effective ordinances regulating and controlling the operation of the said railroad and use of the streets and alleys of the City by said railroad, and all limitations and reservations of right, super- vision and control of and by the city, and all covenants, agreements and undertakings of -the said railroad or its predecessors in inter- est which are contained in Ordinance 457 and other effective ordi- nances shall govern the use, operation and control of the said railroad in this franchise, except as otherwise specifically set forth herein. Section 3. The said grantee shall file its written acceptance of this ordinance and the rights and privileges granted thereunder in the office of the City Clerk of the City of Port Angeles within thirty days after the effective date of said ordinance which accept- ance shall contain an express undertaking by the grantee, its succes- sors- and:asigns -, -to comply with,__abide by.and be bound by the terms and requirements thereof. Section 4. The work of the construction of the said railroad track shall commence within "A days after the effective date of the franchise and shall be carried on to completion within_) 1 days from the effective date hereof and if not so completed within said time, all the rights and privileges under this franchise shall be forfeited and the franchise shall be declared null and void at the option of the City Commission of the City of Port Angeles.
