HomeMy WebLinkAbout1003/(`'.3 ORDINANCE NO. 1005 AN ORDINANCE Amending Sections 10, 20, 21, 37, 77, 78 and 92 of Ordinance No. 971 of the City of Port Angeles, being an ordi- nance relating to and providing for the licensing of certain occupations, vocations, trades, amusements, etc., THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN AS FOLLOWS: Section 1. That Section 10 of Ordinance No. 971 be and the same is hereby amended to read as follows: "Section 10. Licenses for transfer and commercial trucks, fuel trucks and wagons, public dances not conducted in a regularly licensed dance hall, hawkers and peddlers applying for license for less than one week, may be issued directly by the City Clerk with the approval and endorsement of the Mayor and the Chief of Police; all other licenses shall-be issued by the City Clerk after approval by the City Commission." Section 2. That Section 20 of Ordinance No. 971 be and the same is hereby amended to read as follows: 'Section 20. Auctioneer's License: It shall be unlawful for any person to sell or offer for sale any goods, wares, merchandise, or other personal property or real property of any kind or nature, at auction, without firet procuring a license so to do, to be known as an'Auctioneer'e License.' The following shall be the fees for such Auctioneer's License: For a period of one month or lees, not 1 .as ban $25.00. For a period of three monthw,- $50.00. For a period of from three months to one year, $100.00. No such license shall be issued in the name of more than one person, nor in the name of any firm, company or corporation; provided, that no license shall be required of any public officer, executor, administrator, guardian or trustee who shall Bell or offer for sale at auction any property pursuant to legal process. No itinerant or transient person shall be granted an auctioneer's license." • sue, r Section 3. That Section 21 of Ordinance No. 971 be and the same is hereby amended to read as follows: "Section 21. Auctioneer's Bonds: Any applicant for an auctioneer's license shall file with his application therefor a surety bond duly executed in the penal sums as follows: For a period of three months or less, $500.00. For a period of more than three months and including a year's license, $1000.00. Bonds shall run to the City of Port Angeles, conditioned that the said principal shall conduct all auctions in an orderly manner and abide by the provisions of this ordinance and all other ordinances and state laws and that no fraud or imposition shall be practiced upon the buyers at the auctions conducted by the applicant and that a true and strict account and record of all sales shall be kept as a permanent record and also rendered to the persons employ- ing said auctioneer. Said bonds: shal1.be :further conditioned that any person shall Pave the right of action and redress under said bond." Section 4. That Section 37 of Ordinance No. 971 be and the same is hereby amended to read as follows: "Section 37. Commercial Truckle and Cars: shall mean any motor truck or car used for the transportation of merchandise, freight or advertising matter over and upon the public streets in the City of Port Angeles other than those designated as trans- fer trucks." "Commercial trucks _ and cars shall -also mean and include trucks carrying tools, supplies and equipment about the city commonly known as 'service trucks', and trucks equipped to raise, move and tow disabled motor vehicles, said trucks being commonly known as 'wreckers'." Section 5. That Section 77 'of Ordinance No. 971 be and the same is hereby amended to read as follows: • "Section 77. Second -Hand Dealer Defined: Any person who, within the City of Port Angeles, shall as a business, engage in the purchase, sale, trade, barter or exchange of second -hand goods or merchandise (other than junk as herein defined) is here- by defined to be a second -hand dealer within the meaning of this ordinance; Provided, however, that this definition shall not be understood to apply to dealers who acquire second -hand goods only in trade or sale of new goods." Section 6. That Section 78 of Ordinance No. 971 be and the same is hereby amended to read as follows: "Section 78. Second -Hand Dealer's License Fee: It shall be unlawful for any person to engage in the business of second -hand dealer without first procuring a license to to do, to be known as • a ' Second -Hand Dealer's License'. The fee for such Second -hand Dealer's License shall be, and the same is hereby fixed at Fifteen ($15.00) Dollars per annum. Any person having moretithan one place of business where second- hand goods are bought, sold, traded, bartered or exchanged, shall be required to procure a separate license for each and every such place of business." 1 Section 7. That Section 92 of Ordinance No. 971 be and the same is hereby amended to read as follows: "Sectioh 92. Any person,conduoting or maintaining, either as principal or agent, any stand or place where non - intoxicating beverages ar-e.sold.or offered for.sale_at. retail, shall pay a license fee for each such stand or place as follows: For each separate stand or place where such drinks or liquids are sold or offered for sale, $5.00 per annum." • • Section 8. This ordinance shall be in full force and effect from and after thirty (30) days from and after its passage, ap- proval and lawful publication.
