ORDINANCE NO. 1088
1 1 AN ORDINANCE providing for and regulating the giving of franchises, providing
2 ' for the manner in which the consideration therefor shall be determined, and re-
3 , pealing Ordinances 465 and 346, and all other ordinances or parts of ordinances in
4 1 conflict herewith.

iiJ CITY COWXSSION OF THE CITY OF PORT ANGELES DOES ORDAIN AS FOLLOWS:
6 I Section 1. No franchise or right to occupy or use the streets, alleys, high-

iways, bridges or public places in the City of Port Angeles shall be granted, re-
8 1 newed or extended, except by ordinance; and every ordinance granting any such fran -1

chise shall be complete in the form in which it is finally passed, and shall remain
on file with the City Clerk for public inspection at least one week before the
final passage or adoption thereof.
12 Section 2. Every franchise or grant for interurban or street railways, gas or1
13 G water works, electric light or power plants, heating plants, telegraph or telephone
14 systems, or other public service utilities within said city must be authorized or
15 approved by a majority of the electors of said city voting thereon at a general or
16 special election.

Section 3. The consideration to be paid for any such franchise shall be stated
in the ordinance granting the same, and shall be fixed by the City Commission.
19 Section 4. All publications of ordinances granting a franchise shall be made d
20 at the expense of the grantee.
21 Section 5. No exclusive franchise or privilege shall be granted for the use
22 of any street, alley or highway, or any other public place or part thereof; and no
23 franchise shall be granted for a longer period of time than fifty years.
24 Section 6. Ordinances No. 465 and No. 346 and all ordinances and parts of
25 ordinances in conflict with this ordinance are hereby repealed.
26 1 Section 7. This ordinance shall be in full force and effect thirty (30) days
27 i after Its passage, approval and lawful publication.
28 1 Passed first reading by the City Commission August 13, 1941.
29 1 Passed second reading by the City Commission August 20, 1941.
• 30 1 Passed third reading and finally passed and adopted by the City Commission
31 August 20, 1941.
