HomeMy WebLinkAbout11301 2 Of ORDINANCE NO. 1130 An ordinance amending Ordinance No. 1101 of the City of Port Angeles, adopted by the City Commission April 15, 1942, dec= 3 laring an emergency and making the ordinance effective immediately. 4 1 The City Commission of the City of Port Angeles does 5 ordain as follows: 6 Section 1. That there is hereby added to Ordinance No. 7 �' 1101, adopted by the City Commission on the 15th day of April, 1942, 8 k another section, as follows: 9 That any decision rendered by the Health Officer in the 10 enforcement of this Ordinance shall be subject to appeal to the City 11 • Commissioners of the City of Port Angeles, and any person feeling 12 ,! agrieved by any such decision of the Health Officer or his repre- 13 4 sentative, shell have the right to appeal to said City Commission, 14 '! by notifying the said City Commission, in writing, of the decision 15 or decisions from which he is appealing, and the City Commission 1.6 shall fix a date of hearing which shall not be less than ten days 17 from the date of receipt of notice of said appeal, which notice 18 shall specify the details of said decision. i 19 The City Commission, at said hearing on appeal, shall 20 have authority to supoena. any person or any records and hear any 21 testimony offered or deemed material by the Commission, and a two- 22 thirds vote of the Commission'shall be final as to the decision for 23 the enforcement of this Ordinance or any part thereof, which decision 24 and vote shall be recorded by the City Clerk in the minutes of the 25 City Commission proceedings. 26 Said City Commission, in reviewing and hearing any appeal 27 shall have power to fix any conditions which, in their judgment, 28 may be fitting and proper under all the circumstances, to obtain as 29 effective compliance with this ordinance as is possible without 30 being unreasonable, unjust or creating unnecessary hardship. Section 2. Pending the appeal and the decision of the 1 ; City Commission herein referred to the decision of the Health 2 3 410 4 5 6 7 8 9 10 11 Department shall be in full force and effect and shall remain so until reversed by a two - thirds majority of the City Commissioners. In order that there may be full publicity for any and all hearings held hereunder, notice of such hearings shall be given by an advertisement in a newspaper of general circulation in Clallam County, Washington, at least three days before any such hearing, which advertisement shall occupy one column space and be four inches in height and which advertisement shall be paid for by the City of Port Angeles. At any such hearing, the City shall employ a competent 12 Court reporter or stenographer to take all testimony, a copy of 13 which shall be available to any person desiring the same and paying 14 for such copy. Upon the request of any person present at such 15 hearing, either interested therein or as a citizen, the City Com- i 16 mission may order a full transcript of such testimony and. submit 17 the same to any newspaper in Clallam County, Washington, wishing 18 a copy thereof so that full, adequate and complete publicity may 19 be given in everything pertaining to said hearings. 20 Section 3. This Ordinance is necessary for the preserva- 21 tion of peace, health and safety of the inhabitants of the City of 22 Port Angeles, and shall take effect and be in force immediately 23 after its final passage, approval and lawful publication. 0 24 r .
