HomeMy WebLinkAbout1155• ORDINANCE NO. //5-5- AN ORDINANCE vacating portions of "B ", "C ", "D" and "E" Streets and portions of Second and First Streets, and portions of the alleys in Blocks thirty -eight (38) and one hundred four (104) in the City pi Port Angeles. "'HFRF'AS, the Port of Port Angeles, a municipal corporation of the State of :ashington, and the Fibreboard Products, Inc., a corporation, having filed herein their petition praying for the vacation of certain portions of streets and alleys in the City of Port Angeles, and it ap- pearing that the petitioners are the owners of more than two- thirds (2/3) of the property abutting upon the parts of the streets and alleys sought to be vacated, and that due and legal notice of the time and place of said hearing has been given, and the Mayor and City Commission having determined that said petition should be granted, now, therefore, B ?'. IT ORDAINED BY THE MAYOR AND CITY COML ISSION OF TH7 CITY OF POPT ANGLES: Section 1. That the following parts of streets and alleys, des- cribed as follows, to -wit: That portion of Railroad Avenue extending from the West line of "E" Street to the West line of Lot Six (6) in Block One Hundred Seventeen (117), and the West line of Lot Six (6) in Block Twelve (12) of Tidelands West of Laurel Street. That portion of "E" Street extending from the .0,ortherly line of Marine Drive, or Third Street, to the Inner Harbor Line, and lying between Blocks Eleven (11) and Twelve (12) of Tidelands West of Laurel btreet. That portion of "D" Street extending from the North line of Marine Drive, or Third Street, to the Inner Harbor Line, and lying between Blocks Ten (10) and Eleven (11) of Tidelands West of Laurel Street. That portion of "C" Street extending from the North line of the alley, running through Blocks One Hundred Five (105) and One Hundred Ten (110) of the Townsite of Port Angeles to a point ten (10) feet South of the South line of Third btreet, or Marine Drive, and that portion of "C" Street North of the North line of Third Street, or Marine Drive, and extending to the Inner Harbor Line, and lying between Blocks Nine (91 and Ten (10) of Tidelands "'est of Laurel Street. • That portion of "B" Street extending from the forth line of the alley, running through Blocks One Hundred Three (103) and One Hundred Five (105) of the Townsite of Port Angeles, and extending, North to a point ten (10) feet South of the South line of Third Street, or Marine Drive, and that portion of "B" Street extending from the North line of Marine Drive, or Third Street, to the Inner Harbor Line, and lying between Blocks One Hundred Four (104) and One Hundred Four and One -Half (1041) of the Townsite of Port Angeles, and between Blocks- Eight 78) and Nine (9) of Tidelands West of Laurel Street. That portion of the alley in Block One Hundred Four (104) of the Townsite, and lying Yesterly of the right of way of the Chicago, Milwaukee, St. Paul and Pacific Railroad. That portion of ''econd Street extending from the Westerly line of the Chicago, Milwaukee, Wit. Paul and Pacific Railroad right of way and Tumwater Creed water way. That portion of the alley in Block Thirty -eight (38) of the Town- site of Port Angeles extending from the Westerly line of the Chicago, Milwaukee, St. Paul and Pacific Railroad right of way and "A" Street vacated. That portion of First Street extending from the Westerly line of Tumwater Street to the Inner Harbor Line, and lying between Block Nine (9) of Tidelands West of Laurel Street and Block Thirty - eight (38) of the Townsite of Port Angeles. Excepting from any of the above descriptions, any portion which may be covered, or extend over, or upon any portion of the right of way of the Chicago, Milwaukee, St. Paul and Pacific Railroad. be and the same are hereby vacated. Section 2. The City of Port Angeles speafically reserves the right to go in and upon the portions of the streets and alleys herein vacated for the purpose of erecting utilities poles, laying sewers, or establishing any other public utilities which it may determine •.necessary on said streets and alleys, with the right of ingress and eggress for the purpose of constructing, maintaining or removing said facilities. Section 3. This ordinance shall take effect and be in force thirty (30) days from and after its final passage, approval and lawful publication. Passed first reading by the City Commission this 13th day of February, 1946. Passed second reading by the City Commission this day of February, 1946. Passed third reading and finally passed and adopted this X,94 day of February, 1946.
