HomeMy WebLinkAbout1216• • ORDINANCE NO. 1,2 AN ORDINANCE providing for the exploitation and advertising of the general advantages of the City of Port Angeles, creating a fund therefore, creating a publicity board, providing for a tax levy, repealing ordinances in conflict herewith and declaring an emergency. RR IT ORDAINED by the City Commission of the City of Port Angeles as follows: Section 1. That there is hereby created in the treasury of the City of Port Angeles a special fund which shall be known as the publicity fund of the City of Port Angeles. The City Treasurer shall at all times keep a separate account of such fund and of the receipts and disbursements thereof, ands shall not at any time nor in any manner commingle or confuse such fund with any other funds of said City. Section 2. Such publicity fund shall be expended only to de- fray the cost and expense of exploiting and advertising the general advantages of and opportunities extant in the City of Port Angeles and its vicinity under the direction of the publicity board herein- after created: Provided, however, that no part of such fund shall ever be paid to any newspaper, magazine or periodical published with- in the City of Port Angeles or the County of Clallam, for advertis- ing or write -ups or for any other service or purpose whatsoever, nor shall any part of such fund be expended for the purpose of making any exhibits at any fair, exposition or the like. Section 3. There is hereby created in and for the City of Port Angeles a publicity board which shall consist of three members, all of whom shall be nominated by the Port Angeles Chamber of Com- merce, or its successor, and appointed by the Mayor, which appoint- ment shall not be effective until the same shall have been confirmed by a two- thirds vote of the City Commission or other legislative body of said City. The Port Angeles Chamber of Commerce, or its suc- cessor, shall make no nominations of persons to be appointed to the publicity board unless and until it shall have certified in writing over the signatures of its president and secretary that it is the oldest recognized commercial organization in the City of Port Angeles that is public and representative and devoted exclusively to the work usually devolving upon Chambers of Commerce and similar organ- izations, and that it has 200 or more bona fide dues paying members and is incorporated under the laws of the State of Washington. Such certificate shall be filed annually with the City Clerk. All members of such publicity board shall be bona fide residents and registered voters of the City of Port Angeles and shall serve without salary or compensation. The first members of the publicity board shall be nominated and appointed immediately after the effective date of this ordinance and shall hold office un- til the second Monday in January, 1951, or until their successors have been appointed and qualified. Commencing with December, 1950, three members of the publicity board, having been first nominated as herein provided, shall be appointed at the first meeting of the City Commission or other governing body in December of each year and shall hold office for a term of one year, beginning on the second 'Monday in January following their appointment, or until their suc- cessors have been appointed and qualified. Upon their appointment and confirmation and prior to the beginning of their terms, each mem- ber of the publicity board shall qualify by taking an oath of office and filing the same in writing with the City Clerk and by filing with said Clerk an official bond running to the City of Port Angeles as obligee in the penal sum of X1,000.00, conditioned upon the faithful performance by them of their official duties. • • lithin thirty (30) days after t;aeir appo.Lntment land qualification the members of the publicity board shall meet, !1orgar.ize and elect a chairman, a secretary and such other officers as they may deem necessary or desirable, such officers to serve un- Itil the expiration of their terms as board members, or until their 1 successors are duly elected. The publicity board shall meet at 'least once each month at a time and place to be fixed at their or- ganization meeting,, at which time they shall promulgate such rules for the government and functioning; of such board as may be necessary and not inconsistent with the laws of the State of .shin :ton or the ordinances of the City of Port Angeles. Vacancies upon said board shall be filled by the same procedure used for the appointment of members. Vacancies among the officers of the board shall be filled I by election from the membership to serve for the unexpired term. Any member of the publicity board shall be re- moved by the Mayor upon the request of the Port Angeles Chamber of 'Commerce, or its successor, when a majority vote of the entire mem- bership of such organization favoring such removal shall have been .cast at a regular meeting of the members thereof. Such removal shall Knot be made by the Mayor unless and until a certified copy of the minutes of the meeting of the nominating organization, showin: a majority vote of the entire membership thereof favoring such removal and signed by the president and secretary of such organization, shall' have been filed with the City Clerk. Section 4. The duties of the publicity board shall be to ex- ploit by suitable publicity, advertise and publicize the advantages thereof with a view to attracting desirable visitors and residents and promoting industrial and cormercial development advantaieous to 'the general %elfare and prosperity of the people of said City, by such methods of publicity as shall in the jud-aent of said board be • well calculated to accomplish the ends above stated. Such publicity • board shall have auteeritx; to expend the publicity fund created by Section 1 hereof for the necessary cost of the publicity and adver- Stising herein authorized and for no other purpose. Expenditures of said fund shall be made only upon warrants.drawn against the sane and signed by the chairman and secretary of the publicity board. Section 5. . ?or the maintenance of the publicity fund created !by Section 1 hereof the City of Port tin :eles shall levy annually, as nay be necessary, a special tax not exceeding 2' mills upon the dollar of the assessed valuation of all of the taxable property within such City as determined by the Clallam County Assessor for purposes of general taxation. All moneys derived from such tax shall be paid in- to such publicity fund and shall be paid out only as herein provided. Section 6. All ordinances and parts of ordinances in conflict! herewith are hereby repealed. Section 7. This ordinance is hereby declared to be immediately 'necessary for the preservation of the public peace, safety and wel- �j fare of the City of sort ,,ngeles, an emergency hereby declared to exist and this ordinance shall be effective immediately upon its final passage and publication in the manner provided by law.
