I2,3 AN ORJINA TCE stating the facts of an emergency affecting the public health, peace and safety of the City of Port Angeles; requiring the unforeseen expenditure of funds; providing for '6iie issuance of emergency warrants and declaring an emergency. That by reason of unforeseen and unexpected and unusually violent discharge of flood waters over, across and upon the premises known as the Ocean View Cemetery and owned and operated as a cemetery and burial ground by the City of Port Angeles, said premises have been seriously damaged by said flood waters suddenly and rapidly eroding and greatly deepening and widening a certain gully or water course running through said premises and cemetery. That such erosion and crashing away of soil has progressed to an extent where portions of said cemetery heretofore used as a burial ground and having graves therein containing bodies has been damaged, is now being damaged and will in the future be further damaged unless immediate steps are taken to control such flood waters and halt such erosion. That by reason of such flooding, (erosion and damage it has been necessary for the City of Port Angeles to exhume and remove numerous bodies from the area so eroded, flooded and damaged to other locations, and that it is fur- ther necessary, in order to stop such flooding, erosion and damage, Ito construct a suitable drain of concrete pipe in the gully or water course crossing said cemetery premises to safely conduct and drain away the flood waters cast into said Fully in such manner that said waters will cause no further damage or erosion. That the cost of said operation is the sum of approxi- mately 0,000.00, of which sum •4,000.00 is in excess of any funds 1 • • now available in the budget of the City of k'ort Angeles. That such damage and erosion,and the full extent of the flood waters, and the magnitude of the damage caused thereby, and the cost of repairing such damage and erecting suitable works to prevent further damage could not reasonably have been foreseen at the time of making and preparing the budget for the City of Port Angeles for the year 1950. That the amount provided in said budget and the various funds thereof was not sufficient to meet the expenses of repairing the damage caused by such floodinu and erosion and to control fur- 1 Lther damage therefrom. That the amount required to meet such ex- penses in excess of the funds available in said budget is the sum II of y4,000.00. Section 2. That the expenditures to be made in excess of the funds provided in the budget of the City of Port Angeles for 1950 for the above purposes are for the protection and preserve.- tion of the public health, peace and safety of the inhabitants of the City of Port Angeles. Section 3. That by reason of the facts above stated an emergency exists which requires the issuance of emergency warrants provide for said expenditures in the sum of ?4,000.00. gnat such emergency warrants shall be paid from any moneys on hand in the treasury of the City of Pori Angeles, properly chargeable with such expenditures, and the Iayor and City Clerk are hereby author - 0.zed to execute, in and deliver and the City Treasurer to pay 'such emergency warrants on and from such funds. Section 4. That the amount of such emergency warrants 'shall be included and provided for in the annual budget of the City. of Port Angeles for the year 1951, and such budget shall include tax levies sufficient to reimburse the fund or funds out of which , such emergency warrants are paid. Section 5. That this ordinance is necessary and urgent for the preservation and protection of the public peace, health and safety of the people of the City of Port Angeles, that an emergency exists, and this ordinance shall take effect and be in force immed- iately upon its passage, approval and publication in the manner provided by law.
