HomeMy WebLinkAbout1244• • ORDINANCE NO. 1:05/5/ AN ORDINANCE stating the facts of an emergency affecting the public safety, welfare and convenience of the City of Port Angeles; requiring the unforeseen expenditure of funds; providing for the issuance of emergency warrants, and declaring an emergency. THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1. That by reason of unexpected, unforeseen and unusually severe winter weather and storm conditions during the winters of 1949 and 1950, and 1950 and 1951, that certain thorough- fare known as the Ediz Hook Road, being and situate upon Ediz Hook in and in front of the City of Port Angeles, has been severely damaged and partially destroyed. That the City of Port Angeles is under contractual obligation to the United States government to maintain said thoroughfare, and that certain industries situated under along said thoroughfare are /contractual obligation to the City of Port Angeles to maintain the same. That it is necessary for the public safety, welfare and convenience of the City of Port Angeles that said thoroughfare be rebuilt and that certain engineering works be erected to protect the same against damage from the sea in stormy weather. That those certain industries under contractual obligation to the City of Port Angeles have provided and paid to said City certain funds to be used in the repair and reconstruction of said thoroughfare, which funds are sufficient to meet a portion of the cost thereof but are not budgeted in the budget of the City of Port Angeles for the year 1951. That the cost of repairing and 'reconstructing such thoroughfare and providing the engineering 'works for the protection thereof is in excess of the funds so con- tributed, and that it is necessary that the City of Port Angeles .provide additional funds for such purpose. • • Section 2. That the cost of repairing and reconstructing such thoroughfare and providing the engineering works for the pro- tection thereof is the sum of 018,500.00, all of which sum is in excess of any funds now available in the budget of the City of Port Angeles. That there are no funds provided in such budget and the various funds thereof to meet the expenses of repairing and re- constructing such thoroughfare and building the engineering works necessary for the protection thereof. Section 3. That the expenditures to be made in excess of the funds provided in the budget of the City of Port Angeles for the year 1951 for the above purposes are for the protection and preservation of the public welfare, safety and convenience of the inhabitants of the City of Port Angeles and could not reasonably have been foreseen at the time of the preparation and adoption of the budget of said city for the year 1951. Section 4. That by reason of the facts above stated an emergency exists which requires the issuance of emergency warrants to provide for the expenses of so repairing and reconstructing such thoroughfare and building the engineering works necessary for the protection thereof in the sum of $18,500.00. That such emergency warrants shall be paid from the monies contributed and provided to the City of Port Angeles by the various industries situated along such thoroughfare and under contractual obligation to the City of Port Angeles to repair and maintain such thoroughfare and any other monies on hand in the treasury of the City of Port Angeles, properly chargeable with such expenditures, and the Mayor and City Clerk are hereby authorized to execute, sign and deliver and the City Treasurer to pay such emergency warrants on and from such fund. Section 5. That the amount of such emergency warrants shall :be included and provided for in the annual budget of the City of Port Angeles for the year 1952, and such budget shall include tax ,levies sufficient to reimburse any fund or funds other than those I .City Clerk APPROVED AS TO FORM: contributed to the City of Port Angeles as above stated from which such emergency warrants or any of them shall be paid. Section 6. That this ordinance is necessary and urgent for the preservation of the public safety, welfare and convenience of the people of the City of Port Angeles, that an emergency exists, and this ordinance shall be in full force and effect immediately upon its passage, approval and publication in the manner provided by law.
