HomeMy WebLinkAbout1246• • ORDINANCE NO. /..V/6 AN ORDINANCE ORDERING AND PROVIDING FOR THE IMPROVEMENT OF FIFTH STREET FROM THE WEST MARGIN OF "A" STREET TO THE EAST MARGIN OF "E" STREET, BY THE CONSTRUCTION OF CEMENT, CONCRETE SIDEWALKS ALONG THE NORTHERLY SIDE OF SAID FIFTH STREET. Creating Local Improvement District #155 and providing for the payment of the cost and expenses thereof by such special assessments upon the property within said District according to law, and by the mode of payment by bonds, all in accordance with Improvement Resolution #155 of the City of Port Angeles, and in accordance with the maps, plans and specifications prepared by the City Engineer and approved and adopted by the City Commission. The City Commission of the City of Port Angeles do ordain as follows: SECTION 1. There is hereby ordered the improvement on Fifth Street from the Westerly margin of "A" Street to the Easterly margin of "E" Street, by the construction of cement concrete side- walks along the Northerly side of Fifth Street from said "A" to "E" Street. All of said improvement to be done in accordance with the maps, plans and specifications prepared by the City Engineer and approved and adopted by the City Commission in accordance with Improvement Resolution #155 of the City of Port Angeles. SECTION 2. The cost and expense of said improvements, in- cluding all necessary and incidental expenses shall be borne by and assessed against the property situated and included within the boundaries of the District hereinabove created and described in accordance with law and the Ordinances of the City of Port Angeles. The said City shall not be liable in any manner for any part of the cost and expenses of said improvements, except so far as the said City is made liable by virtue of the Statutes of the State of Washington in such cases made and provided and particu- larly those Statutes providing and directing the City of Port • • 1 Angeles create a Local Improvement guarantee fund for the purpose of guaranteeing, to the extent of such fund, and in the manner provided by law for the payment of Local Improvement Bonds issued I1 to pay for local improvements ordered by said City. SECTION 3. That there is hereby created a Local Improvement District to be called Local Improvement District No. 155 which includes all of the property especially benefited by such improvement, which territory is described and fixed as follows, to- wit: All of the property abutting on the North side of Fifth Street from the westerly margin of "A" Street to the easterly margin of "E" Street, and back to the alley running through the middle of the blocks, lying between "A" Street on the East, and "E" Street on the West and by- setting the blocks between Fourth and Fifth Streets. SECTION 4. That the property between the termini of said improvement and within the buildings of said district comprising all i of the property especially benefited by said improvement shall be the property especially assessed to pay the cost and expense of such improvement by the zone and termini as provided in Section 13 of Chapter 98 of the laws of 1911 as ammended by Chapter 155 of the laws of 1947 (Remingtons Revised Statutes, Section 9365). SECTION 5. Bonds bearing interest not to exceed five per cent (5%) per annum payable on or before twelve (12) years from the date of their issue, shall be issued in payment of the cost and expenses of said improvements; which bonds may be redeemed by the collection of special assessments to be levied and assessed against the property within said District, payable in ten (10) annual installments under the mode of "payment by bonds" as provided by law; these bonds may be delivered to the contractor • in redemption of warrants on the special fund of the Local Improve- ment District herein created, on estimates of the City Engineer, or the said City, at its election may sell said bonds and make such liredemption in cash or cash warrants. SECTION 6. This ordinance shall be in full force and • effect immediately after its passage and approval and lawful publication. Passed 1st reading by the City Commission 1951. 1951.
