HomeMy WebLinkAbout1258el • ORDINANCE NO. 1.2.52 An Ordinance of the City of Port Angeles, pro- viding for the improvement of Vine Street, Peabody Street and Tenth Street, by construct- ing concrete curbs and gutters thereon and creating a Local Improvement District to provide for the payment of such improvement. WHEREAS, Resolution No. 159 was passed by the Commiss- ion of the City of Port Angeles on July 16 , 1951, declaring the intention of the Commission to order the improvement hereinafter described, and fixing a time for hearing thereon; and ;"WHEREAS, said hesolution has been duly published and notice of said hearing given as required by law; and WHEREAS, said hearing was held as provided in said notice, and after due consideration, the Commission of the City of Port Angeles decided to order the construction and installation of such improvement; Now therefore BE IT ORDAINED by the City Commission of the City of rort Angeles as follows: SECTION 1. That the following streets and alleys of the City of Port Angeles be improved by the construction and installation of concrete curbs, gutters and driveways, together with all necessary appurtenances thereto, and by doing such other work as may be necessary in connection therewith, including all necessary labor and materials for the complete construction and installation thereof: Vine Street, Peabody Street and Tenth Street, from the Southerly margin of the alley running through Block 288 of the Qownsite of Port Angeles; thence Southerly along the 'vJest curb line of Vine Street to its intersection with Tenth Street; thence :'Westerly along the North curb line of Tenth Street to its intersection with Peabody 'Street; thence Northerly along the East curb line of Peabody Street to the South margin of the alley running through said Block 288, and Block from the Northerly margin of the alley running through /331 of the • Townsite of Port Angeles; thence North along the ;'lest curb line of Vine Street to its-intersection with Tenth Street; thence ',:est along the Southerly curb line of Tenth Street to its intersection with 'Peabody Street; thence South along the Easterly curb line of 2eabody Street to the Northerly margin of the alley running through said Block 331. SECTION 2. That the cost and expense of such improvement shall be borne by and assessed against the property situated and in- cluded within the boundaries of the district hereinafter created and described, and the City of Port Angeles shall not be liable in any I}nanner for any part of the cost and expense of said improvement, i 'except, in so far as said City is made liable by virtue of the statutes of the State of aashington in such cases made and provided, particularly the statute providing for a Local Improvement Guarantee Fund. SECTION 3. That there is hereby created a Local Improvement District to be called Local Improvement District No. 159, which includes all of the property especially benefited by such improve- ment, which territory is described and situated as follows, to -wit: That portion of the area of the City of Port Angeles bounded on the North by the Southerly margin of the alley running through Block 288 of the Townsite of Port Angeles; on the South by the Northerly margin of the alley runring through Block 331 of the Town - site of Port Angeles; on the East by the ti',esterly margin of Vine Street, and on the .:est, by the Easterly margin of Peabody Street. SECTION 4. That the property between the termini of said improvement and within the boundaries of said district, comprises all of the property especially benefited by said improvement, and said property shall be specially assessed for the cost and expense of such improvement by the zone and termini method as provided in Section 13, of Chapter 98 of the Laws of 1911, as amended by Chapter 155 of the Laws of 1947 (Remington's Revised Statutes, Section 9365, 194? Supplement). SECTION 5. Bonds bearing interest at the rate of not to exceed 11 per cent per annum, payable on or before twelve (12) years from the date of their issue, shall be issued in payment of the cost and expense of said improvement, which bonds may be redeeme by the collection of special assessments levied and assessed against the property within said district, payable in ten (10) equal install - ents, under the mode of payment by bond as provided by law. Such � bonds may be delivered to the contractors, constructing such improve- ent in redemption of warrants on the special fund of such Local Improvement District hereby created on estimates of the City Engineer, or the City may at its election sell such bonds and make the redemption in cash or cash warrants. SECTION 6. This ordinance shall be in full force and effect immediately after its passage, approval and lawful publication. Passed first reading by the City Commission August 20th, 1951.
