HomeMy WebLinkAbout1273ORDINANCE NO. 4:273 AN ORDINANCE of the City of Port Angeles regulating the in- stallation and use of radio antenna and similar devices, providing a penalty and declaring an emergency. THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1. That from and after the effective date of this ordinance no person, firm or corporation shall install, construct, erect, maintain, use or have within the City of Port Angeles any outside radio antenna, mast, pole or other structure, whether in- tended for use in connection with the reception or transmission of radio, telephone, telegraph or television or otherwise, which shall be so located, positioned or constructed that the same shall be in contact with, or in dangerous proximity to, any electric light or power transmission line or wire, or any telephone or telegraph line or wire, or so that the same may become charged with electricity 'other than radio frequency energy, or mounted on, supported by or attached to any chimney, flue or smoke pipe or inserted in any vent, outlet or exhaust pipe or otherwise be hazardous or dangerous to :'persons or property. Each such antenna or similar device shall be mounted, supported and installed separately and independent of any other appurtenance or accessory of the building or structure upon or in connection with which the same shall be installed. Section 2. No such radio antenna or other device as des- cribed in Section 1 hereof shall hereafter be constructed, erected, or installed in the City of Port Angeles unless a permit therefore shall have been first obtained from the Superintendent of the Light Department of the City of Port Angeles. Applications for such per- mits shall be made to the Superintendent of the Light Department of the City of Port Angeles at the office of such Light Department and • • shall be in writing. A The of $1.00 shall be charged for each such permit, to be paid at the time of application therefore. Temporary installations for the purpose of finding the best loca- tion for antenna or for the demonstration of appliances or simi- lar purposes shall fully conform to the ordinances of the City of Port Angeles, but may be made upon notice to the Superintendent of the Light Department . of such City, which notice may be verbal or in writing and shall give the address of the premises where such in- stallation is being made and the name of the occupant thereof. No fee shall be payable or permit required for such temporary installa- tions, but upon the same being made permanent a permit shall be obtained therefore and fee paid as herein provided. No temporary installation shall continue for more than thirty (30) days and up- on the expiration of such time shall be considered permanent and a permit obtained and fee paid. Section 3. Upon completion of the installation of any such antenna or similar device, notice in writing thereof shall be given i,to the Superintendent of the Light Department of the City of Port Angeles, whereupon such installation shall be p ramptly inspected by such Superintendent or his authorized representative. If upon such inspection such installation shall be found to be in viola- tion of any ordinance of the City of Port Angeles, the same shall be, within ten (10) days, so altered as to comply with such ordi- nances or be entirely removed. Section 4. Operators of amateur radio broadcasting sta- tions who hold licenses for such stations from the Federal Communi- cations Commission shall obtain a permit and pay the fee as herein ;provided for the original antenna erected for each such station. Written notice of any change in location or structure of such ori- ginal antenna or of the erection of any other or additional antenna, which notice shall give the address of the premises upon which such • antenna is located, the name of the occupant thereof, a brief des - cription of the changes being made, and which notice shall be signed by holder of the permit for the original antenna, shall be given to the Superintendent of the Light Department of the City of Port Angeles, within five (5) days after such change shall be made, whereupon such antenna shall be inspected as herein provided. No fee other than for the original antenna. shall be payable for such amateur radio broadcasting stations. Section 5. Any person violating any of the provisions hereof shall be punished by a fine of not more than One Hundred Dollars (6100.00), or by imprisonment in the City Jail for not to exceed thirty (30) days, or by both such fine and imprisonment. Section 6. This ordinance is necessary for the preserva- tion of the public health, peace, safety and welfare of the City of Port Angeles; an emergency exists, and this ordinance shall be- come effective immediately upon its passage and publication in the manner provided by law.
