HomeMy WebLinkAbout1283ORDINANCE NO. j,2 83 AN ORDINANCE stating the facts of an emergency affecting the public safety, welfare and convenience of the City of Port Angeles; requiring the unforeseen expenditure of funds; providing 'for the issuance of emergency warrants; and declaring an emergency. THE CITY COMMISSION OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Section 1. That subsequent to the making and adoption of the budget of the City of Port Angeles for the year 1952 the voters of said City, at a special election called for the purpose, authorized the issuance of General Obligation Bonds for the pur- 1 pose of repairing, reconstructing and paving certain arterial streets in the City of Port Angeles. That by reason of an un- expected, unanticipated and unforeseen increase in the travel up- ion and use of the arterial streets of the City of Port Angeles by 'vehicular traffic in general and by heavy vehicles in particular said streets have become broken, rough, unserviceable and dangerous to vehicles and traffic and are in need of immediate and extensive repair, reconstruction and surfacing. That prior to the issuance lof the General Obligation Bonds authorized for the purpose of de- fraying the cost and expense of such repair, reconstruction and paving program it is necessary and proper that extensive prelimin- ary engineering work be undertaken and accomplished by the City of Port Angeles. That in order to accomplish such engineering work it is necessary that additional engineering help be secured and ;employed by and in the office of the City Engineer of the City of Port Angeles. That the cost and expense of securing and employing such additional engineering help is the sum of $5,500.00. Section 2. That the necessity for and the cost and expense of securing and employing such additional engineering help could • • not reasonably have been foreseen and anticipated at the time of the making and adoption of the budget of the City of Port Angeles !for the year 1952. That such cost and expense in the sum of J5,500.00 is entirely in excess of any funds provided in the bud- get of the City of Port Angeles for the year 1952. That there are no funds provided and available in such budget for the payment of such cost and expenses. Section 3. That the expenditures to be made in excess of .Rinds provided in the budget of the City of Port Angeles for such 'additional engineering help for the above purposes are for the pro- tection and preservation of the public welfare, health, safety and ,convenience of the inhabitants of the City of Port Angeles. That { by reason of the facts above stated an emergency exists which re- quires the issuance of emergency warrants to provide for the cost 9 and expense of so securing and employing such additional engineer - ing help in the office of the City Engineer of the City of Port Angeles. Section 4. That such emergency warrants shall be paid from any monies on hand in the treasury of the City of Port Angeles in 'funds properly chargeable with such expenditures, and the Mayor and City Clerk are hereby authorized to execute, sign and deliver, viand the City Treasurer to pay, such emergency warrants on and from 'any such funds. That the amount of such emergency warrants shall be included and provided for in the annual budget of the City of Port Angeles for the year 1953, and funds for the payment thereof shall be provided from the proceeds of the sale of the General Obligation Bonds of the City of Port Angeles authorized as afore- said and by tax levies included in the budget of the City of Port Angeles for the year 1953 to such extent as shall be necessary to reimburse any fund or funds out of which such emergency warrants shall be paid. Section 5. That this ordinance is necessary and urgent for if ithe preservation and protection of the public safety, welfare and P ;convenience of the people of the City of Port Angeles. That an emergency exists, and this ordinance shall take effect and be in force immediately upon its passage, approval and publication in the manner provided by law.
