AN ORDINANCE of. the City of Port Angeles stating the facts of an emergency affecting the public safety, welfare and convenience of the people of the City of Port Angeles; requiring the unforeseen jexpenditure of funds; providing for the issuance of emergency warrants; and declaring an emergency. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES ORDAIN as follows: Sectionl. That subsequent to the making and adoption of the budget of the City of Port Angeles for the year 1952, the City of Port Angeles has made a demand upon Clallam County Public Utility District No. 1 for a readjustment in the rate at which electric power is sold to said City by said Public Utility District. That said demand was made in accord with and under the terms and conditions of a written c ntract heretofore entered into by and be- tween said City and said Public Utility District, by the terms of which the City of Port Angeles is entitled to have said contract amended to enable the City `to purchase power at a lower rate from such District. That such demand has been refused by said Public Utility District and that in order to provide for the enforcement 'thereof by the City of Port Angeles, it is necessary for said City to procure and hire additional legal and engineering help and ex- pend additional sums for legal, engineering and technical data and various extraordinary legal, engineering and other technical costs and expenses in connection with litigation to enforce the demand of said City against said Public Utility District. Section 2. That the necessity for and the cost and ex- pense of employing such extra legal and engineering help and assist - ance, securing and assembling such legal, engineering and other technical data, and conducting such litigation could not reasonably M have been foreseen and anticipated at the time of the making and adoption of'the budget of the City of Port Angeles for the year ' 1952. That such cost and expense is in the sum of X10,000.00 and is entirely in excess of any funds provided for in the budget of the City of Port Angeles for the year 1952, and that there are no funds available in such budget for the payment of such cost and expense. Section 3. That the expenditures to be made for the above purposes in excess of funds provided in the budget of the City of Port Angeles for the year 1952 are for the protection and preservation of the public welfare, safety and convenience of the Inhabitants of the City of Port Angeles. That by reason of the facts above stated an emergency exists which requires the issuance ,of emergency warrants to provide for the cost and expense of so securing and employing additional legal and engineering help and securing and assembling legal, engineering and other technical data and defraying the cost and expense of such litigation to enforce such demand on the part of the City of Port Angeles. Section 4. That such emergency warrants shall be paid from any monies on hand in the Treasury of the City of Port Angeles in funds properly chargeable with such expenditures, and the City Manager and City Clerk are hereby authorized to execute, sign and ,deliver, and the City Treasurer to pay, such emergency warrants on and from any such funds. That the amount of such emergency warrants shall be included and provided for in the annual budget of the City iof Port Angeles for the year 1953. That tax ]e vies shall be in- eluded in the budget of the City of Port Angeles for the year 1953 to such extent as shall be necessary to reimburse any fund or funds 'out of which such emergency warrants shall be paid. • • Section 5. That this ordinance is necessary and urgent for the preservation and protection of the public safety, wel- fare and convenience of the people of the City of Port Angeles. That an emergency exists, and this ordinance shall take effect and be in force immediately upon its passage, approval and pub- lication in the manner provided by law. INTRODUCED 7 , 1952.
