HomeMy WebLinkAbout1293• • Lhe improvement of certain streets and alleys in the City of Port Angeles by the construction and laying therein of certain lateral sanitary sewers, all in accord with Improvement Resolution No. 162 of the City of Port Angeles; creating a local improvement district for such improvement; and providing that payment for said improve- ORDINANCE NO. 1293 AN ORDINANCE of the City of Port Angeles providing for ment be made by special assessments on the property in said dis- trict specially benefited, payable by the mode of payment by bonds, all in accord -with maps, plans and specifications prepared by the City Engineer and approved by the City Council. WHEREAS, Improvement Resolution No. 162 was adopted by the City Council of the City of Port Angeles on December 18th, 1952, ;declaring the intention of the Council to order the improvement Lreinafter described and fixing a time for hearing thereon; and WHEREAS, said resolution has been duly published and due notice of said hearing has been given as required by law; and WHEREAS, said hearing was held as provided in said notice and written and oral protests of certain property owners were re- ceived, and after due consideration the Council of the City of Port Angeles by unanimous vote decided that it was necessary for the pro- tection of the public health to order the construction and installa- tion of such improvement; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO ORDAIN as follows: Section 1. That the following streets and alleys of the City of Port Angeles be improved by the laying and construction there- in of certain lateral sanitary sewers as follows, to wit: Columbia Street from a point approximately ten feet east of the westerly boundary line of Lot 16 in Block 2 of Puget Sound Cooperative Colo - iyts Subdivision of the Townsite of Port Angeles, westerly for a distance of approximately 537 Feet to a manhole in the intersection • • Lf Columbia Street with Chambers Street, and from a point approxi- mately 10 feet west of the easterly boundary line of Lot 17 in Block 3 of Puget Sound Cooperative Colony's Subdivision of the Town - site of Port Angeles, easterly to such manhole in the intersection of Columbia and Chambers Streets, and Chambers Street from such manhole in the intersection thereof with Columbia Street south to a manhole in the intersection of Chambers Street with the alley run- through Blocks 4 and 5 in Puget Sound Cooperative Colony's Subdivision of the Townsite of Port Angeles, all in the City of Port Angeles, Washington, by the construction and laying therein of a lateral sanitary sewer, including all necessary labor and material for the complete laying, construction and installation thereof with all necessary wyes, connections and manholes. Section 2. That the cost and expense of such improvement shall be borne by and assessed against the property situated and included within the boundaries of the district hereinafter created and described. That the City of Port Angeles shall not be liable in any manner for any part of the cost and expense of said improve - I�ment, except insofar as said city is made liable by virtue of the (statutes of the State of Washington in such cases made and provided, particularly the statutes providing for a local improvement guaranty fund. Section 3. That there is hereby created a local improve- ment district to be called Local Improvement District No. 162, which includes all of the property specially benefited by such improvement, which territory is described and fixed as follows, to wit: That portion of the area of the City of Port Angeles bounded on the north by the alley running through Blocks 2 and 3 of Puget Sound Cooperative Colony's Subdivision of the Townsite of Port Angeles, on the west by the west boundary line of Lot 17 in Block 3 of Puget Sound Cooperative Colony's Subdivision of the Townsite of r Port.Angeles, on the south by Columbia Street and on the east by the east boundary line of Lot 16 in Block 2 of Puget Sound Cooperative ;Colony's Subdivision of the Townsite of Port Angeles, and containing the following specifically described property, which is abutting upon, adjacent, vicinal and proximate to the streets and alleys to be improved, and which constitutes all of the property specially 'benefited by such improvements and all of the property to be tispecially assessed in the improvement district hereby created, to wit: Lots 17 and 18 in Block 3 and Lots 10,11, 12, 13, 14, 15, and 16 in Block 2 of Puget Sound Cooperative Colony's Subdivision of the Townsite of Port Angeles, all in the City of Port Angeles, Clallam County, Washington. Section 4. That the property specifically described in the preceding section lies between the termini and within the boundaries of said District and comprises all of the property :specially benefited by said improvement. That the nature of the improvement to be made is such that the special benefits conferred on such property are not fairly reflected by the use of the termini and zone method of assessment. That the special assessments to be levied to pay the cost of said improvement shall be spread over the property specially benefited in an even amount for each square foot thereof and without regard for the termini and zone method of assess- ment. That the spreading of the special assessment to be levied against the property specially benefited and to pay the cost of such •I improvement in an even amount for each square foot thereof will 'fairly reflect the special benefits conferred upon such property so , assessed. Section 5. Bonds bearing interest at the rate of not to ex- teed six per cent. (6 %) per annum, payable on or before twelve years • !from the date of their issue, shall be issued in payment of the cost and expense of said improvement, which bonds may be redeemed by the • collection of special assessments to be levied and assessed against the property within said District and specially benefited by said improvement, such assessments to be payable in 10 equal installments under the mode of "payment by bonds" as provided by law. Such bonds may be delivered to the contractors constructing such improve- ment in redemption of warrants issued on the special fund of such local improvement district hereby created on estimates of the City Engineer, or the City may at its election sell such bonds and make such redemption in cash or cash warrants. Section 6. This ordinance shall be in full force and effect five days after its passage and publication as provided by law. S f Attest: INTRODUCED January ,Z , 1953.
