HomeMy WebLinkAbout1302• ORDINANCE NO. 4O�G An Ordinance approving and confirming the assessments and assessment roll of Local Improvement District No. 161 created under Ordinance No. 1288 approved October 2, 1952, which ordered and provided for the improvement of certain streets and alleys in the City of Port Angeles by the construction and laying therein of certain trunk and lateral sanitary sewers, all in accordance with Improvement Resolution No. 161 and the plans and specifications adopted by the City Council of the City of Port Angeles, ordering the levy and collection of said assessments and creating a special fund for said District No. 161. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO ORDAIN as follows: Section 1. That the assessments and assessment roll of Local Improvement District No. 161 created by Ordinance No. 1288, approved October 2, 1952, which ordered and provided for the improve- ment of the following streets and alleys in the City of Port Angeles by the construction and laying therein of certain trunk and lateral sanitary sewers as follows, to -wit: the alley running through Blocks Two Hundred Fifty -two (252) and Two Hundred Fifty -three (253); the alley running through Blocks Two Hundred Forty -seven (247) and Two Hundred Forty -six (246) of the Townsite of Port Angeles; and Seventh Street; all from the Easterly margin of K Street to appropriate connections with a trunk sanitary sewer in H Street, by the construc- tion and laying therein of lateral sanitary sewers; H Street from its intersection with the alley running through Blocks Two Hundred Fifty - three (253) and Two Hundred Fifty -four (254) of the Townsite of Port Angeles to its intersection with the alley running through Blocks One Hundred Fifty -one ( 151) and One Hundred Fifty -two (152) of the Townsite of Port Angeles, by the construction and laying therein of a sanitary trunk sewer; the alley running through Block One Hundred Fifty -one (151) of the Townsite of Port Angeles from the Easterly margin of I Street to an appropriate connection with a trunk sewer in the intersection of such alley with H Street, by the construction and laying therein of a lateral sanitary sewer; the alley running through Block One Hundred. Fifty -two (152) of the Townsite of Port Angeles from a manhole in the intersection of such alley with G Street to an appropriate connection with a trunk sewer in H Street, by the con- struction and laying therein of a sanitary trunk sewer; the alley running through Blocks One Hundred Fifty (150), One Hundred Forty - nine (149) and One Hundred Forty -eight (148) of the Townsite of Port Angeles, and Block One (1) of Evans Subdivision of Suburban Lot No. 36 West of M Street in the Townsite of Port Angeles from the Westerly margin of I Street to an appropriate connection with a trunk sewer in Evans Street, by the construction and laying therein of a lateral sanitary sewer; Sixth Street from the Westerly margin of I Street to an appropriate connection with a trunk sewer in Evans Street, by the construction and laying therein of a lateral sanitary sewer; the alley running through Blocks One Hundred Twenty -eight (128), One Hundred Forty -two (142) and One Hundred Forty -three (143) of the Townsite of Port Angeles and Block Two (2) of Aldwells Subdivision of Suburban Lot No. 35 West of M Street in the Townsite of Port Angeles from the Westerly margin of I Street to an appropriate connection with a trunk sewer in Evans Street, by the construction and laying therein of a lateral sanitary sewer; the alley running through Blocks One Hundred Twenty -nine (129), One Hundred Forty -one (141) and One Hundred Forty - fie (145) of the Townsite of Port Angeles and Block One (1) of Aldwells Subdivision of Suburban Lot No. 35 West of M Street in the Townsite of Port Angeles from the Westerly margin of I Street, as the same now runs through said Block One Hundred Twenty -nine (129), to an appropriate connection with a trunk sewer in Evans Street, by the construction and laying of a lateral sanitary sewer therein; Fourth Street itrom the • Easterly margin of I Street, as the same now runs through Block One Hundred Twenty -nine (129) of the Townsite of Port Angeles, to an appropriate connection with a trunk sewer in Evans Street, by the con- struction and laying therein of a lateral sanitary sewer; Evans Street from the end of an existing trunk sewer in the intersection of said street with Sixth Street South to a manhole in the intersection of Evans Street with the alley running through Block One (1) of Evans Subdivision of Suburban Lot No. 36 West of M Street in the Townsite of Port Angeles, by the construction and laying therein of a sanitary trunk sewer, including all necessary labor and material for the com- plete laying, construction and installation of all such trunk and lateral sanitary sewers, with all necessary wyes, connections and manholes and all within the City of Port Angeles, Washington, all in accordance with said Resolution No. 161 and the plans and specifications /ro -a' prepared by the City Engineer anoyadopted by the City Council sitting as a Board of Equalization thereon on the 16th day of April, 1953, according to regular notice thereof and according to law, and ordinances of the City of Port Angeles, and in accordance with the findings and order of the City Council as a Board of Equalization at said meeting in said City, be and the same are hereby, in all respects, approved and confirmed in all things. Section 2. That each lot, tract or parcel of land shown upon said assessment roll is hereby declared to be especially benefitted by . said improvement in at least the amount charged against the same, and that the assessment appearing against the same is in proportion to the several assessments appearing on said assessment roll, and there is hereby levied and assessed against each said lot, tract, or parcel of land appearing on said roll, the amount actually charged and assessed against the same. Section 3. That there is hereby created and established for said Local Improvement District No. 161 a special fund to be known and designated as Local Improvement District No. 161 for the uses and purposes provided by law and the ordinances of the City. Section 4. That said assessments or any of them may be paid without interest at any time within thirty (30) days from the date of the first publication of the City Treasurer's notice to pay the same as required by law to be given, and all assessments not paid within said thirty (30) day period shall thereafter be paid in ten equal annual installments with interest thereon at the rate of five (5) per cent per annum. Section 5. Assessments or installments thereof, when delinquent shall in addition to the interest bear a penalty at the rate of five (5) per cent for such delinquency. Section 6. That immediately upon the taking effect of this ordinance said assessment roll shall be turned over to the City Treasurer for the collection of said first annual installment, who will thereon proceed to collect the same according to law. Section 7. This ordinance shall be in full force and effect upon its passage by the City Council, signed by the Mayor, from and after five (5) days of its publication as provided by law.
