HomeMy WebLinkAbout1325• ORDINANCE N0. 1023' AN ORDINANCE of the City of Port Angeles providing for the improvement of certain streets and alleys in the City of Port Angeles by the construction of curbs, gutters and such storm sewers and catch basins as may be required and incidental thereto, all in accord with Improvement Resolution No. 165, creating a local improvement district for such improvement, and providing that payment for said improvement be made by special assessment on the property in said district specially benefited, payable by the mode of payment by bonds, all in accord with maps, plans and specifications prepared by the City Engineer and approved by the City Council; WHEREAS, Improvement Resolution No. 165 was adopted by the City Council of the City of Port Angeles on the 7th day of January, 1954, declaring the intention of the improvement herein- after described and fixing a time for hearing thereon; and WHEREAS, said resolution has been duly published and due notice of said hearing has been given as required by law, and a hearing thereon was held as provided in said notice, and no written protests against said improvement were filed, and all oral protests were heard, and after due consideration the Council of the City of Port Angeles decided by unanimous vote that it was necessary for the protection of the public health and safety to order the construction and installation of such improvement; now, therefore, TEE CITY COUNCIL OF '1 E CITY OF PORT ANGELES DO ORDAIN as follows: Section 1. That the following streets and portions thereof of the City of Port Angeles be improved by the construc- tion of curbs, gutters and such storm sewers and catch basins as may be required and incidental thereto, to wit: Eighth Street • • from the Westerly approach of Tumwater Bridge to the Easterly margin of "E" Street, and "C" Street from the Southerly margin of Eighth Street to Ninth Street, by the construction of curbs and gutters on the North and South sides of Eighth Street and the i East and West sides of "0" Street between the termini of said pro- posed improvement, together with the construction of such storm q sewers and catch basins as may be required and incidental there- to, together with all necessary labor and material for the com- plete construction and laying thereof. Section 2. That the cost and expense of such improve - ment shall be borne by and assessed against the properties situ- ated and included within the boundaries of the district herein- after created and described. That the City of Port Angeles shall not be liable in any manner for any part of the cost and expense I of said improvement, except in so far as said City is made liable by virtue of the statutes of the State of Washington in such cases made and provided, particularly the statutes providing for a local improvement guaranty fund. Section 3. That there is hereby created a local improve- ment district to be called Local Improvement District No. 165, which includes all of the property specially benefited by such improvement, which territory is particularly described and bounded as follows, to wit: Commencing at the intersection of the South line of the alley in Block Two Hundred Thirty -nine (239) and "A" Street; thence Westerly along the South line of said alley through Blocks Two Hundred Thirty -nine (239), Two Hundred Forty (240), Two Hundred Forty -one (241) and Two Hundred Forty -two (242) to the East line of "E" Street; thence Southerly along the East line of "E" Street to the North line of the alley in Block Two Hundred Fifty -seven (257); thence Easterly along the North line of said alley to the West line of Lot Five (5) in Block Two Hundred Fifty- ' seven (257); thence Northerly along the Vest line of said Lot Five (5) to Eighth Street; thence Easterly to the Northeast (NE) corner of said Lot Five (5); thence Southerly along the Easterly line of said Lot Five (5) to the Northerly line of the alley in said Block Two Hundred Fifty -seven (257); thence Easterly along the Northerly line of said alley through Blocks Two Hundred Fifty- seven (257) and Two Hundred Fifty -eight (258) to the Westerly line of Lot Sixteen (16) in said Block Two Hundred Fifty -eight (258); I thence Southerly along the Westerly line of said Lot Sixteen (16) to Ninth Street; thence Easterly along the Northerly line of Ninth Street to the Easterly line of Lot Fifteen (15) in Block Two Hundred Fifty -nine (259); thence Northerly along the Easterly line of Lot Fifteen (15) to the Northerly line of the alley in said Block Two Hundred Fifty -nine (259); thence Easterly along the Northerly line of said alley through Blocks Two Hundred Fifty - nine (259) and Two Hundred Sixty (260) to the Westerly line of "A" Street; thence Northerly along the Westerly line of "A" Street to the point of beginning and containing the South Half (Si) of Blocks Two Hundred Thirty -nine (239), Two Hundred Forty (240), Two Hundred Forty -one (241) and Two Hundred Forty -two (242) and the North Half (N2) of Blocks Two Hundred Fifty -seven (257), Two Hundred Fifty -eight (258), Two Hundred Fifty -nine (259) and Two Hundred Sixty (260), and Lots Sixteen (16) to Twenty (20), inclu- sive, in Block Two Hundred Fifty -eight (258), and Lots Eleven (11) to Fifteen (15), inclusive, in Block Two Hundred Fifty -nine (259), all in the City of Port Angeles, Clallam County, Washington. Section 4. That the property hereinbefore described lies between the termini and within the boundaries of said dis- trict, and comprises all of the property specially benefited by said improvement. That special assessments shall be levied to pay the cost of said improvement in accordance with the zone and termini method of assessment in accordance with law. li to exceed Section 5. Bonds bearing interest at the rate of not per cent. per annum, payable on or before twelve •(12) year from.the date of their issue shall be issued in payment of the cost and expense of said improvement, which bonds may be redeemed by the collection of special assessments to be levied and assessed against the property within said district and specially benefited by said improvement, such assessments to be payable in ten (10) equal installments under the mode of "payment by bonds" as provided by law, such bonds may be delivered to the contractors constructing such improvement in redemption of warrants issued on the special fund of said local improvement dis- trict hereby created on estimates of the City Engineer, or the City may at its election sell such bonds and make such redemption in cash or cash warrants. Section 6. This ordinance shall be in full force and effect five (5) days after its passage and publication as pro- vi de d by law. INTRODUCED April /5- -, 1954.
