HomeMy WebLinkAbout1338RT HF 10 -19 -54 6 ORDINANCE NO. /9i2 AN ORDINANCE of the City of Port Angeles, Washington, providing for the improvement of a highway, streets, an alley and drive within the city by the filling, clearing, draining, grading, ballasting and paving thereof and by doing all other work necessary in connection therewith and incidental thereto, pursuant to Resolution No. 167 of the city, passed and approved September 16, 1954, creating an enlarged local improvement district therefor and providing that the payment for said improve- ments be made by special assessments upon the property in said district payable by the mode of "payment by bonds." WHEREAS, on September 16, 1954, the Council of the City of Port Angeles, Washington adopted its Resolution No. 167 declaring its intention to order the improvement of a certain highway, alley and drive and certain streets within the city by filling, clearing, drain- ing, grading, ballasting and paving, together with all necessary appurtenances thereto and by doing all work necessary in connection therewith, and fixing a time for the hearing thereon; and WHEREAS, said resolution was duly published in the manner required by law and notice of said hearing was duly given as required by law; and WHEREAS, said hearing was held on October 20, 1954, as pro- vided in said notice, and after hearing all protests a discussion of the same and of said improvements was held, and after due consideration Is of the same the Council determined to order the construction of said improvements as set forth in said Resolution No. 167 and determined that an enlarged local improvement district be created therefor with the boundaries as set forth in said resolution and as herein provided; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Port Angeles, Washington, as follows: Section 1. The area described in Section 2 hereof shall be improved by the construction of the following described highway, streets, alley and drive, together with all necessary appurtenances thereto and by doing all other work as may be necessary in connection therewith, all in accordance with maps, plans and specifications prepared by the city's engineer and now on file with the City Clerk: A. Clearing, draining, grading, ballasting and paving of a highway up Tumwater Canyon between Cedar and Tumwater Streets from Marine Drive to Lauridsen Boulevard and "A" Street, thence westerly on Lauridsen Boulevard to "C" Street, with a 24 -foot wide asphaltic concrete pavement. B. Grading, draining, ballasting and paving of Marine Drive from a point 200 feet east of its intersection with "A" Street to Edit Hook Road with 8 -inch cement concrete pavement 20 feet to 24 feet wide, with cement concrete curbs and gutters where necessary, with a 9 -foot wide asphalt parking strip on the southerly side of said paving, with the construction of a precast concrete bridge 28 feet wide and with a 4 -foot wide walk across the lagoon waterway. C. Filling, draining, grading and ballasting of West Front Street produced westerly from Oak Street to its intersection with Valley Street or to a point approximately 300 feet westerly of the W margin of Cherry Street; Valley Street from West First Street to West Front Street as produced; Cherry Street from West First Street to West Front Street as produced, with 50 -foot wide asphalt pavement; and the alley between Front and First Streets extending from Oak Street to Valley Street. Section 2. That there be and is hereby established an enlarged local improvement district of the city to be known as "Local Improvement District No. 167," which said district shall 2. include all the property within the following described area: Beginning at a point on the Northerly Margin of Lauridsen Boulevard and the Easterly Margin of "F" Street, which is the Southwest corner of Block Four Hundred Fifty -Eight (458), Townsite; thence Northerly along the said Easterly Margin of "F" Street to the Northerly Margin of Twelfth (12th) Street, thence Westerly along the said Northerly Margin of Twelfth (12th) Street to the Westerly line of Lot Sixteen (16), Block Three Hundred Fifty -Seven (357), Townsite; thence Northerly along said Westerly lot line produced Northerly to the Northerly Margin of the alley between Tenth (10th) and Eleventh (11th) Streets; thence Westerly along said Northerly Margin of the said alley between Tenth (10th) and Eleventh (11th) Streets to the Easterly Margin of "L" Street; thence Northerly along the said Easterly line of "L" Street to the Northerly Margin of Tenth (10th) Street; thence Westerly along the said Northerly Margin of Tenth (10th) Street to a point near the center of Suburban Lot Forty -Eight (48) which is two hundred fifty (250) feet Easterly from the Easterly Margin of "N" Street; thence Northerly through Suburban Lot Forty-Eight (48) and the center of Blocks Two (2) and One (1) of the Subdivision of Suburban Lot Thirty -Eight (38) to the intersection with the Southerly line of the C. M. St. P. & P. R. R. Right of Way line; thence Northeasterly along the said Railroad Right of Way line to the intersection of the Easterly line of Suburban Lot Thirty- Three; thence Northerly along the said Easterly line of Suburban Lot Thirty -Three (33) and along the Easterly line of Suburban Lot Thirty (30) to the Strait of Juan de Fuca; thence Northeasterly along the outer shore line of Ediz Hook for a distance of approximately three thousand six hundred and forty (3640) feet; thence on the approximate course of S 450 55' E. to an intersection with and at right angles to the Inner Harbor Line; thence Southerly and Easterly along said Inner Harbor line to the Northwest corner of Block Nine (9) which point is on the Easterly Margin of "A" Street; thence Northeasterly a distance of 370 feet along the Easterly Margin of "A" Street; thence in a Southeasterly direction on the extension of a line fifteen (15) feet Northerly of and parallel to the C. M. St. P. & P. R. R. main line tangent between Oak and Cedar Streets to the angle point of the Inner Harbor Line at the Northwest corner of the intersection of Railroad Avenue and Oak Street; thence Northerly along the Westerly Margin of Oak Street produced Northerly one hundred fifty (150) feet; thence Southeasterly across the Harbor area parallel to Railroad Avenue, to the Westerly Margin of Chase Street; thence Southeasterly along the Inner Harbor Line to the Westerly_ Margin of vacated Liberty Street ex- tended Northerly; thence Southwesterly along said extended Westerly Margin of Liberty Street to the Southerly Margin of vacated Railroad Avenue; thence Easterly along the Southerly Margin of vacated Railroad Avenue to its junction with the East City Limits Line; thence South along the East City Limits Line to the Northerly Right of Way Line 3 e- f of the C. M. St. P. & P. R. R. Co.; thence Westerly along said Right of Way Line to the Easterly Margin of vacated Liberty Street; thence Southerly along the said margin of vacated Liberty Street to the line designated as the Westerly brink of Ennis Creek Valley, continuing Southerly along the Westerly brink of Ennis Creek Valley and Whites Creek Valley to the Northerly Margin of Lauridsen Boulevard, East of Walcott Street; thence Westerly along said Northerly Margin of Lauridsen Boulevard to the place of beginning, excepting certain lots and portions lying in Tumwater Creek Valley, Valley Creek Valley and Peabody Creek Valley. Section 3. The entire cost and expense of said improvements, including all necessary and incidental expenses, shall be borne by and assessed against the property included in the local improvement district hereinbefore created. The City of Port Angeles shall not be liable in any manner for any portion of the cost and expense of said improvements. Approximately 18% of such cost shall be charged to the property specially benefited by said improvements lying between the termini of the proposed improvements and extending back from the marginal lines thereof to the middle of each block (or at least 90 feet back) on each side thereof. Such assessments shall be computed by the zone and termini method except in a few instances where, due to topographical conditions, such method will not truly reflect the benefits received by such properties from said improvements. Ap- proximately 82% of the cost of such improvements shall be distributed over and assessed against all of the properties within the district in accordance with spectral benefits derived from such improvements, without regard to the zone and termini method of computing assessments. Section 4. Bonds of said local improvement district bearing interest at the rate of not to exceed 6% per annum payable on or be- fore twelve years from date of issuance shall be issued in payment of the cost and expense of the improvements provided for herein, which bonds shall be redeemed by the collection of special assessments to 4. • be levied and assessed upon the property within the district payable in ten equal annual installments with interest at a rate of not to exceed 6% per annum under the mode of "payment by bonds" as defined by law and ordinances of the City of Port Angeles. Any assessments or installments thereof when delinquent and the interest due thereon shall bear a penalty of % of the total amount thereof from the date of such delinquency. That there be and is hereby created a fund of the city to be known as "Local Improvement District No. 167 Fund." Warrants bear- ing interest at a rate of not to exceed 6% per annum shall be drawn on said Fund, based on estimates of the city's engineer, in payment of the cost of construction of said improvements and all costs incidental thereto. The money received from the sale of said warrants shall be placed in Local Improvement District No. 167 Construction Fund of the city to be hereafter created, and shall be used to pay all of said costs. Said bonds shall be delivered to the owner and holder of said Local Improvement District No. 167 Fund warrants in redemption of the same. The rate of interest to be borne by said warrants, bonds, and installments of said assessments shall be as hereafter fixed by resolution of the City Council. Section 5. This ordinance shall become effective five days from and after its passage, approval and publication as required by law.
