HomeMy WebLinkAbout1369RT HF 5 -16 -56 6 ORDINANCE NO. /c4b,67 AN ORDINANCE of the City of Port Angeles, Washington, providing for the improvement of a certain area within the city by the construction and installation of trunk and lateral storm sewers, the improvement of certain streets by grading, ballasting, con- structing curbs and gutters where necessary and paving, and doing all work necessary in connection therewith and incidental thereto, pursuant to Resolution No. 171 of the city, passed and approved April 19, 1956; creating an enlarged local improvement district therefor, and providing that the payment for said improvements be made by special assessments upon the property in said district payable by the mode of "payment by bonds." • WHEREAS, on April 19, 1956, the Council of the City of Port Angeles, Washington, adopted its Resolution No. 171, declaring its intention to order the improvement of a certain area within the city by the construction and installation of certain trunk and lateral storm sewers, by the grading, ballasting, constructing of curbs and gutters where necessary and paving of certain streets, and by doing all work necessary in connection therewith and incidental thereto, and fixing a time for the hearing on such resolution; and WHEREAS, such resolution was duly published in the manner the required by law and notice of said hearing was duly given to/owners or reputed owners of all lots, tracts and parcels of land or other property to be specially benefited by the proposed improvement as shown on the rolls of the County Treasurer directed to the address shown thereon; and WHEREAS, said hearing was held on May 7, 1956 as provided in said resolution and notice, and after hearing all protests a discussion of the same and of said proposed improvements was held, and after due consideration of the same the Council determined to order the construction of said improvements as set forth and described in said Resolution No. 171 and determined that an enlarged local improvement district be created therefor with the boundaries as set forth in said resolution and as herein provided; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Port Angeles, Washington, as follows: Section 1. The area described in Section 2 hereof shall be improved by the construction and installation of the following described improvements: A. Trunk Sewers 1. An 18" storm sewer on 4th Street from Peabody Street to Chase Street, thence by a 15" storm sewer on Chase Street to 8th Street. 2. A 24" storm sewer on 3rd Street from Cherry Street to Laurel Street, thence by an 18" storm sewer on Laurel Street to 4th Street, thence by a 15" storm sewer on Laurel Street from 4th Street to 9th Street, thence by a 10" storm sewer on 9th Street to Cherry Street. B. Lateral Sewers An 8" storm sewer on Laurel Street from 2nd Street to 3rd Street. A 6" storm drain on either side of 3rd Street from Laurel Street to Lincoln Street. Also a 6" storm sewer on 3rd Street from the easterly brink of Valley Creek Gulch to Cherry Street. An 8" storm sewer on Laurel Street from 9th Street to 14th Street. An 8" storm sewer on Oak Street from 2nd Street to 3rd Street, and also an 8" storm sewer on Oak Street from 3rd Street to 7th Street. 2. A 10" storm sewer on 9th Street from Laurel Street to Cherry Street. A 10" storm sewer on Oak Street from 9th Street to 10th Street. A 6" storm drain on 9th Street from Lincoln Street to Laurel Street. An 8" storm sewer on Oak Street from 10th Street to Lauridsen Boulevard. A 10" storm sewer on Cherry Street from 9th Street to loth Street. An 8" storm sewer on Cherry Street from 10th Street to 15th Street. Lincoln Street A 6" storm drain on 13th Street from LauvcW6enclioqxlmmmack to Laurel Street. A 6" storm sewer on 14th Street from the easterly brink of Valley Creek Gulch to Cherry Street. C. Street Improvements 1. The following described streets shall be improved by grading, ballasting, constructing curbs and gutters where necessary and paving with a compressed mat of asphalt pavement 2 inches thick and to a width of approximately forty feet: 2nd Street from Lincoln Street to Oak Street 3rd Street from Lincoln Street to the easterly brink of Valley Creek Gulch 4th, 5th, 6th and 7th Streets from Peabody Street to the easterly brink of Valley Creek Gulch Chase Street from 8th Street to 4th Street Laurel Street from 8th Street to the alley between 1st Street and 2nd Street Oak Street from 8th Street to 2nd Street Bluff. 3. 2. The following described streets shall be improved by grading, ballasting, constructing curbs and gutters where necessary and paving with a compressed mat of asphalt pavement 2 inches thick and to a width of approximately thirty feet: 9th, 10th, llth, 12th and 13th Streets from Lincoln Street to the easterly brink of Valley Creek Gulch loth and 15th Streets from the State Olympic Highway No. 101 to the easterly brink of Valley Creek Gulch. 3. The following described streets shall be improved by resurfacing with a compressed mat of asphalt pavement 1 inch thick: Cherry, Oak and Laurel Streets from 8th Street to Lauridsen Boulevard together with all necessary appurtenances thereto, and by doing all work as may be necessary in connection therewith and incidental thereto, all in accordance with maps, plans and specifications pre- pared by the city's engineer and now on file with the City Clerk, which maps, plans and specifications are hereby adopted as those necessary and required for these improvements. Section 2. That there be and is hereby established an enlarged local improvement district of the city to be known as "Local Improvement District No. 171," which said district shall include all the property within the following described area: Beginning at the northeast corner of Lot 18, Block 67, J. H. Taylor's Subdivision in the City of Port Angeles, which is on the westerly margin of Peabody Street and the alley between 3rd Street and 4th Street; thence along the southerly line of the alley between 3rd Street and 4th Street to the northeast corner of Lot 15 of said Block 67, J. H. Taylor's Subdivision; thence northerly 10 feet to the center of the said alley between 3rd Street and 4th Street; thence westerly along said alley centerline to the westerly margin of Lincoln Street; thence northerly, along the said Westerly margin of Lincoln Street to the southerly line of the alley between 1st Street and 2nd Street; thence westerly 4. along said southerly alley line to the brink of the hill at Lot 15, Block 32, Townsite; thence southwesterly along the said brink of the hill to the northwest corner of Lot 5, Block 52, Townsite; thence southerly along the westerly line of said Lot 5, Block 52, Townsite, to the northwest corner of Lot 16, Block 52, Townsite; thence westerly along the southerly line of the alley between 2nd Street and 3rd Street to the westerly margin of Cherry Street; thence southerly along the easterly brink of Valley Creek Hill to the northerly margin of Lauridsen Boulevard; thence southeasterly along the said northerly line of Lauridsen Boulevard to the easterly point of Block 386 1/2 Townsite; thence, northeasterly along the westerly right -of -way line of the State of Washington Highway No. 101, through Block 380 Townsite; thence northeasterly to the southeast corner of Lot 18, Block 38 Townsite; thence northerly along the westerly margin of Lincoln Street to the southerly margin of the alley between 7th Street and 8th Street; thence easterly along the southerly margin of the alley between said 7th Street and 8th Street to the center of Lot 14., Block 230 Townsite; thence southerly along the center line of said Lot 14, Block 230 Townsite to the northerly margin of 8th Street; thence easterly along the northerly margin of said 8th Street to the center line of Lot 14, Block 229 Townsite; thence northerly along the center line of said Lot 14, Block 229 Townsite, to the alley between 7th Street and 8th Street, thence easterly along said alley to the westerly margin of Peabody Street; thence northerly along the westerly margin of said Peabody Street to the place of beginning. • Section 3. The entire cost and expense of said improvements, including all necessary expenses incidental thereto, shall be borne by and assessed against the property included in the local improvement district hereinabove created. The City of Port Angeles shall not be liable in any manner for any portion of the cost and expense of said improvements. Approximately 73% of such entire cost shall be charged to the properties specially benefited by said grading, ballasting, con- struction of curbs and gutters where necessary and paving improvements lying between the termini of such proposed improvements and extending back from the marginal lines thereof to the middle of each block (or at least 90 feet back) on each side thereof. Except as hereinafter 5. provided in this section, such assessments shall be computed by the zone and termini method. Approximately 27% of such entire cost shall be charged to the property specially benefited by such trunk and lateral storm sewer improvements, and shall be distributed over and assessed against all of the properties within the district in accordance with special benefits derived from such improvements without regard to the zone and termini method of computing assessments. Those lots or portions of lots within the above described boundaries extending back from Peabody Street and Cherry Street north of 8th Street to the center of the blocks abutting thereon or to the easterly brink of Valley Creek Gulch shall not be assessed for any of the storm sewer improvements described herein for the reason that such properties have already been improved and specially benefited by storm sewers previously installed. Section 4. Bonds of said local improvement district bearing interest at the rate of not to exceed 6% per annum, payable on or be- fore twelve years from date of issuance, shall be issued in payment of the cost and expense of the improvements provided for herein, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within the district payable in ten equal installments with interest at a rate of not to exceed 6% per annum under the mode of "payment by bonds" as defined by law and ordinances of the City of Port Angeles. Any assessments or installments thereof when delinquent, and the interest due thereon, shall bear a penalty of 5 % of the total amount thereof from the date of such delinquency. That there be and is hereby created a fund of the city to be known as "Local Improvement District No. 171 Fund." Warrants bearing interest at a rate of not to exceed 6% per annum shall be 6. • drawn on said Fund based on estimates of the city's engineer in payment of the cost of construction of said improvements and all costs incidental thereto. The money received from the sale of said warrants shall be placed in Local Improvement District No. 171 Construction Fund of the city, to be hereafter created, and shall be used to pay all of such costs. Said bonds shall be delivered to the owner and holder of said Local Improvement District No. 171 Fund warrants in redemption of the same. The rate of interest to be borne by said warrants, bonds and installments of said assessments shall be as hereafter fixed by resolution of the City Council. Section 5. This ordinance shall be effective five days from and after its passage, approval and publication as required bylaw. PASSED by the Council of the City of Port Angeles, Wash- ington and approved by its Mayor at an adjourned regular meeting of which notice was given to the press and radio as required by law, said adjourned regular meeting held this 24th day of May, 1956.
