HomeMy WebLinkAbout1370• • ORDINANCE NO. / 7' AN ORDINANCE of the City of Port Angeles, Washington providing for the improvement of a certain area within the City of Port Angeles by the construction and installation of lateral, storm and sanitary sewers therein, and installation of a combina- tion storm and sanitary lateral sewer including service to each property line, and the ballasting and paving of the alley in said district, and by doing all work necessary in connection therewith and incidental thereto pursuant to Resolution No. 172 of the City passed and approved on the 19th day of April, 1956 creating a Local Improvement District therefor, and providing that the payment for said improvement be made by special assess- ments on the property in said district, payable by the mode of payment by bonds. WHEREAS, on the 19th day of April, 1956 the Council of the City of Port Angeles adopted its Resolution No. 172 declaring its intention to order the improvement of a certain area within the City of Port Angeles by the construction and installation of certain trunk and lateral storm sewers, by the grading, ballasting and paving of the alley through said district, together with all necessary appurtenances to such improvement and all work necessary in connection therewith, and WHEREAS, such resolution was duly published in the manner required by law, and notice of said hearing was duly given to the owners or reputed owners of all lots, tracts and parcels of lend or other property to be specially benefited by the proposed improvement as shown on the rolls of the County Treasurer and directed to the addresses shown thereon, and WHEREAS, said hearing was regularly held in accordance with said resolution and notice on the 18th day of May, 1956 in the Council Chamber of the City Council and after hearing all protests a discussion of the same and of said improvement was held and after due consideration of the same the Council duly determined to order the construction of said improvement as set forth and des- cribed in said Resolution No. 172 and determined that a Local Improvement District be created therefor with the boundaries and including the properties as set forth in said resolution and as herein provided; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO ORDAIN as follows: Section 1: That the area hereinafter described in Section 2 shall be improved by the construction and installation of the following described improvements: A. Combination Lateral, Sanitary and Storm Sewers. (1). An 8" storm and sanitary sewer in the alleys running East and West through Block 33 and 34, including necessary Wyes and services to the property line of each lot and necessary lamp holes and man holes. (2). A 10" sewer line from the alley through Blocks 33 and 34 where said alley meets approximately in the center of Cherry Street thence continuing northerly along said Cherry Street to an existing man hole at the intersection of Cherry Street and First Street, including the installation of a pump house containing a sewage lift pump along with all electrical installation for the operation of this pump. B. Alley Improvement (1). The alley through Blocks 33 and 34 to be improved by grading, ballasting and paving with a three inch (3 ") mat of type F Asphaltic concrete for a distance of approximately 1,070 feet. Section 2: That there be, and is hereby established a Local Improvement District of the City of Port Angeles to be known as Local Improvement District No. 172, which district shall include all of the property within the following described area: Beginning on the northwest corner of Lot 10, Block 34, Townsite of Port Angeles, which is on the southerly margin of First and Valley Streets; thence along the south line of First Street to • the northeast corner of Lot 1, Block 33; thence southerly along the westerly line of Oak Street to the southeast corner of Lot 20 in said Block 33; thence westerly along the south boundary of Block 33 and 34 to the southwest corner of Lot 11, in Block 34; thence northerly along the westerly boundary of said Block 31. to the place of beginning. Section 3: That the entire cost and expense of said improvements including all necessary expenses incidental thereto shall be borne by and assessed against the property included in the local improvement district hereinabove created. The City of Port Angeles shall not be liable in any manner for any portion of the cost and expense of saidimprovement and the entire cost shall be charged to the properties specially benefitted by said grading, ballasting, installation of sewers and other work and abutting upon such improvement in accordance with the zone and termini method as established by the statutes and laws of the State of Washington. Section 4: Bonds of said local improvement district bearing interest at the rate of not to exceed 6% per annum, payable on or before twelve years from date of issuance, shall be issued in payment of the cost and expense of the improvements provided for herein, which bonds shall be redeemed by the collec- tion of special assessments to be levied and assessed upon the property within the district payable in ten equal installments with interest at a rate of not to exceed 6% per annum under the mode of "payment by bonds" as defined by law and ordinances of the City of Port Angeles. Any assessments or installments thereof when delinquent, and the interest due thereon, shall bear a penalty of 5% of the total amount thereof from the date of such delinquency. That there be and is hereby created a fund of the city to be known as "Local Improvement District No. 172 Fluid." Warrants • bearing interest at a rate of not to exceed 6% per annum shall be drawn on said Fund based on estimates of the city's engineer in payment of the cost of construction of said improvements and all costs incidental thereto. The money received from the sale of said warrants shall be placed in Local Improvement District No. 172 Construction Fund of the city, to be hereafter created, and shall be used to pay all of such costs. Said bonds shall be delivered to the owner and holder of said Local Improvement District No. 172 Fund warrants in redemption of the same. The rate of interest to be borne by said warrants, bonds and installments of said assessments shall be as hereafter fixed by resolution of the City Council. Section 5: This ordinance shall be effective five days from and after its passage, approval and publication as required by law. PASSED by the Council of the City of Port Angeles, Washington and approved by its Mayor at an,adjourned regular meeting of which notice was, given to the press and radio as required by law, said adjourned regular meeting held this 24th day of May, 1956.
