HomeMy WebLinkAbout1373• L ORDINANCE NO. /76$ AN ORDINANCE of the City of Port Angeles, Washington providing for the improvement of a certain area within the City of Port Angeles by the construction and installation of lateral and sanitary sewers therein, including wyes to serve each lot, and by doing all work necessary in connection therewith and incidental thereto pursuant to Resolution No. 173 of the City of Port Angeles passed and approved on the 7th day of June, 1956, and providing therewith payment of said improvement be made by special assessments on the property in said district, payable by the mode of payment by bonds, and setting forth the property in said district. WHEREAS, on the 7th day of June, 1956 the City of Port Angeles adopted its resolution No. 173 declaring its intention to order the improvement of a certain area within the City of Part Angeles by the construction and installation of certain trunk and lateral sewers, together with all necessary appurtenances to said improvement and all work necessary in connection therewith, and WHEREAS, by an examination and survey of said area by the Olympic Health District it was found that the same was a critical area and that improper sewage disposal systems are now within said district and that in order to improve facilities and for the protection and health of the inhabitants of said district it is necessary that the properties originally described and contained in said local improvement district and particularly described as follows, to -wit: Beginning at the intersection of the alley between Sixth and Seventh Streets on "G1Q Street, running thence Southerly to Eleventh Street, thence Easterly to TF!! Street, thence Southerly to the alley between Eleventh and Twelfth Streets, thence down the alley in Block 355 to the Easterly end of said Block, thence Northerly on °!E'{ Street to 8th Street, thence Westerly on 8th Street to "G!! Street and including the properties in Blocks 255, 256, 303, 304, 315, 316 and the North Half of Blocks 355 and 356 be contained in and continued in said Local Improvement District No. 173, and 1 • WHEREAS, said resolution was duly published in the manner required by law, and notice of said hearing was duly given to the owners or reputed owners of all lots, tracts or parcels of land or other property specially benefitted by the proposed . improvement as shown by the rolls of the County Treasurer and directed to the addresses as shown thereon, and WHEREAS, said hearing was regularly held in accordance with said resolution and notice in the Council Chamber of the City Council and after hearing all protests and a discussion of the same and the examination of the assessment roll and after due consideration of the same the Council duly determined that the construction of said sewer system covering the property herein described and determined that a Local Improvement District be created therefor with the boundaries and including the properties as set forth herein; now, therefore, THECITY COUNCIL OF THE CITY OF POPT ANGFTRS DO ORDAIN as follows: Section 1: That the area hereinafter described in Section 2 shall be improved by the construction and installation of the following described improvements: A. Sanitary Sewers (1) A ten (10) inch sanitary sewer commencing at the alley through Blocks 152 and 153 on "G" Street; thence running southerly on "G" Street to its intersection with the alley through Blocks 254 and 255. (2) An eight (8) inch sanitary sewer from the alley through Blocks 254 and 255 on "G" Street, contin- uing northerly on "G" Street to the northerly boundary of Eleventh Street. (3) Lateral sanitary sewers on the South side of Eighth Street from "G" Street to "E" Street; and, - 2- through the alley in Blocks 255 and 256; and, on the South side of Ninth Street from "G" Street to "F" Street; and through the alley in Blocks 304 and 303; and, on the South side of Tenth Street from "G" Street to "E" Street; and, through the alley in Blocks 315 and 316; and, on the South side of Eleventh Street from "G" Street to "F" Street and continuing southerly on "F" Street to the alley through Blocks 355 and continuing through the alley in said Block 355. (4) Including all manholes, lampholes, wyes and appurtenances all in accord with the plans and specifications originally prepared by the City Engineer. Section 2: That there be, and is hereby established, a Local Improvement District of the City of Port Angeles to be known as Local Improvement ]district No. 173, which district shall include all the property within the following described area and consisting of all of Blocks 255, 256, 303, 304, 315, 316, and the North Half of Blocks 355 and 356. Section 3: That the entire cost and expense of said improvements including all necessary expenses incidental thereto shall be borne by and assessed against the property included in the local improvement district hereinabove created. The City of Port Angeles shall not be liable in any manner for any portion of the cost and expense of said improvement and the entire cost shall be charged to the properties specially benefitted by said installation of sewers and other work and abutting upon such improvement in accordance with the zone and termini method as established by the statutes and laws of the State of Washington. Section 4: Bonds of said local improvement district bear- ing interest at the rate of not to exceed 6% per annum, payable on or before twelve years from date of issuance, shall be issued in payment of the cost and expense of the improvements provided for herein, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within the district, payable in ten equal installments with interest at a rate of not to exceed 6% per annum under the mode of "payment by bonds" as defined by law and ordinances of the City of Part Angeles. Any assessments or installments thereof when delinquent, and the interest due thereon, shall bear a penalty of 5% of the total amount thereof from the date of such delinquency. That there be, and is hereby created, a fund of the city to be known as "Local Improvement District No. 173 Fund." Warrants bearing interest at a rate of not to exceed 6% per annum shall be drawn on said Fund based on estimates of the city's enginner in payment of the cost of construction of said improvements and all costs incidental thereto. The money received from the sale of said warrants shall be placed in Local Improvement District No. 173 Construction Fund of the city, to be heareafter created, and shall be used to pay all of such costs. Said bonds shall be delivered to the owner and holder of said Local Improvement District No. 173 Fund warrants in redemption of the same. The rate of interest to be borne by said warrants, bonds and installments of said assessments shall be as hereafter fixed by resolution of the City Council. Section 5: The City Council of the City of Port Angeles do hereby specifically ordain that the construction of said sewers in the area is necessary for the public health of said area and for the health and sanitation of the district and the inhabitants thereof. Section 6: This ordinance shall be effective five days from and after its passage, approval and publication as required by law. • • PASSED by the Council of the City of Port Angeles, Wash- ington and approved by its Mayor at a regular meeting held this 19th day of July, 1956.
