HomeMy WebLinkAbout1385• • ORDINANCE NO. 1 J 8 5 AN ORDINANCE of the City of Port Angeles, Washington providing for the improvement of a certain area within the city by the construction and installation of trunk, lateral and sub- sewers therein, including all Wyes, man holes and by doing all work necessary in connection therewith and incidental thereto pursuant to Improvement Resolution No. 174 of the City of Port Angeles; creating a local improvement district therefor, and providing that the payment of the cost of said improvement be made by special assessments upon the property of said district, payable by the mode of "payment by bonds." W EREAS, on the 7th day of February, 1957 the Council of the City of Port Angeles, Washington adopted its improvement Resolution No. 174 declaring its intention to order the improvement of a certain area within the City of Port Angeles by the construc- tion and installation of trunk, lateral and sub - sewers and by doing all work necessary in connection therewith and incidental thereto, and fixing a time for hearing on said resolution; and WHEREAS, such resolution was duly published in the manner required by law and notice of said hearing was duly given to the owners or reputed owners of all lots, tracts, parcels of land or other property to be specially benefited by the proposed improve- ment as shown on the rolls of the County Treasurer and directed to the address shown thereon; and, WHEREAS, said hearing was held on the 7th day of March, 1957 as provided in said resolution and notice and after hearing all protests against and statements in favor of said improvement the hearing was closed and the matter taken into consideration by the Council; and wfE??EAS, after long and careful consideration the Council decided that the improvement to be constructed was necessary for the public health, welfare and safety of the residents and property owners within said proposed local improvement district. NOW, THEREFO ?,E, BE IT ORDAINED by the City Council of the City of Port Angeles as follows: • Section 1: That it is hereby found and declared that the construction and installation of the hereinafter described trunk, lateral and sub - sewers are necessary for the public health, welfare and safety of the residents and property ow rs within said proposed local improver: eat district. Section 2: That the City shall construct and install the following described trunk, lateral and sub - sewers in, on, along and under the following described avenues, streets and alleys within the City of Port Angeles as follows: A. An 8" trunk sanitary sewer on the westerly margin of "M" Street from the alley between Sixth Street and Seventh Street; thence southerly along said "Y" Street to the southerly side of Seventh Street. B. An 8" lateral sanitary sewer on the southerly side of Seventh Street from "M" Street easterly to Lot 7, Block 2L8 of the Townsite of Port Angeles. A 6" lateral sanitary sewer con- tinuing easterly on said southerly side of Seventh Street to a lamp hole in front of Lot 1, Block 218 of the Townsite of Tort Angeles. C. An 8" late- -al sanitary sewer from a man hole on the southerly side of Seventh Street in front of Lot 7, Block 248 Town - site of Port Angeles; thence southerly th roagh said Lot 7 to the alley in said Block 248 between Seventh Street and Eighth Street. D. A 6" lateral sanitary sewer from a man hole in said alley between Seventh and Eighth Streets and between Lot 7 and Lot 14 in Block 248 Townsite of Port Angeles easterly to a lamp hole in said alley between Lot 1 and Lot 20 in said Block 24F, Townsite of Port Angeles. The above described improvements shall be constructed and installed in accordance with the maps, plans and specifications prepared by the City Engineer and now on file with the City Clerk, which maps, and specifications are hereby adopted as those re cessary and required for said improvement. -2- Section 3: That there be and is hereby established a local improvement district of the City to be known as Local Improve- ment District No. 17L., which district shall include all of the property within the following described aree: Beginning at the intersection of the West margin of "K" Street and Eighth Street at the Southeast corner of Block 2!j8 of the Townsite of Port Angeles; thence westerly along said Eighth Street to the lot line between Lot 14 and Lot 15 in Block 248 of said Townsite; thence northerly along, said lot line to the alley between Seventh Street and Eirrhth Street; thence westerly a ong said alley in said Block 248 to the westerly margin of "M" Street; thence northerly along said "M" Street and across Seventh Street to the alley between Sixth Street and Seventh Street; thence easterly to the easterly margin of "V" Street; thence southerly along said easterly margin of "•S" Street to Seventh Street; thence easterly along said Seventh Street to the westerly margin of "K" Street; thence southerly along the westerly margin of "K" Street to the point of beginning. Section 4: The entire cost and expense of said improvement, including all expenses incidental thereto, shall be borneby and assessed against the property included in the local improvement district heretofore created. The City of Port Angeles shall not be liable in any manner for any portion of the costs and expense of said improvement. Section 5: That the improvement district shall include all the property between the termini of the hereinbefore described improvements abutting upon, adjacent, vicine l or proximate to the street or alley proposed to be improved to a distance back of at least ninety feet from the marginal lines thereof, or to the center of the blocks facing or abutting thereon, whichever is the greater. Such assessments shall be computed by the zone and termini method unles the special benefits conferred on any of such properties are not fairly reflected by the use of such method, and in such case the assessi ent shall be computed in a manner which shall fairly reflect the special benefits derived from such improvement. Section 6: Bonds of said local improverent district bearing interest at a rate not to exceed six per cent (6) per annum, payable on or before twelve (12) years from date of issue, shall be issued in payment of the cost and expense of the improve- ments provided for herein, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within the district, payable in ten (10) equal installments and with interest at the rate of not to exceed five per cent (5 %) per annum under the mode of "payment by bonds" as defined by the law and the ordinances of the City of Port Angeles. Any assessment or installment thereof when delinquent and the interest due thereon shall bear a penalty of five per cent (5 %) of the total amount thereof from the date of such delinquency. That there be, and is hereby created, a fund of the City to be known as "Local Improvement District No. 174 Fund ", Warrants bearing interest at a rate of not to exceed six per cent (6 %) per annum shall be drawn on said fund based on estimates of the City Engineer in payment of the cost of construction of said improvements and all costs incidental thereto. The money received from the sale of said warrants shall be placed in "Local Improverrnt District No. 174 Construction Fund" of the City to be hereafter created and shall be used to nay all of such costs. Said bonds shall be delivered to the owners and holder of said Local Improvement District No. 174 Fund warrants in redemption of the same. he rate of interest to be borne by said warrants, bonds and installments of said assessments shall be as hereinafter fixed by resolution of, or upon motion duly made, seconded and passed by the City Council. Section 7; This ordinance shall be effective five days after its passage, approval and publication as required by law. IMPROVEMENT RESOLUTION NO. 1 7 if A RESOLUTION of the City Council of the City of Port Angeles declaring its intention to improve a certain area within the City by the construction and install -, ation of trunk, lateral and sub - sewers therein, inclu- ding wyes, manholes and by the doing of all'xork necessary in connection therewith, and fixing a time and date for the hearing on this resolution of inten- tion. BE IT RESOLVED by the City Council of the City of Port Angeles as follows: Section 1: That it is the intention of the City Council of the City of Port Angeles to order the improvement of the herein- after described area by the construction of sewers and appurtenances hereinafter described; said area being bounded as follows, to -wit: Beginning at the intersection of the West margin of T'K Street and Eighth Street at the Southeast corner of Block 248 of the Townsite of Port Angeles; thence Westerly along said Eighth Street to the lot line between Lot 14 and Lot 15 in Block 248 of said Town - site; thence Northerly along said lot line to the alley between Seventh Street and Eighth Street; thence Westerly along said alley in said Block 248 to the Westerly margin of "M" Street; thence Northerly along said "M" Street and across Seventh Street to the alley between Sixth Street and Seventh Street; thence East- erly to the Easterly margin of "M" Street; thence Southerly along said Easterly margin of "M" Street to Seventh Street; thence Easterly along said Seventh Street to the Westerly margin of "K" Street; thence Southerly along the Westerly margin of "K" Street to the point of beginning. Section 2: That the property to be improved by the construc- tion and installation of the herein described trunk and lateral sanitary sewers, together with the necessary manholes, inter- connecting sewers, sub - sewers and all necessary appurtenances for such improvement, and by doing all work necessary in connection therewith is as follows: (a). An 8" trunk sanitary sewer on the Westerly margin of "M" Street from the alley between Sixth Street and Seventh Street; thence Southerly along said "M" Street to the Southerly side of Seventh Street. (b). An 8" lateral sanitary sewer on the Southerly side of Seventh Street from "M" Street Easterly to Lot 7, Block 248 of the Townsite of Port Angeles. A 6" lateral sanitary sewer con- tinuing Easterly on said Southerly side of Seventh Street to a Lamp Hole in front of Lot 1, Block 248 of the Townsite of Port Angeles. (c). An 8" lateral sanitary sewer from a Manhole on the Southerly side of Seventh Street in front of Lot 7, Block 248 Town - site of Port Angeles; thence Southerly through said Lot 7 to the alley in said Block 248 between Seventh Street and Eighth Street. (d). A 6" lateral sanitary sewer from a Manhole in said alley between Seventh and Eighth Streets and between Lot 7 and Lot 14 in Block 248 Townsite of Port Angeles Easterly to a Lamp Hole in said alley between Lot 1 and Lot 20 in said Block 248, Townsite of Port Angeles. Section 3: It is hereby declared to be the intention of the Council to assess the entire cost of said sanitary sewer by the zone and termini method of assessment for the reason that the benefits of the improvement hereinbefore mentioned are most equitably distributed by the zone and termini method. Section 4: That the City of Port Angeles shall not be liable in any manner for any part of the cost of said improvement except in so far as said city is made liable by the statutes of the State of Washington in such cases made and provided and especially by the statute governing the application of the local improvement guarantee fund. Section 5: The City Engineer is hereby directed to submit to the Council at or prior to the date fixed for hearing on this improvement resolution a statement of the estimated cost and expense of such improvement, the portion thereof which shall and should be borne by each lot within the improved district, the local improve- ment districts assessments outstanding, pending and unpaid against the property therein, and the aggregate actual valuation of the real estate, including 25% of the actual valuation of the improve- ments in the proposed district according to the valuation last placed upon it for the purposes of general taxation, together with a diagram or print showing thereon the lots, tracts or parcels of land or other property which shall be especially benefitted by said improvement and the estimated amount of the cost and expense thereof to be borne by each lot, tract or parcel of land or other property within the proposed district. Section 6: All persons who may desire to object to such local improvement district are hereby notified to appear and present such objection at a meeting of the City Council to be held in the Council Chambers at 120 North Oak Street at 7:30 o'clock P.M. on Thursday the 7th day of March, 1957, which time and place is hereby fixed for hearing of matters relating to said improve- ment and all objections thereto and for determining the method of payment for the same. WHEREAS, a request has been presented to the City Council of the City of Port Angeles for the improvement of the alley running through Blocks 33 and 31. of the Townsite of Port Angeles and extending from the Westerly line of Oak Street to the Easterly line of Valley Street in the City of Port Angeles; now, therefore, BE IT RESOLVED by the City Council of the City of Port Angeles as follows: First: That it is the intention of the City Council to order the improvement of the alley in Blocks 33 and 34 of the Town - site of Port Angeles extending from the Westerly line of Oak Street to the Easterly line of Valley Street by the grading and surfacing of said alley and paving with 3" thick Type "F" asphaltic pavement and the construction of a combination storm and sanitary sewer, together with necessary manholes, catch basins and appurtenances, which may be found necessary and suitable to complete said improve- ment, and to establish and create a local improvement district for the payment of the cost thereof. Second: That the cost and expense of said grading and surfacing together with the construction of the necessary sewers and manholes and other facilities necessary to complete said improve- ment shall be bom a by and assessed to the property adjoining, approximate and o)ntig.uous to said alleys to be improved, and the City of Port Angeles shall not be liable in any manner for any portion of said improvement except in so far as said city is made liable by virtue of the statutes of the State of Washington in such case made and provided and particularly those statutes providing that the City of Port Angeles create a Local Improvement Guarantee Fund for the purpose of guaranteeing to the extent of such fund and in the manner provided by law the payment of bonds or warrants issued to pay for such local improvement. • Third: That it is the intention of the City Council that a local improvement district be formed consisting of Blocks 33 and 34 and bounded on the East by Oak Street, on the North by First Street, on the West by Valley Street, and on the South by Second Street and including all of Blocks 33 and 34 of the Townsite of Port Angeles, being the property adjoining, approximate and con- tiguous to the alleys to be improved. Fourth: That all persons who may desire to object to said improvement, or to any part thereof, are hereby notified to appear and present such objections at a meeting of the City Council to be held in the Council Chamber of the City in the Police Station at Front and Oak Streets in said city at the hour of 7:30 orclock P.M. on the 7th day of March, 1957, which time and place are hereby fixed for the hearing on the matters relating to said proposed improvement and all objections thereto and for determining the method of payment of said improvements. Fifth: That the City Engineer is hereby directed to submit to the Council at or prior to the date fixed for hearing on this resolution a statement of the estimated cost and expense of such improvement, a description of the boundaries of the district, the portion thereof which shall and should be borne by each lot within the improved district, a statement in detail of the local improve- ment assessments outstanding and unpaid against the property in the proposed district, and a statement of the aggregate actual valuation of the real estate, including 25% of the actual valuation of the improvements in the proposed district according to the value last placed upon it for the purposes of general taxation, together with a diagram or print showing thereon the lots, tracts, parcels of land or other property which shall be specially benefitted by said improvement, and the estimated amount of the cost and expense thereof to be borne by each lot, tract, parcel of land or other property within the proposed district. -.2- • Sixth: That the City Engineer and City Clerk are hereby directed to prepare and give notice of such hearing in the manner required by law.
