HomeMy WebLinkAbout1386ORDINANCE NO. / AN ORDINANCE of the City of Port Angeles providing for the improvement of a certain area within the City of Port Angeles by the construction and installation of sanitary and storm sewers therein and the install- ation of the necessary manholes, catch basins and appurtenances which may be necessary and suitable to complete said improvement and for the purpose of grading and surfacing the alley in Blocks 33 and 34. of the Townsite and paving with a 3" thick type "F" asphaltic pavement and the doing of all necessary work in connection therewith and incidental thereto pursuant to Improvement Resolution No. 175 passed and approved on the 17th day of February, 1957; creating a local improvement district therefor, and providing that the payment for said improvement be made by special assessments on the property in said district, payable by the mode of "payment by bonds." WHEREAS, on the 7th day of February, 1957 the Council of the City of Port Angeles adopted its Improvement Resolution No. 175 declaring its intention to order the improvement of a certain area within the City of Port Angeles by the construction and installation of certain sanitary and storm sewers and by the grading and improve- ment of the alley in Blocks 33 and 34. of the Townsite of Tort Angeles with a 3" thick type "F" asphaltic pavement and by doing all work necessary in connection therewith and incidental thereto, and fixing a time for hearing on said resolution; and WHEREAS, such resolution was duly published in the manner required by law and notice of said hearing was duly given to the owners cr reputed owners of all lots, tracts and parcels of land or other p o perty to be specially benefited by the proposed improve- ment as shown on the rolls of the County Treasurer and directed to the address shown thereon; and WHEREAS, said hearing was held on the 7th day of March, 1957 as provided in said resolution and notice, and after hearing all protests and statements in favor of said improvement the hearing was closed, a discussion of the same and of said improvement was held and after due consideration of the same the Council duly determined that said improvement to be as provided in said resolution was necessary for the public health, welfare and safety of the residents and the property ow/era within said proposed local improve- ment district. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Port Angeles as follows: Section 1: That the area hereinafter described in Section 2 shall be improved by the construction and installation of the following described improvements: A. Combination Storm and Sanitary Sewers. (1). An 8" storm and sanitary sewer in the alleys running East and. Wcst through Blocks 33 and 34, including necessary Wyes and services to the property line of each lot and necessary lamp holes and man holes. (2). A 10" sewer line from the alley through Blocks 33 and 34 where said alley meets approximately in the center of Cherry Street thence continuing northerly along said Cherry Street to an existing man hole at the intersection of Cherry Street and First Street, including the installation of a pump house containing a sewage lift pump along with all electrical installation for the operation of this pump. B. Alley Improvement. (1). The alley through Blocks 33 and 34 to be improved by the grading, ballasting and paving with a three inch (3 ") mat of type "F" asphaltic concrete for a distance of approximately 1,070 feet. The above described improvements shall be constructed and installed in accordance with maps, clans and specifications prepared by the City Engineer and now on file with the City Clerk, which maps, plans and specifications are hereby adopted as those necessary and required for said improvements. -2- Section 2: That there be, and is hereby established, a local improvement district of the City of Port Angeles to be known as Local Improvement District No. 175, which district shall include all of the property within the following described area: Beginning on the northwest corner of Lot 10, Block 34 of the Townsite of Port Angeles, which is on the southerly margin of First and Valley Streets; thence along the south line of First Street to the north- east corner of Lot 1, Block 33; thence southerly along the westerly margin of Oak Street to the southeast corner of Lot 20 in Block 33; thence westerly along the south boundary of Blocks 33 and 34 to the southwest corner of Lot 11, in Block 34; thence northerly along the westerly boundary of said Block 34 to the place of beginning. Section 3: It is hereby found and aeclared that the construction and installation of the hereinbefore described improve- ment of the alley and of the sewers are necessary for the public health, welfare and safety of the residents and property owners within said proposed local improvement district. Section 4: The entire cost and expense of said improvement, including all expenses incidental, thereto, shall be borne and assessed against the propety included in the local improvement district heretofore created. The City of Port Angeles shall not be liable in any manner for any portion of the cost and expense of said improvement. Section 5: That by reason of the nature of such improvement it is such that the special benefits conferred on the property are not fairly reflected by the zone and termini method and therefore the Council does hereby provide that the assessments shall be made against the property of the district in accordance with the special benefits derived therefrom and said assessments shall be made in accordance with the benefits conferred without regard to the zone and termini method. Section 6: Bonds of said local improvement district bear interest at a rate not to exceed six per cent (6 %) per annum, payable on or before twelve (12) years from date of issuance shall be issued in payment of the cost and expense of the improvements provided for herein, which bond shall be redeemed by the collection of special assessments to be levied and assessed upon the property within the district, payable in installments with interest at a rate not to exceed five per cent (5%) per annum, under the mode of "payment by bonds'' as defined by law and the ordinances of the City of Port Angeles. Any assessment or installment thereof when delinquent, and the interest due thereon, shall bear a penalty of five per cent (5 %) of the total amount thereof from the date of such delin- quency. That there be and is hereby created a fund of the City to be known as "Local Improvement District No. 175 Fund ". Warrants bearing interest at a rate not to exceed six per cent (6%) per annum shall be drawn on said fund based on estimates of the City Engineer in payment of the cost of construction of said improvements and all costs incidental thereto. The money received from the sale of said warrants shall be placed in Local Improvement District No. 175 Construction Fund of the City to be hereinafter created and shall be used to pay all of such costs. Said bonds shall be delivered to the owner and holder of said Local Improament District No. 175 Fund warrants in redemption of the same. The rate of interest to be borne by said warrants, bonds and installments of said assessments shall be as hereinafter fixed by resolution of or upon motion duly made, seconded and passed by the City Council. Section 7: This ordinance shall be effective five (5) days from and after its passage, approval and publication as • required by law. PASSED by the Council of the City of Port Angeles, Wash- ington, and approved by its Mayor at a regular meeting of said Council held this 71 day of March, 1957.
