HomeMy WebLinkAbout1393• ORDINANCE NO. ) 5 13 AN ORDINANCE of the City of Port Angeles, Washington approving and confirming the assessments and assessment roll of Local Improvement District No. 176 for the installation of lateral and sani- tary sewers, including Wyes to serve each lot, and by doing all work necessary in connection therewith and incidental thereto, for the con- struction of sewer in Block 67 of Leighton's Subdivision of the Townsite of Port Angeles, and levying and assessing the amounts thereof against the several lots, tracts and parcels of land and other property as shown on said assessment roll, providing for the payment of such assessments into Local Improvement District No. 176 Fund created by Ordinance No. 1389 of the City. WBEREAB, by Resolution No. 16 -57 of the City Council passed and approved on the 16th day of May, 1957 the time, place and date of the hearing on the assessment roll for Local Improvement District No. 176 was set and fixed at 7:30 o'clock P.M. in the Council Chamber at 120 North Oak Street in the City of Port Angeles on June 6, 1957; and, WHEREAS, notice of said hearing was duly and regularly given by publication in the Olympic Tribune, the official news- paper of the City of Port Angeles, on the 24th and 31st days of May, 1957 and by mailing a notice thereof at least fifteen days prior to said date of hearing to the owner or reputed owner of each lot, tract or parcel of land or other property whose name appears on such assessment roll at the address of such owner as shown on the tax rolls of the County Treasurer for the property described on the roll; and, WHEREAS, at the time and place of said hearing the Council met and duly considered said assessment roll and no protests were filed thereto, and after consideration and discussion and con- sideration of said assessment roll, the Council then ordered that said assessment roll as presented by confirmed in the manner required by law; now, therefore, BE IT ORDAINED by the City Council of the City of Port Angeles, Washington as follows: Section 1: That the assessments and assessment roll of Local Improvement District No. 176 for the improvement of the area therein described for the construction and installation of lateral and sanitary sewers therein, including Wyes to serve each lot, together with all necessary appurtenances thereto, and by doing all work necessary in connection therewith and incidental thereto, pursuant to Ordinance No. 1389 passed and approved on the 18th day of April, 1957 as such assessments now stand upon such assessment roll be, and the same are, hereby in all things approved and confirmed. Section 2: That each of the lots, tracts or parcels of land or other property shown upon said roll is hereby declared to be specially benefitted by said improvement in at least the amount charged against the same and the assessment appearing against each such lot, tract, parcel of land and other property is in proportion to the several assessments appearing on said roll. There is hereby levied and assessed against each such lot, tract, parcel of land and other property appearing upon said roll the amount finally charged against the same thereon. Section 3: That said amount, or any portion thereof, may be paid at any time within thirty days from the date of the first publication of the City Treasurer's notice that the assessment roll has been placed in her hands for collection without penalty, interest or cost and thereafter the sum remaining unpaid, if any, will be paid in ten equal annual installments with interest on the whole unpaid sum at the rate of four per cent (!}. %) per annum, such installments comming due each year commencing with the year 1957 on the date that is thirty days after the first publication of said notice and each year thereafter one of said installments, together with the interest due thereon, and all inatallements there- after to become due, shall be collected as provided by law and ordinances of the City of Port Angeles. Section ti: All of such assessments or installments thereof and interest and penalties, if any t% reon, when collected by the City Treasurer shall be paid into the "Local Improvement Dis- trict No. 176 Fund" created by said Ordinance No. 1389 and shall be used solely for the purpose of paying the principal and interest on warrants and bonds drawn upon or issued against said fund. Section 5: This ordinance shall take effect five days from and after its passage, approval and publication as provided by law. PASSED by the City Council of the City of Port Angeles and approved by the Mayor at a regular meeting held this Se Co4 day of July, 1957.
