ORDINANCE NO. /534
AN ORDINANCE of the City of Port Angeles authorizing
participation by the City in a lawsuit to recover
damages from certain pipe manufacturers; providing
for contributions toward costs of the lawsuit and
authorizing the Attorney General of the State of
Washington to conduct the litigation.
WHEREAS, certain pipe manufacturers from whom the City of
Port Angeles has procured pipe have been fined in Federal Court
for violations of the Sherman Anti -Trust Act in connection with
price fixing; and
WHEREAS, the Attorney General of the State of Washington
is prepared to bring and has asked certain cities to join in an
action against said manufacturers to recover treble damages for
violations of said Act; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES as follows:
Section 1. The City of Port Angeles shall participate with
other cities in a lawsuit to be conducted by the Attorney General
of the State of Washington in behalf of said cities against certain '
pipe manufacturers to recover damages for violations of Federal
law.
Section 2. The City shall advance the sum of $1,000.00 to
a special fund for actual costs of litigation and shall contribute
lin the future its pro rata share of the costs of litigation in
said lawsuit as the same are incurred, but the total amount shall
not exceed $2,000.00.
Section 3. The Attorney General's office is authorized to
sign on behalf of the City pleadings and other documents in connec-
!tion with said litigation, and the City Attorney of the City of
Port Angeles is authorized to sign an agreement with the Attorney
General of the State of Washington in the same form as other cities
participating in said litigation shall sign or have signed, which
provides for conduct of the litigation and payment of costs on a
pro rata basis; provided that, this agreement shall be binding
on the City only if the City of Seattle executes a like agreement.
