ORDINANCE NO. /‘61,3
AN ORDINANCE authorizing a settlem -nt agreement of the
antitrust suit of the City against Kuhlman Electric
Company.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT
ANGELES that Joseph L. Alioto, the Special Counsel engaged by the
City to prosecute the City's antitrust claim growing out of the
,purchases of electrical apparatus, be, and is hereby, authorized
to do the following:
1. To enter into an agreement with Kuhlman Electric
Company as attorney for the City and the other party plaintiffs
in the State of Washington cases and to compromise and settle the
,City's claim against said Company.
2. To receive the sum of $24,427.05 on behalf of all
his clients collectively, such sum to be apportioned by Mr. Alioto
on the basis of relative purchases by all his clients, of which
,the City shall receive the sum of $575.00 provided such Company
lishall not be required to inquire as to the application or distri-
bution of such sum amongst Mr. Alioto's clients.
3. To execute and deliver as agent for the City a
Covenant Not To Sue in the form attached hereto.
4. To move for a dismissal with prejudice of all
iclaims against Kihlman Electric Company transferred to the United 1
States District Court for the Eastern District of Pennsylvania.
