WHEREAS, the City of Port Angeles has heretofore adopted the 1964 edition of the Uniform Sign Code; and WHEREAS, it is. deemed advisable to provide for a more flex- ible method of appealing decisions of the Building Inspector;. now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ANGELES as follows: Section 1. Section S- 1.03(c) of the .Uniform Sign Code, 1964 edition is amended to read as follows: Section S- 103.(6) Appeals 1. The Planning Commission is hereby .designated as the Sign Code Board of Appeals,. hereinafter referred to as "the Board ". 2. Any person who has been ordered by the Build- ing Inspector to incur an expense. for the alteration or removal of any sign, or any .person whose application for a permit for a sign has been refused, may appeal to the Board by .serving written no- I' tice to the City Clerk. Such notice shall immediately be trans- mitted to the Board. Any .person appealing from an order or action of the Building Inspector shall accompany the notice with a check in the sum of fifteen dollars executed in favor of the City Trea- surer. :Upon the filing of a notice of appeal, the Building Inspector shall take no further action with regard to the sign involved until the'final. decision of the Board or the City Council on the appeal unless the Building Inspector finds that the sign involved, by reason of its condition, presents an immediate and serious danger. to the public, in which case, he shall order it repaired or removed. 3. The Board, or. its. 'duly authorized representa- tive, shall post two written notices in places within 200-.feet of the location or proposed location of the sign involved setting the date, place and time of the hearing at least ten days prior to a hearing. A public hearing shall then be held by the Board at which all interested persons shall have the right to appear and offer oral or written testimony. After the hearing, the Board, by a majority vote,' may affirm, .annul or modify the order or action of the. Building Inspector and grant a variance from the provisions of this Coder Provided that said variance is subject to the approval of the City Council. 4. Any person aggrieved by a final determination of the Board shall have the right of further appeal to. the City Council upon written notice of appeal to the City Clerk. Such appeal shall be promptly scheduled for a hearing by the City Council. at their next regularly scheduled meeting. The Council shall hear all pertinent data and make a binding determination upon all parties involved.
