The attached Exhibit "A" is hereby adopted as the official map of the City of Port Angeles, showing the loca- tion of the streets established by law as public streets. Section 3. The Clerk of the City of Port Angeles is hereby directed to record said map with the County Auditor, and the Clerk' is directed to certify on behalf of the City Council that the map designated as Exhibit "A" is the official established map of the City of Port Angeles. City Clerk of the City of Port Angeles, Washington 0 MAPPED STREET ORDINANCE .. for the CITY OF PORT ANGELES • THE CITY OF PORT ANGELES DOES ORDAIN AS FOLLOWS: Section 1. .PURPOSE An ordinance enabling Port Angeles to pare- serve the integrity of its comprehensive plan by establishing stan- dards for street widths according to functional classification of streets, regulation of building in and along mapped streets, as requisite in the interest of health, safety, morals and general welfare. Section 2. AUTHORITY In accordance with the Laws of Washington 1935, as provided for in RCW 35.63.080 through 35.63.110 and RCW 35.78, the City Council of Port Angeles enacts the following ordin- ance to carry out the following provisions: (1) To integrate through the police power the authority express- ed in RCW 35.63; RCW 35.78; RCW 58.12 and 58.16 to secure continuity between planning and land development. (2) To facilitate the adequate provision of transportation. (3) To lessen traffic congestion and accidents. (4) To permit recommendation and adoption of plans in part or in whole by functional subdivision of the subject matter. (5) To provide for adoption and enforcement of coordinated plans as part of a comprehensive plan for the advantageous development of the municipality. (6) To establish official maps for the whole or any portion of the muncipality and to regulate and restrict the erection, construc- tion, reconstruction, alteration, repair or use of buildings and structures or land as provided for in the state statutes and more specifically enumerated and in greater detail in RCW Section 35.63. Section 36 DEFINITIONS (1) Board The Board of Adjustment, an independent board created under the zoning ordinance of the City to handle appeals and hard- ship cases, and having the same jurisdiction in the administration and enforcement of the Mapped - Street Ordinance, as designated there- in, in respect to review of the decisions and interpretations of the Mapped- Street Ordinance made by the City Engineer, the granting of special property uses, and the determination of variances based upon the finding of fact that hardship exists. (2) City Council The chief legislative body of the City:. (3) Commission The city planning commission. (4) Functional Classification of Streets Includes the following: (al Minor Access Streets Land service streets, including those plublic ways which are generally (1) limited to providing access to abutting property, (2) tributary to the higher type traffic - ways, (3) 1esigned to discourage fast; heavy and through traffic volumes. (b) Collector or Feeder Access Streets Slightly wider than service streets and public ways, primarily providing access to abut- ting property, but also designed to distribute traffic from minor access streets to the arterial trafficway system, including the principal entrance streets of a residential development, grid streets, and streets for circulation within development areas. (c) Secondary Arterials Routes designed (1) to serve secondary points of traffic interest within the community; (2) to carry through, fast traffic, and for moderately heavy traffic between neighborhoods, commercial and industrial districts; (3) to provide communication with outlying districts in the same degree; and (4) serve to distribute traffic between major arterials and the access streets; generally two or more traffic lanes. (d) Major Arterials Public way arteries which connect the focal points of traffic interest within the urban area; designed to carry maximum traffic volumes, consisting generally of more than two traffic lanes; provide communication between communities and outlying areas; arteries having relatively higher traffic volume, compared with lesser streets to justify median strips, left -turn lanes and /or lanes for acceleration and deceleration. Amendment of the functional classification by the addition of new types and /or changing the definition may be made by resolution to this ordinance; basic types shall be in accordance with RCW 35078 as amended. (5) Official Map Certain maps designated to show the location, size and dimension, together with reports relating thereto, of land areas deemed to be necessary for future public use, and a summary of certain provisions of the comprehensive plan or portions thereof, by establishing the limits and outside lines of land areas and per- mitted uses of areas of land being contemplated for use as sites for such future public improvements. (6) Plot Plan Scale drawings, showing the actual dimensions of the lot to be built upon and showing the size, the use and location of existing and proposed buildings to be erected thereon. (7) Street or Streets Relates to and includes streets, avenues, boulevards, roads, lanes, alleys and other trafficways. Section 4 COMPREHENSIVE PLAN OF MAJOR TRAFFICWAYS The Council, in compliance with the provisions of RCW 35.63.110 (Sec. 6, Laws, 1935, Rem.Rev.Stat.Sec.9322 -6) has prepared a comprehensive plan of major trafficways. Section 5 ENFORCEMENT AND ADMINISTRATION It shall be the duty of the city engineer to interpret, administer and enforce the provisions of this ordinance; issue permits for the use of land, erection, con- struction, reconstruction, alteration and repair of any building and /or structure or part thereof; he shall require that each applica- tion for a building permit shall include a plot plan of the land, specifications for and intended use of the proposed building; he shall issue permits for such uses that he finds conforms in all respects with the provisions of this ordinance; and he shall keep careful record of such applications and plot plans in the office of the city engineer. • • Section 6. MUNICIPAL PROCEDURE Any person, firm, or corporation, proposing to erect, construct, reconstruct, alter, repair, or use any location, site, parcel of land, buildings and /or structures, shall make application to the building inspector for a building permit, who shall refer the application to the city engineer for the purpose of establishing that the proposed use shall be in accordance with the provisions contained herein. Section 7. STANDARDS Existing or anticipated traffic volume and the function shall be the basic criteria for determining the classi- fication of any street. Determination of the classification shall be made by the planning commission in cooperation with the Depart- ment of Public Uorks and the city engineer's office. The uniform design standards provided for in RCW 35.78 and as prescribed by the city engineer, as may be subsequently amended, shall be the basis for all determinations. A. Minimum standards of width for advanced planning, which shall apply to all subdividing of streets as defined and enumerated in Section 3 shall be as follows: Right -of -Way Curb-to-Curb (1) Minor Access Streets 60 feet 34 feet (2) Collector or Feeder Access Streets 70 feet 40 feet (3) Secondary Arterials 70 feet 44 feet (4) Major Arterials 80 feet 54 feet B. Minimum standards of width which shall apply to all remedial planning, i.e., redevelopment of established streets, shall be as follows: Right -of -Way Curb -to -Curb (1) Secondary Arterials 60 feet 40 feet (2) Major Arterials 70 feet 44 feet (3) A one -way couplet may serve as a major arterial, in which case each leg of the couplet would conform to these minimum standards 70 feet 40 feet Section 8. PLATTING OF STREET LINES BY PLANNING COMMISSION The planning commission has adopted a comprehensive plan which includes a major street plan. The commission shall have the power to make or cause to be made, from time to time, surveys for the exact locating of the lines of new, extended, widened, or narrowed streets in the whole or in any portion of the municipality and its environs, and to make and certify to the city council a plat or plats of the area or areas thus surveyed, on which are indicated the locations of the lines recommended by the commission as the planned or mapped lines of future streets, street extensions, street widenings. or street narrowings. The making or certifying of a plat by the commission shall not in and of itself constitute or be deemed to constitute the opening or establishment of any street or the taking or acceptance of any land for street purposes. Section 9. ESTABLISHMENT OF OFFICIAL MAP After the commission duly adopts a comprehensive plan which includes a major street plan, and shall have certified a copy of such comprehensive plan to the -3- city council of the municipality, said city council may establish an official map of the municipality showing the location of the streets of the whole or of any part or parts of the muncipality theretofore existing and established by law as public streets. Such official map shall also show the location of the lines of streets on plats of subdivisions which shall have been approved by the planning commission of the municipality. Such official map shall also show the location of the lines of private streets on plats of subdivisions which, previous to the establishment of the official map shall have been approved under and in accordance with the provisions of earlier laws and ordinances. The city council shall certify the fact of the establishment of the official map to the County Auditor for official recording. Section 10. OFFICIAL MAP ADDITIONS AND CHANGES In the event that the official map established under Section 9 of this ordinance does not include the whole of the municipality, the city council may add to the official reap by placing thereon, from time to time, the lines of the streets which, at the date of the establishment of the official map, existed and were established by law as public streets in other part or parts of the municipality or had been approved as streets, public or private, in such other part or parts of the municipality under earlier provisions. The City council may also add to the official map by placing thereon, from time to time, thelines of streets in accordance with the plat of any subdivision which shall have been approved by the planning commission. The city council may make, from time to time, other additions to or modifications of the official map by placing thereon the lines of planned new streets or street extensions, widening, narrowings, or vacations; provided, however, that before taking any such action, the city council shall hold a public hearing thereon, notice of the time and place of which shall be given not less that 5 days previous to the time fixed therefor by one publi- cation in a newspaper of general circulation in the municipality and, in so far as their addresses appear in the county records, by mail to the record owners of lands on or abutting which the propos- ed street lines are located; and provided further that such proposed addition to or modification of the official map shall be submitted to the planning commission for its consideration. Any street line location certified by the planning commission to the city council, as authorized by Section 1 of this ordinance s hall be deemed approved by the city council whithout further sub- mission thereof to said city council. The placing of any street or street line upon the official map shall not in and of itself constitute or be deemed to constitute the opening or establishment of any street or the taking or acceptance of any land for street purposes. Amending actions shall be effected by resolution. Section 11. REGULATION OF BUILDINGS IN BED OF MAPPED STREETS For the purpose of preserving the integrity of the official map, no permit shall be issued for any building or structure or part there- of on any land located between the mapped lines of any street as shown on the official map, except as specified in this section. ink VIP The Board of Adjustment or the planning commission shall have the power upon an appeal filed with it by the owner of any such land, to authorize the grant of a permit for a building or structure or part thereof within arysuch mapped- street location in any case in which such board or commission finds, upon the evidence and argu- ments presented to it upon such appeal, (a) that the property of the appellant of which such mapped - street location forms a part will not yield a reasonable return to the owner unless such permit be granted, or (b) that, balancing the interest of the city in preserving the integrity of the official map and the interest of the owner in the use and benefits of his property,the grant of such permit is requir- ed by considerations of justice and equity. Before taking any such action, the Board of Adjustment or planning commission shall hold a hearing thereon, at least 5 days notice of the time and place of which shall be given to the appellant by mail at the address speci- fied by the appellant in his appeal petition. In the event that the board or the commission decides to autho- rize a building permit, it shall have the power to specify the exact location, ground area, height and other details and conditions of extent and character, and also the duration of the building, structure, or part thereof to be permitted and a waiver must be obtained from the owner as required in Section 12. Section 12. ESTABLISHMENT AND REGULATION OF BUILDING SETBACK LINES ALONG BEDS OF MAPPED- STREETS For the purpose of encouraging reason- able densities, providing for the safety and general welfare, the regulation of building setbacks as provided in the zoning ordinance shall prevail along mapped - streets, except that along those streets of functional classification to accommodate additional volumes of traffic than expected on minor streets, an increase in building set back line on each side of the street shall be established and maintained as follows: (1) Collector or feeder access streets . . additional 5 feet (2) Secondary arterials . . . additional 10 feet (3) Major arterials . . . additional 15 feet (4) Where a one -way couplet serves as a major arterial, the additional setback shall be 5 feet. For the purpose of preserving the integrity of the comprehensive plan and official map as provided for in preceding sections, no permit shall be issued for any building or structure or part there- of between the setback lines and street lines except as provided below: The Board of Adjustment or planning commission shall have appeal functions in this matter similar to those described in Section 11 to candle individual harships of a unique nature. In instances where the street program is not contemplated for a considerable time, the board or commissionmay also permit construction between the building setback line and street right -of -way line, provided the owner files a waiver of claims of damage for the removal of any structures that may be in the restricted area when the street is constructed or widened. -5- Section 13. MUNICIPAL IMPROVEMENTS IN STREETS: BUILDINGS NOT ON MAPPED- STREETS Excepting in streets existing and established by law as public streets at the date of the establishment of the official map, no public water facilities, sewer, or other public utility or improvement shall be constructed after said date in any street until such street is duly placed on the official map. No permit for the erection of any building shall be issued unless a street giving access to such proposed building existed and was established by law as a public street at the time of the establish- ment of the official map or shall have been duly placed on the official map in accordance with the provisions in Section 9 and 10 of this ordinance; provided, however, that the applicant for such permit may appeal to the Board of Adjustment or the planning com- mission for hearing upon such appeal, notice of which shall be given as provided in Section 11 of this ordinance. The board or the commission shall have the authority to authorize a permit, subject to such conditions as the board or commission may impose, where the circumstances of the case do not require the proposed building to be related to existing streets or to streets as shown on the official map and where the permit would not tend to distort or increase the difficulty of carrying out the official map or comprehensive plan of the municipality. PENALTIES Whenever any person or persons, firm or firms, or one or more corporations have violated or failed to comply with the provisions herein contained, they shall be subject to a fine in any sum not to exceed $300.00, or imprisonment in the city jail for a period not to exceed 90 days, or both, such fine and imprisonment in the discretion of a court of competent jurisdiction for each day of each violation, for such offense or failure to com- ply with the provisions of this ordinance. Section 18. CONFLICT The provisions of this ordinance shall pre- vail in the event they conflict with the provisions of the city zon- ing regulations, and shall not prevail when in conflict with the provisions of the city building code, Section 19. VALIDITY In the event any section, subsection, para- graph, sentence, clause, or phrase of this ordinance is declared unconstitutional or invalid for any reasons, such decision shall not affect the validity of the remaining portions of this ordinance. Section 20. EFFECTIVE DATE The provisions of this ordinance shall be in full force and effect 5 days from and after its passage, approval, and legal publication of additions to the official map which is made a part of this ordinance now or henceforth, as pro- vided by law. Section 21. SHORT TITLE OF ORDINANCE This ordinance, which shall include the comprehensive plans as defined herein, shall hereafter be known as the "Mapped- Street Ordinance ".
