HomeMy WebLinkAbout1642ORDINANCE NO. //yG,2 AN ORDINANCE of the City of Port Angeles, Washington providing for the improvement of a certain area within the city generally known as East Lincoln Heights by the construction and installation of lateral storm sewers therein, the grading, bal- lasting and paving with asphaltic concrete of certain streets and alleys therein, the con- struction of curbs and gutters where necessary, and by doing all other work required in connection with such improvements, all pursuant to Improve - rient Resolution No. 189 of the City passed and approved June 6, 1968; creating a local improve- ment district therefor, providing for the payment of a portion of the cost of said improvements by special assessments upon the property in said District, providing for the creation of Local Improvement District No. 189 Fund and for the issuance and sale of local improvement district warrants and notes or bonds. WHEREAS, on June 6, 1968, the Council of the City of Port Angeles, Washington, adopted its Improvement Resolution No. 189 declaring its intention to order the improvement of a certain area within the city generally known as East Lincoln Heights by the construction and installation of lateral storm sewers therein, the grading, ballasting and paving with asphaltib concrete of certain streets and alleys therein, the construction of curbs and gutters where necessary and by doing all work recuired in connection therewith;• and WHEREAS, sa.d resolution was duly published in the Pen- insula Herald in the manner required by law and notice of said hearing was also duly given by mailing as required by law; and WHEREAS, said hearing was held on July 9, 1968, as pro- vided in said notice, various oral statements for and against the improvements were made and certain written protests were filed and after discussion of said improvements and due consideration thereof the Council has determined to order the construction and installation of the improvements hereinafter more oarticularly described and to create a local improvement district therefor; NOW, THEREFORE, DE IT ORDAINED by the Council of the City of Port Angeles, Washington, as follows: Section 1. The following described property within the city shall be improved by the construction of lateral storm sewers where necessary, together with all appurtenances and work required in connection therewith: "Beginning at the point which is on the centerline of the alley between 15th and 16th Streets and the projected easterly line of Lot 4 in Block 427 and on the westerly brink of Tumwater gulch; thence northerly along said westerly brink to the bluff of Port Angeles Harbor and the Northeast corner of Lot 15, Block 98; thence westerly along said bluff to the easterly margin of "E" Street; thence southerly along the easterly margin of "E" Street to the centerline of the alley between 4th and 5th Streets; thence westerly along the centerline of the alley between 4th and 5th Streets to the west- erly line of Lot 13, Block 115; thence southerly along the westerly line of Lot 13 to the northerly margin of 5th Street; thence easterly along the northerly margin of 5th Street to the easterly margin of ".E" Street; thence southerly along the easterly margin of "E" Street to the southerly margin of 8th Street; thence westerly along the southerly margin of 8th Street to the westerly line of Lot 5 and the north -south centerline of Block 256; thence southerly along the north -south center- lines of Blocks 256, 303, 316, 355, 368, 398, 411, and 432 to the northerly margin of 16th Street; thence easterly along the northerly margin of,l6th.Street to the easterly margin of "E" Street: thence south- erly along the easterly margin of "E" Street to the centerline of the alley between 16th and 17th Streets; thence easterly along the centerline of the alley between 16th and'l7th Streets to the easterly margin of "C" Street; thence southerly along the easterly margin of "C" Street to the centerline of the alley between 17th and 18th Streets: thence easterly along the centerline of the alley between 17th and 18th Streets to the westerly margin of "B" Street; thence northerly along the westerly margin of "B" Street to the northerly margin of 16th Street; thence easterly along the northerly margin of 16th Street to the easterly line of Lot 15, Block 42.8; thence northerly along the easterly line of Lot 15 to the centerline of the alley between 15th and 16th Streets; thence easterly along the center- line of the alley between 15th and 16th Streets to the westerly brink of Tumwater gulch, the point of beginning, all in the Townsite of Port Angeles." -2- Section 2. The following described streets shall be improved by grading, ballasting where necessary, constructing curbs and gutters where necessary, and paving with two inch compacted Bituminous Plant Mix: Fourth Street 200 feet East and West of A Street. Fifth Street from Turniat&r Bluff to E Street. Sixth Street from Tumwater Bluff to E Street. Seventh Street from Tumwater Bluff to E Street. Eighth Street from C Street to E Street. Ninth Street from Tumwater Bluff to B Street and from C Street to E Street. Tenth Street from A Street to E Street. Eleventh Street from A Street to E Street. Twelfth Street from Tumwater Bluff to E Street. Thirteenth Street from Tumwater Bluff to D Street. Fourteenth Street from Tumwater Bluff to 200 feet West of D Street. Fifteenth Street from Tumwater Bluff to E Street. Sixteenth Street from B Street to E Street. T. A Street from Fourth Street to the alley between Fifteenth and Sixteenth Streets: B Street from the alley between Fourth and Fifth Streets to Sixteenth Street. D Street from the alley between Fourth and Fifth Streets to Sixteenth Street. E Street from the alley between Fourth and Fifth Sts.to fifth Street, from Eighth Street to the alley between Twelfth and Thirteenth Streets and from Fifteenth Street to Sixteenth Street. Section 3. The following described alleys shall be improved by grading, ballasting where necessary, and .paving with two inch compacted Bituminous Plant Mix: Alley between Fourth and Fifth Streets from Tumwater Bluff to E Street. Alley between Fifth and Sixth Streets from Tumwater Fluff to E Street. -3- Alley between Sixth and Seventh Streets from Tumwater Bluff to E Street. • Alley between Seventh and Eighth Streets from Tumwater Bluff to E Street. Alley between Eighth and Ninth Streets from Tumwater Bluff to B Street and from C Street to E Street. Alley between Ninth and Tenth Streets from A Street to E Street. Alley between Tenth and Eleventh Streets from A Street to E Street. Alley between Eleventh and Twelfth Streets from A Street to E Street Alley between Twelfth and Thirteenth Streets from Tumwater Bluff to E Street. Alley between Thirteenth and Fourteenth Streets from Tumwater Bluff to 200 feat West of D Street. Alley between Fourteenth and Fifteenth Streets from Tumwater Bluff to 250 feet West of D Street. Alley between Fifteenth and Sixteenth Streets from B Street to E Street. Alley between Sixteenth and Seventeenth Streets from B Street to C Street. Section 4. The plans and specifications for the improvements described in Sections 1, 2 and 3 above as prepared by• the City Engineer and now on file are hereby adopted and approved. Section 5. There is hereby established a local improve- ment district of the city to be known as "Local Improvement District No. 189" which said district shall include all the property described in Section 1 above. Section 6. The City of Port Angeles will bear approx- irately $155,000.00 of the entire cost of the improvements and the remainder of the cost of said improvements shall be borne by and assessed against the property within Local improvement District No. 189 specially benefited by said improvements. Section 7. There is hereby created. a fund of the city to be known as "Local Improvement District No. 189 Fund" into -4- which fund there shall be paid all of the assessments collected in said district as and when directed by the ordinance confirming said assessments and the assessment roll therefor. Interim revenue warrants bearing interest at a rate of not to exceed 8% per annum shall be drawn upon said fund based upon estimates of the City Engineer and shall be sold to such person, firm or corporation or to such other funds of the city as may hereafter be provided by resolution of the City Council and in the manner provided by such resolution to furnish moneys for the payment of the costs of construction and installation of said improvements and costs incidental thereto as same shall be incurred. .The proceeds of sale of such interim revenue warrants shall be deposited in said fund and cash warrants drawn thereon in payment of such costs. Upon completion of the improvements and after the expir- ation of the 30 -day assessment prepayment period, installment notes or bonds of said local improvement district bearing interest at a rate of not to exceed 8% per annum and payable on or before twelve years from date of issue shall be issued for the redemption of the outstanding revenue warrants and shall be payable both principal and interest by the collection of special assessments to be levied and assessed upon the property within the district payable in ten equal annual installments with interest at a rate of not to exceed 8% per annum, all as provided by law and ordin- ances of the city. If bonds are issued they shall be in denom- inations of '$1,000 each, except for bond No. 1, the denomination of which shall be hereafter provided by resolution of the City Council. Section 8. This ordinance shall become effective five days from and after its passage, approval and publication. -D- r PASSED by the Council of the City of Port Angeles and approved by its Mayor at a regular meeting of said Council held this 9th day of July, 1968.
